2017-052 Authorize the Temporary Closing of a Highway and to Repeal By-Law No. 2005-125 (Line 11 South Closure)The Corporation of the Township of Oro-Medonte By-law No. 2017-052 A By-law to Authorize the Temporary Closing of a Highway and to Repeal By-law No. 2005-125. (Line 11 South Closure By-law) Whereas Section 11 (3) of the Municipal Act, 2001, S.O. 2001, as amended, authorizes a municipality to pass by-laws respecting highways, including traffic on highways; And Whereas the Council of The Corporation of the Township of Oro-Medonte deems it expedient to do so for the purpose of recreational activities; Now Therefore the Council of The Corporation of the Township of Oro-Medonte hereby enacts as follows: 1. That Appendix "A" form part of this By-law. 2. That this By-law may be cited as the "Line 11 South Closure By-law". 3. That By-law No. 2005-125 is hereby repealed in its entirety. 4. And that this By-law shall take effect on the final passing thereof. By-law read a First, Second and Third time, and Passed this 26th day of April, 2017. The Corporation of the Township of Oro-Medonte es as I Appendix "A" to By-law No. 2017-052 for The Corporation of the Township of Oro-Medonte 1.0 Definitions For the purpose of this By-law, the following definitions shall apply: "Chief Municipal Law Enforcement Officer" means a person appointed by the Council for the purpose of supervising and to carry out the enforcement of Municipal By- laws; "May" means discretionary and not mandatory. 2.0 Regulations 2.1 That Line 11 South in Hawkestone from Lake Simcoe north for a distance of approximately 179 metres, more or less, for the period of April 1St to May 1St in any calendar year, may be closed and/or locked, at the discretion of the Chief Municipal Law Enforcement Officer, for recreational purposes due to smelt fishing activities. 2.2 When the gate is to be locked, all agencies and residents affected by the closure will be notified prior to doing so. 3.0 Prohibitions 3.1 No person shall remove or deface any gate, barricade, sign or notice. 4.0 Offences 4.1 Every person who contravenes any provision of this By-law is guilty of an offence and shall be liable to fine pursuant to the Provincial Offences Act, R.S.O. 1990, c. P.33, and every such fine is recoverable under the Provincial Offences Act.
