Representing the Township were Mr. R.B. Watkin, Township Planning Consultant with Ainle and Associates and Ms. Kris Menzies, Township Planner. (This portion of the meeting was held In-Camera. ) 3. COMMUNITY SERVICES: following correspondence and items for discussion were a) County of Simcoe Recreation Department re: Recreational Bonspiel 1991 County by Johnson, seconded by Caldwell It is recommended that the Confidential Correspondence from Solicitor Alfred W.J. Dick, concerning the Township of Oro Road Closing, Part West Half Lot 1, Concession 7, (Parts 1-8, Plan 51R- 17872) and the Appraisal Report from Appraisers Canada, be received and the appraised value be accepted by the Council of the corporation of the Township of Oro, and further, the Administrator/Clerk advise Monica Interior Design Limited of the appraised value of these lands in order that this transaction can b completed or a transfer of ONE lot, acceptable to Council on a Registered Plan in trade for this Road Allowance, the final decisio to be at Council's discretion. Carried MOTION NO.4 Moved by Caldwell, seconded by Johnson It is recommended that the Confidential Correspondence from Solicitor Kelly Yerxa with the firm of Aird and Berlis with regards to the Status Report, be received, and further, the Administrator/Clerk respond to the Township Solicitors regarding th status of each file, and further, the appropriate action be taken. Carried - 4 - MOTION NO.5 Moved by Burton, seconded by Crawford It is recommended that the Report from Fred Haughton, Public Services Administrator, with regards to the 12th Line Obstruction 0 Highways By-Law, be received and adopted. Carried MOTION NO.6 Moved by Crawford, seconded by Burton It is recommended that correspondence from ontario Hydro with regards to Lakeview Ash Management Environmental Assessment; Existing Landfill options, be received, and further, the Administrator/Clerk be directed to advise the county Waste Management Department that the Corporation of the Township of Oro does not want any Coal Ash deposited within the Corporate Boundarie of the Township of Oro. Carried MOTION NO.7 Moved by Johnson, seconded by Caldwell It is recommended that the Correspondence from Mr. Steen Klint, Director of the Solid Waste Management Department of the County of Simcoe with regards to Tipping Fees 1991 Waste Management Budget, b received, and referred to Mr. Klint, advise how controls will be in place to ensure only Oro Township garbage is billed to Oro Township Carried MOTION NO.8 Moved by Burton, seconded by Crawford It is recommended that we do now go In-Camera @ 9:33 p.m. with Mr. Gord Campbell, Mr. Ron Watkin and Ms. Kris Menzies present. B. Watkin of Ainley and Associates Limited, with regards to Proposed Industrial Development on Parts of Lots 23 and 24, Concession 4, be received, and further, Ron Watkin be instructed to meet with the Developer's Planner and Township Planner to explain the nature of the Township's position. Carried. - 5 - MOTION NO. 11 Moved by Burton, seconded by Crawford It is recommended that the six (6) Council Committee Room chairs be offered For Sale to Adair Furniture in Exchange for other office furniture listed in the 1991 Capital Budget and the items to be exchanged will be at the discretion of the Administrator/Clerk. Carried MOTION NO. 12 Moved by Caldwell, seconded by Johnson It is recommended that Item 34 on Aird and Berlis Letter of Februar 4, 1991, be collected through their Litigation Department and an estimate of costs to achieve this be provided to the Township. Carried MOTION NO. 13 Moved by Burton, seconded by Crawford It is recommended that the correspondence from the Ministry of Transportation with regards to M.O.T. Provincial Highways Program, Class Environmental Assessment, be received and referred to the Public Services Administrator for a report back to the Department Head Meeting in March of 1991. Carried MOTION NO. 14 Moved by Johnson, seconded by Caldwell It is recommended that the Correspondence from the Township of Flos with regards to the Township of Flos Request for Reduction in the Speed Limit along County Road 22 in the vicinity of Craighurst, be received, and further, the Administrator/Clerk is directed to advis the Township of Flos and the County of Simcoe that the corporation of the Township of Oro supports the Township of Flos's position. Carried MOTION NO. 15 Moved by Crawford, seconded by Burton It is recommended that the Memo from Fred Haughton, Public Services Administrator, with regards to the Bass Lake Side Road and the 7th Line Deviation Road, be received, and further, the Administrator/Clerk is hereby authorized to direct the Public Services Administrator as follows: THAT he should review this correspondence and attached survey with Mr. Leo Longo, and accept the advice of the Township's solicitor, and further, if the solicitor agrees, the Treasurer be authorized t issue a cheque in the amount of $500.00 for a shared cost of the survey work, and further, an additional $250.00 for legal costs to register same. Supplementary Request Anti-Recession Fund, be received, and further, the Corporation of the Township of Oro directs the Public Services Administrator to apply to the Ministry of Transportation for the projects outlined i his memo dated February 7, 1991, and further, the Public Services Administrator address the Bridge on 15/16 Sideroad, Bridge between 1 & 2 Concession for widening. Trivett, Q.C. with regards to his client, John Waddell and his enclosed application for a rezoning, be received, and further, the Administrator/Clerk be authorized to send the rezoning application back to Mr. Trivett with copies of the proper application form, indicating what the Township's fees are for processing a rezoning application. Carried MOTION NO. 28 Moved by Crawford, seconded by Burton It is recommended that the Corporation of the Township of Oro support the initiative of the Oro/Barrie/Orillia Airport Commission in their endeavours to attract a Federal Service to the Oro/Barrie/Orillia Airport as outlined in correspondence dated February 1, 1991, signed by the Chairman of the Oro/Barrie/Orillia Airport Commission, and further, the Administrator/Clerk is hereby directed to correspond with the Minister of Transport indicating th municipality's support in this endeavour. Charge, be received, and further, that the Administrator/Clerk and Public Services Administrator be authorized to meet with the two O.P.P. Officers involved with the accident to review the incident and report to Council. Carried - 9 - MOTION NO. 30 Moved by Burton, seconded by Crawford It is recommended that WHEREAS, B.A.F.M.A. Incorporated was awarded its costs respecting its court challenge of By-Law No. 89-61; AND WHEREAS, B.A.F.M.A.'s solicitor has submitted its Bill of for paYment or assessment by the Court; AND WHEREAS, the Township's solicitor has advised that B.A.F.M.A.' solicitor is prepared to settle the Bill of Costs for less than as submitted; BE IT RESOLVED THAT the Township settle this matter by issuing a cheque in the amount of $4,855.31 (being fees $4,660.00; disbursements $195.31), payable to B.A.F.M.A. Incorporated, as a complete and final settlement of this matter. AND IT BE FURTHER RESOLVED THAT the Township Solicitor meet with B.A.F.M.A.'s Solicitor to discuss the resolution of all issues between the municipality and B.A.F.M.A. MOTION NO. 31 Moved by Johnson, seconded by Caldwell It is recommended that the Township of Oro after reviewing the I.E.E.
