09 03 1991 Public Minutes 7:00 c' THE CORPORATION OF THE TOWNSHIP OF ORO SPECIAL PUBLIC MEETING TUESDAY. SBPTBKBER 3.1111 @ 7:00 P.M. - COUNCXL CHAMBERS ORB HUNDRED AND SBVBNTY-FXRST MEETING 1188-1111 COUNCXL The following members of Council were present: Reeve Robert E. Drury Deputy Reeve David Caldwell Councillor David Burton Councillor Alastair Crawford Councillor Allan Johnson Also Present Were: Ms. Kris Menzies, Mrs. Lynda Aiken, Ms. Florence Hosick, Mr. Ralph Hosick, Bohdan Stukalo, Mr. Wm. Mccuaig, and One Member 0 the Press. Reeve Robert E. Drury chaired the meeting. Reeve Robert E. Drury opened the meeting by explaining to those present that this Public Meeting was to obtain public comments with respect to a proposed Zoning By-Law Amendment, pursuant to the provisions of the Planning Act, 1983, section 34 (12). The applicant has applied to rezone certain lands described as Lot 25 and Part Lot 26, Plan 863, Concession 10, (Hosick). To date, the Council of the Corporation of the Township of Oro have not made a decision on this application, other than proceeding to a Public Meeting. Only after comments are received from the Public, Township Staff and requested agencies within the appropriate time period, will Council make a decision on this application. Notice of the Public Meeting was mailed out on August 13, 1991, to all property owners within 400 feet of the subject lands. Reeve Robert E. Drury then asked the Clerk if there had been any correspondence received on this matter. The Clerk responded by indicating that correspondence had been received from the Simcoe County District Health unit requesting a fee for a site Inspection of the property. The Reeve then stated that those persons present would be afforded the opportunity of asking questions with respect to the proposed Zoning By-Law Amendment. Reeve Robert E. Drury then turned the meeting over to the Township Planner, Ms. Kris Menzies, to explain the purpose and effect of the proposed Zoning By-Law Amendment. Kris Menzies: The purpose of the application is a reques for a conversion to rezone certain lands from Seasonal Residential Use to a Permanent Residential Use. The current Official Plan designation of the property is Shoreline Residential and the current Zoning is Shoreline Residential. The request of Rezoning is to a General Residential Zone in order to allow a permanent year round occupancy of the property. The current site to allow for the conversion adheres to the policies of - 2 - Kris Menzies: the Township. As stated perviously the Simcoe County District Health unit, has a conditional objection in which they reques a $75.00 fee which is for a site Inspectio to be payable to the Simcoe County Distric Health Unit, be done and executed, prior t them commenting favourably or not favourably on the application. Florence Hosick: I cannot understand why we have to pay the $75.00, I thought I paid the $600.00 plus the G.S.T. and nothing was said that we would have to pay any more. Reeve Drury: It is not the municipality, it is the Simcoe County District Health unit requesting the $75.00. Florence Hosick: Why don't you pay the $75.00, it was not 0 our card that we had to pay more than the $600.00? Kris Menzies: Part of this answer is going to be an assumption on my part. The $624.50 that you paid, is a municipal fee to go through the conversion process. The fee that is requested from the Simcoe County District Health unit is something over and above that which the municipality is asking for. They feel, (this is where the assumption comes in) that they require a site Inspection of the property and the tile field system, in order to adequately judge whether or not they agree with the conversion process as one of the commentin agencies and they have an inspection fee 0 $75.00. Florence Hosick: On the form that you gave out, it exclusively told us what we had to do and it said the charge was $600.00 plus G.S.T. It did not say that we had to pay any more than that. I think that the $75.00 that they want from us should come from the $600.00. Kris Menzies: That $624.50 fee was based on the municipa processing and as you saw in the form you had to fill out, it said that we required Health unit approval. In order to get Health Unit approval, the Health unit is saying they require $75.00. Florence Hosick: I phoned the Health unit and they did not say anything about the $75.00. Ralph Hosick: We have already gone through the business of putting in the septic system, which was approved. I don't understand why it needs another inspection. Is this being requested by the municipality? Reeve Drury: No, this is being requested by the Simcoe County Health unit. . . - 3 - Kris Menzies: We require comments from various agencies and when we are looking at the conversion process, one of the agencies which we take a lot of credence to, in what they have to say, is the Health unit. Because essentially, the conversion rests on whether or not you have the applicable til field system in order to allow for the yea round use of the property. Now they are saying they will not comment yes or no, on the conversion, until they do a site Inspection of the property. Ralph Hosick: Supposing I had put in my septic system si months ago, would they still require to come and take a look at the property. Kris Menzies: They mayor may not. I really can't comment on what they would require. They are governed by Simcoe County. Councillor Crawford: How long ago was your septic tank put in? Ralph Hosick: About twelve years ago. councillor crawford: The whole conversion policy is based on th fact that you have a septic system which i satisfactory for year round use. The Reeve after enquiring and ascertaining that there were no further questions from those present, thanked those in attendance for their participation and advised that Council would consider all matters before reaching a decision. He then advised those present that if they wished to be notified of the passing of the proposed By-law, they should leave their name and address with the Clerk.
