Drury Also Present Were: Mr. Raymond Sanford, Mr. Allen Sergent, Ms. Phyllis Cooney, Ms. Phyllis Mould, Ms. Doris Riffer, Mr. Nick Pollock, Mr. Michael Oliver, S. Giles, Mr. Douglas wilson, Mr. Char Hastings, Mr. stephen Woodrow, Mr. Hastings, Mrs. Doris Church, Mr. Gordon Church and Mr. Carl Cumming. staff Present: Ms. Kris Menzies, Mr. Henry Sander. Deputy Reeve David Caldwell chaired the meeting. Deputy Reeve David Caldwell opened the meeting by explaining to those present that this Public Meeting was to receive public comments with respect to a proposed zoning By-Law Amendment, pursuant to provisions of the Planning Act, 1983, section 34 (12). The applicant has applied to rezone certain lands described as Lot 20, Concession 5, (Hastings). To date, the Council of the Corporation of the Township of Oro not made a decision on this application, other than proceeding to this Public Meeting. Only after comments are received from the Public, requested agencies and Township Staff, within the appropriate time period, will Council make a decision on this application. Notice of the Public Meeting was mailed out on september 16, 1993, to all property owners within 120 metres of the subject lands. Notice of the Public Meeting was also placed in both the Barrie Examiner and Orillia Packet and Times on September 16, 1993. Deputy Reeve David Caldwell then asked the Clerk if there had been any correspondence received on this matter. The Clerk responded indicating that no correspondence had been received resulting from the recent circulation. The Deputy Reeve then stated that those persons present would be afforded the opportunity of asking questions with respect to the proposed Amendment. He then turned the meeting over to the Tow Planner, Ms. Kris Menzies, to explain the purpose and effect of proposed Zoning By-Law Amendment. - 2 - Kris Menzies: The subject property is located on Part Lot 20, Concession 5. The purpose of tonights meeting is to afford Council the opportunity to hear public comments on rezoning application before making a decision. The subject property is designated Hamlet which permits Res development. The Zoning is "H" which is Holding Zone. The proposal before Counci this evening is to rezone the property to "RG" General Residential, to bring the zoning into conformity with the Official Plan and permit the development of a thirteen lot residential Plan of Subdivision. Upon receipt of public comment, Council will be in a position to consider comments for approval or denial the rezoning application. There are no engineering consultants here on the proponents behalf, so perhaps your questions can be directed to myself or Mr. Hastings and we will try to address them for you. Note: Comments made at this meeting are not verbatim from a recording device but are derived from the notes taken by staff. Ray Sanford: What is this development going to do to wells? The wells in the area are already contaminated with nitrates. Kris Menzies: The Township of Oro requires the owner to provide the municipality with a Draft P of Subdivision and comments are received from various agencies, including the Ministry of the Environment. A hydrogeological report is required and reviewed by the Ministry of the Environment. This report has been submitted to the Ministry of Environment and they have stated that the hydrogeological study indicates that thirteen lots can be developed on the property and still meet the ontario Drinking Water objectives. Ray Sanford: Is the stream down the 5th Line going to diverted? Kris Menzies: If the stream has adverse effects, it wil be diverted or altered. Ray Sanford: The Simcoe County District Health unit never checked with the surrounding neighbours with regard to the nitrate contamination that has leached from the adjacent corn field. I am assuming the septic systems for this subdivision will going into the backyards. - 3 - Kris Menzies: The Simcoe County District Health Unit jurisdiction over this and their policies will have to be adhered to by the developer/owner. Doris Riffer: I have a shallow dug well and I am concerned about septic tanks and drainage. will it pollute my well? Gord Church: Why doesn't the road go through ROy Hastings: I do not own enough land. That area is in Carl Cumming's field. Deputy Reeve Caldwell: The property owner in between the Oro Bal field and the property Line, how much is behind, Roy? Kris Menzies: There is a block of land to be dedicated the Township at the west end, so there could be potential in the future. Phyllis Cooney: I am concerned about the drainage and my dug well. My well too is being contaminated. Deputy Reeve Caldwell: Council are not aware that there is a contamination of wells. The Health Unit does not tell the Township of this These concerns are dealt with between the Health unit and the Ministry of the Environment. Doris Riffer: Is there anything that can be done once Health unit and Ministry of Environment knows about it? What are you doing for water now? (Asked of Mr. Sanford) Ray Sanford: We buy bottled water. Deputy Reeve Caldwell: You can send us in a letter to let us you have had problems and we can ensure that these agencies are made aware, for purpose of this proposal. Could you let know whether your well is dug or drilled and how many feet in order that they can determine if its caused by surface or its into the aquifer. Ray Sanford: The drainage on the plan shows that I am going to get twice as much. I have an artesian well. There is a pond now in my backyard from the drainage. I am opposed to this development. There being no questions or comments, when being called for the third time, Deputy Reeve Caldwell in closing the meeting, thanked those in attendance for their participation and advised that Cou would consider all matters before reaching a decision.
