03 31 2004 C of A Minutes Committee of Adjustment Minutes 8 Thursday March 31. 2004. 5:00 p.m. In Attendance: Chairman Dave Edwards, Member Lynda Aiken, Member Allan Johnson, Member Michelle Lynch, Member Garry Potter, Senior Planner Andria Leigh and Junior Planner/Acting Secretary-Treasurer Andy Karaiskakis. 1. Communications and Correspondence -Letters received from Craig Cooper, Lake Simcoe Region Conservation Authority dated March 29, 2004 and Thomas McConkey, 235 Lakeshore Rd. W. received March 31, 2004. 2. Disclosure of Pecuniary Interest -None declared 8 3. Hearim!s: 5:00 2004-A-08 Diane Gundert Plan 807, Lot 9 to 10 Water Lot (Oro) 233 Lakeshore Road W. In Attendance: Diane Gundert, applicant, and Matt Price, agent/builder. Acting Secretary-Treasurer read letters from Mr. Craig Cooper, Lake Simcoe Region Conservation Authority, dated March 29, 2004 and from Thomas McConkey, owner of 235 Lakeshore Road W. dated March 31, 2004 verbatim to the Committee members and those present in the audience. Decision Moved by Garry Potter, seconded by Michelle Lynch "That the Committee hereby Grant Consent application 2004-A-08 as follows: 8 THAT PERMISSION TO EXPAND A LEGAL NON-CONFORMING USE IS GRANTED FOR 233 LAKESHORE ROAD FOR A 32.5 M2 (350 FT2) DECK ADDITION, A 17.65 M2 (190 FT2) ONE STOREY ADDITION ON THE WEST SIDE OF THE DWELLING AND A 7.8 M2 (84 FT2) ONE STOREY ADDITION ON THE EAST SIDE OF THE EXISTING DWELLING. and subject to the following conditions: 8 1. That the appropriate building permit be obtained from the Township's Chief Building Official only after the Committee's decision becomes final and binding, as provided for within the Planning Act RS.O. 1990, c.P. 13; 2. The west corner of the deck shall be setback no closer than 9.7 metres (32 feet) from the high water mark of Lake Simcoe; 3. The east corner of the deck shall be setback no closer than 6.1 metres (20 feet) from the high water mark of Lake Simcoe; 4. The additions would be required to meet the required setbacks to existing septic systems; 5. That the setbacks be in conformity with the dimensions as set out in the application and approved by Committee; and, 6. That the applicants obtain approval for a Change of Use Sewage Application from the Township of Oro-Medonte Building Department. ... ..Carried." 4. Other Business 8 1. Amend conditions of Consent for applications 2004-B-06 (Monica Interior Designs) & 2004-B-07 (Monica Interior Designs) Moved by Lynda Aiken, seconded by Allan Johnson "That the Conditions to Consent Application 2004-B-06 be modified to state: 1. That three copies of a Reference Plan of the subject lands prepared by an Ontario Land Surveyor be submitted to the Committee Secretary; 2. That the survey prepared by an Ontario Land Surveyor submitted by the applicant indicate and verify the location of the existing fence on the severed lands; 8 3. That the severed lands be merged in title with the residential lots and that the provisions of Subsection 3 or 5 of Section 50 of The Planning Act apply to any subsequent conveyance or transaction involving the subject lands; 4. That the applicants solicitor provide an undertaking that the severed lands and the lands to be enhanced will merge in title; 2 8 5. That the applicant prepare and submit a copy of the proposed conveyance for the parcel severed, for review by the Municipality; 6. That the applicant convey to the Township, free and clear of encumbrances, part of the former road allowance between Concession 6 and 7 for future drainage easements; and, 7. That the conditions of consent imposed by the Committee be fulfilled within one year from the date of the giving of this notice. .. ...Carried."
