Reeve Robert Drury chaired the meeting and called the meeting to order @ 9:00 a.m. 1. DISCLOSURE AND DECLARATION OF CONFLICT OF INTEREST: Reeve Robert Drury, Deputy Reeve David Caldwell and Councillor Alastair Crawford declared a conflict with Item 2(a) (2) of the Agenda, that being the litigation matter with B.A.F.M.A. The three members left the room when the motion was presented with Councillor Mortson assuming the chair. 2. DEPUTATIONS: a) 9:00 a.m. Mr. Leo Longo, Township Solicitor, was present to address Council on the followin matters: 1) with Mr. R. Nunn, owner of Part Lot 14, Concession 1, and Mr. Dale McKenzie, Skelton Brumwell were present re: proposed road improvements to the 1st Line as a result of Plan of Subdivision; 2) B.A.F.M.A. v. Township of Oro; General Discussion took place regarding the status of this litigation matter and the Confidential Correspondence from Fasken, Campbell, Godfrey; 3) Status Report O.P.A. #37; Reviewed Confidential Status Report from Aird and Berlis with Council and Kris Menzies and Ron Watkin; b) NOTE: 3. - 2 - 11:25 a.m. Mr. Ron Robinson, Township Engineer and Mr Henry Glavik were present to address Council with regards to the Report on Stormwater Management study for the Georgian Drive Secondary Plan Area (City 0 Barrie); All options were reviewed, specifically 2 and 2A and 6, which propose to maintain flows into the Township of Oro by constructing appropriate drainage infrastructure. The Township Engineers proposed an alternative option by combinin Options 2 & 4. The Clerk was directed to arrange a meeting with representatives of the City of Barrie in this regard. Council recessed @ 9:35 a.m. and reconvened the meeting @ 10:30 a.m. as well as recessing for lunch from 12:25 p.m. to 1:15 p.m. FINANCE, ADMINISTRATION AND FIRE: The following correspondence and items for discussion were presented: a) b) c) d) e) f) g) h) i) j) 4. PLANNING AND DEVELOPMENT: There was no correspondence or items for discussion presented. 7. COMMUNITY SERVICES: The following correspondence and items for discussion were presented: a) Deborah Broderick, Parks and Recreation Supervisor, Report re: Arena Concession Tender 1992/93; MOTION NO.1 Moved by Mortson, seconded by Crawford It is recommended that the Committee of the Whole Meeting Agenda, dated September 23, 1992, be adopted as printed and circulated. Carried MOTION NO.2 Moved by Crawford, seconded by Mortson It is recommended that the Confidential Report from Aird and Berlis regarding Official Plan Amendment No. 37, ontario Municipal Board Hearing respecting requests for adjournment, be received and adopted, and further, that site E located on Part Lot A, Concession 1, be re-examined for justification and staff be directed to furthe pursue with the Ministry of Agriculture and Food the validity of site 4. Carried MOTION NO.3 Moved by Crawford, seconded by Mortson It is recommended that the Report from Henry Sander, Treasurer, Acting Administrator, regarding the Nunn Subdivision and proposed costs associated to road work to be completed on Line 1, be receive and adopted. Carried MOTION NO.4 Moved by Caldwell, seconded by Crokam It is recommended that the Invitation from the Township of Vespra t participate in the Annual Midhurst World-Class Autumnfest Lot-sawin Contest on September 26th, 1992, at 1:00 o'clock p.m. be received and the following members of Council will participate: Deputy Reeve Caldwell and a designate Carried. - 4 - MOTION NO.5 Moved by Mortson, seconded by Crawford It is recommended that the Memo from Lynda Aiken, Deputy Clerk, regarding approval to sell Raffle Tickets to the Simcoe Area Womens Institute, be received and approved. Carried MOTION NO.6 Moved by Crokam, seconded by Caldwell It is recommended that the Memo from Lynda Aiken, Deputy Clerk, regarding Application for Nevada Lottery Licence from the Oro Minor Softball League, be received and approved, with the exemptions as requested being granted. carried MOTION NO.7 Moved by Mortson, seconded by Crawford It is recommended that the Memo from Ron Kolbe, regarding a Trainin Course to be held February 1-3, 1993, entitled Interpretation of th Building Code Act, be received and approved and that the expense be included within the 1993 Budget. Carried MOTION NO.8 Moved by Caldwell, seconded by Crokam It is recommended that the Confidential Report from Henry Sander, Treasurer, Acting Administrator, regarding Employment Contract, be received and adopted. carried MOTION NO.9 Moved by Crokam, seconded by Caldwell It is recommended that the Confidential Correspondence from the Township of Medonte regarding a Personnel Matter, be received. Carried MOTION NO. 10 Moved by Crokam, seconded by Mortson It is recommended that the copy of the Confidential Correspondence from Fasken, Campbell, Godfrey to Aird and Berlis re: B.A.F.M.A. Incorporated vs. Township of Oro, be received and the Township Solicitor, Leo Longo be directed to respond with a draft document for Council's review. White to Gibson and Adams, regarding Township of Oro, winfull Properties, be received and the Reeve and Clerk be authorized to execute the agreement, upon confirmation and return from Winfull Properties Incorporated. carried - 5 - MOTION NO. 12 Moved by Crokam, seconded by Crawford It is recommended that the Report from Fred Haughton, Public Services Administrator, regarding Springhome Road/Maarse - Ditches, be received and Council give consideration to installing tile and ditch regrading during 1993 Budget. Carried MOTION NO. 15 Moved by Caldwell, seconded by Crokam It is recommended that the correspondence from Keith Sanderson, regarding entrance to Guthrie united Church from Line 4, be referre to the Public Services Administrator for a review of the previous arrangements made with the Board and report back to Council.
