1988-021 Medonte By-law imposing special annual drainage rates upon land in respect of which money is borrowed under the Tile Drainage Act c: ...~ THE CORPORATION OF THE TOWNSHIP OF MEDONTE BY-LAW NUMBER 88-2 BEING A BY-LAW to stop up and sell a road allowance within the Township of Medonte WHEREAS too Municipal Act, R.S.O. 1980, Chapter 302, Section 298 (1) (c) authorizes Council to pass By-Laws "for stopping up any highway or part of highway for a specified period or periods of time". . AND WHEREAS the Munidpal Act R.S.O., 1980, Chapter 302, Section 298 (I) (d) . authorizes Council to pass By-Laws "for leasing or seHing the soil and freehold of a stopped up highway". AND WHEREAS pursuant to Section 30 I (1) of the Municipal Act, R.S.O. 1980, Chapter 302, a notice of this proposed By-Law has been published at least once a week for four consecutive weeks in a local newspaper and notice has been posted in the immediate neighbourhood of the Highway . AND WHEREAS the Council of the County of Simcoe has not objected to the passing of this By-Law NOW THEREFORE, Council of the Corporation of the TDwnship of Medonte enacts as follows: J) That a portion of road allowance in the Village of War minster between lots .5 and 6, Concessionlt,4 as shown as parts 2 and 4 on Reference Plan 51R-16357, be and .is hereby stopped up. 2) that the above noted road aHowance shaH be transferred to Mr. Edward Rix who is the abutting property owner 3) That this By-Law shall not take effect until it is registered in the proper land registry office. Whereas owners of land in the municipality have applied to the council under the Tile Drainage Act, for loans for the purpose of constructing subsurface drainage works on such land; and whereas the council has upon their application lent the owners the total sum of $.l.,,?9.9.~QQ............................. to be repaid with interest by means of rates hereinafter imposed: Be it therefore enacted, by the council, that annual rates as set out in the Schedule attached hereto are hereby imposed upon such land as described for a period of ten years, such rates to be levied and collected in the same manner as taxes.
