1989-021 Medonte By-law to stop and sell a road allowance within the Township of Medonte THE CORPORATION OF THE TOWNSHIP OF MEDONTE BY-LAW NUMBER 89-21 Medonte BEING A BY-LAW to stop and sell a road allowance within the Township of - WHEREAS the Municipal Act, R.S.O., 1980, Chapter 302, Section 298( 1) (c) authorizes Council to pass By-Laws "for stopping up any highway or part of highway for a specified period or periods of time"; AND WHEREAS the Municipal Act, R.S.O. 1980, Chapter 302, Section 298 (1) (d) authorizes Council to pass By-Laws "for leasing or selling the soil and freehold of a stopped up highway"; - AND WHEREAS pursuant to Section 301 (1) of the Municipal Act, R.S.O. 1980, Chapter 302, a notice of this proposed By-Law has been published at least once a week for four consecutive weeks in a local newspaper and notice has been posted in the immediate neighbourhood of the Highway; AND WHEREAS the Council of the County of Simcoe has not objected to the passing of this By-Law; NOW THEREFORE, Council of the Corporation of the Township of Medonte enacts as follows: 1) That a portion of unopen road allowance between lots 5 and 6 In the East Half of Concession 12 be and is hereby stopped up. 2) That the above noted road allowance shall be sold to abutting property owners. 3) That the purchasers shall pay $3,000.00 for the road allowance as well as all survey and legal costs associated with this sale. 4) That this By-Law shall take effect until it is registered in the proper land registry office. - READ A first and second time, read a third time and passed this 26th day of September, 1989. -
