1990-001 Medonte By-law to Establish the Collection, Removal and Disposal of Garbage, Ashes and other Refuse 'illWNSHIP OF MEJX)NTE BY-LAW NO. 1990-01 BEING A BY -LAW 'ill ESTABLISH THE CDLLEC'I'ION, REMNAL AND DISPOSAL OF GARBAGE, ASHES AND OTHER REFUSE --------------------------------------------------------------------------------- ~ WHEREAS The Municipal Act R.S.O. 1980, Chapter 302, section 210, Paragraph 85, 86, authorizes the passing of By-Laws to provide for the collection, removal and disposal of garbage, ashes and other refuse; WHEREAS it is deemed expedient to provide for a system of such collection, ~ removal and disposal; NOW THEREFORE THE CDUNCIL OF THE CORPORATION OF THE TOWNSHIP OF MEJX)NTE HEREBY ENACTS AS FOLIDWS: 1. DEFINITIONS (a) Garbage shall mean all rejected, abandoned or discarded household waste either animal or vegetable, all combustible garbage such as paper, cardboard, boots, shoes, and other wearing apparel, glass and tin food containers, and other refuse capable of being consumed by fire, except non collectable waste. (b) Ashes shall mean the residue of any household fuel after such fuel has been consumed by fire, all tins, bottles, crockery, glass, etc., not used as food containers, waste metal, lawn and garden cuttings and tree limbs cut in pieces not longer than three feet (3') and tied as bundles. (c) Occupant shall mean any owner, householder, lessee, tenant or any person in charge of any residential dwelling, apartment house, or portion thereof. ~ (d) Township Clerk shall mean the Clerk of the Corporation of the Township of Meodnte. (e) Township shall mean of the Corporation of the Township of Medonte. (f) Street shall mean any public highway, road, street, lane, alley, square, place, thoroughfare or way within the Township of Medonte. ~ (g) Recycling Material shall mean newspapers, glass food and beverage containers, tin and aluminum food and beverage containers and plastic "p . E. T ." beverage containers. ( h) Household Trash shall mean heavy bulky articles such as stoves, fridges, bedsprings, mattresses, furniture and any other discarded material which would normally accumulate at a dwelling but shall not include automobile parts, tree stumps or non-collectable waste. (i) Non-Collectable Waste shall mean any waste or matter other than garbage and ashes and shall include the following: ( i) ( ii) ~ ( iii) ( iv) (v) (vi) ( vii) ( viii) ( ix) (x) (xi) ( xii) (xiii) 2. DEFINED AREA ~ - 2 - Oil soaked or gasoline soaked rags and any explosive or highly combustible material of nature whatsoever. Broken plaster, lumber or other waste or residue resulting from the construction, alternation, repair, demolition or removal of any buildings or structure. Sawdust and/or shavings. Liquid waste. Hay, straw, and manure. Carcass of any animal. Live animals or birds. Fuel tanks. Any material which has become frozen to the receptacle and cannot be removed by shaking. Discarded truck and automobile tires. Manufacturers' waste. Natural soil, earth, sand, clay, gravel stones or other similar excavated materials. Fence wire. This By-Law shall apply to all improved residential properties within the Township of Medonte for the collection, removal and disposal by the Township of garbage, ashes, recycling material, and other refuse. 3. CDNTRACT FOR CDLLECTION The Township may enter into a contract with some person or Corporation for the collection, removal and disposal of garbage, ashes, recycling material, and other refuse upon such terms and conditions as the Council may be By-Law provide. ~ 4. RESPONSIBILITY OF OCCUPANTS ( a) No person shall set out for collection any garbage unless it is drained of all liquids, securely wrapped, and placed in a receptacle which shall be: ~ ( i) ( ii) ( iii) ( iv) Constructed of metal or plastic The volume of no more than 0.40 cubic metres Weigh no more than twenty-five kilograms (25 kg.) including contents, and Shall be provided with a water tight cover (b) No person shall set out for collection ashes unless they are cold and placed in proper receptacles. ( c) No person shall set out for collection newspapers, magazines, and any other paper in the form of sheets unless they are securely tied in convenient bundles and weighing no more than twenty-five (25) kilograms. 3 ( d) No person shall set out for collection any cardboard cartons, crates, barrel, or similar containers unless they are knocked down flat and securely tied in convenient bundles having a weight of no more than twenty-five (25) kilograms nor a volume greater than 0.40 cubic metres. ~ (e) No person shall set out for collection clippings from trees or shrubs unless they are canpacted and securely tied in bundles having a weight of no more than twenty-five (25) kilograms nor a volume greater than 0.40 cubic metres. ( f) No person shall set out a receptacle for collection unless it is placed adjacent to the nearest travelled street in such a manner as not to obstruct vehicular traffic. ~ (g) No person shall set out ashes, garbage, or other refuse for collection other than before the hour of seven 0' clock in the forenoon (7: 00 A.M.) of the day fixed for collection. (h) Any person setting out a receptacle for collection shall remove said receptacle from the roadside before the hour of seven o'clock in the afternoon (7: 00 P.M.) of the day which it was set out. (i) The number of receptacles put out for collection on any day set of collection shall not exceed eight (8) in number for each household. 5. GENERAL NUISANCE (a) No person shall suffer or permit within the Township the accumulation upon his premises or upon lands occupied by him or under his control or depositor permit to deposit upon any lands belonging to him or an occupation under his control of any garbage, animal or vegetable matter, household waste, recycling material, or any other matter or thing which may endanger public health. (b) No person shall sweep, throw, cast, lay or direct or suffer agent or employee to sweep, throw or cast, lay or deposit any ashes, garbage, or other refuse on any land, street, creek, roadway, or public place in the Township. (c) No person other than the occupant shall interfere with disturb, remove or scatter any garbage, ashes, recycling material, or other refuse set out for collection. ~ 6. TRANSPORTING WASTE MATERIAL AND REFUSE No person shall convey through the streets wi thin the Township any garbage, ashes, or other refuse, or any non collectable waste except in properly covered containers or on vehicles totally enclosed, or covered so as to prevent any of the contents falling upon the streets. ~ 7. SCHEDULE OF CDLLECTION (a) The Schedule of Collection of the said garbage, ashes, and recycling material shall be made in accordance with Schedule "A" attached hereto. The Township Clerk is hereby authorized to make such changes to the Schedule of Collection as are necessary from time to time, and to establish a Schedule of Collection for household trash, which will provide for collection on at least two separate occasions per year. (b) No person shall set out for collection any household trash except on such dates as are established for collection by the Township Clerk. (c) No person shall set out household trash for collection unless it is placed adjacent to the nearest travelled street in such a manner as not to obstruct vehicular traffic. - 4 - 8. TITLE This By-law may be cited as "The Garbage Disposal By-law". 9. ENFORCEMENT The By-law Enforcement Officer lS hereby authorized to enforce the provision of this By-law. ~ 10. PENALTY Any person found guilty of violating any of the provlslons of this By- law shall on a conviction thereof be liable to a fine of not less than $50.00 and not more than $2,000. 00 exclusive of costs, pursuant to the provisions of the Provincial Offences Act. 11. SEVERABILITY ~ Every provision of this By-law is declared to be severable from the remainder of the By-law, and if any provision of this By-law shall be declared invalid by a court of competant jurisdiction, such declaration shall not affect the validity of the remainder thereof.
