BY-LAW NO. 1990-31
A By-law to authorize the temporary use of certain lands, buildings and structures
for a use prohibited by Zoning By-law 1990-22 of the Township of Medonte
.
~ the Council of the Corporation of the Township of Medonte enacted Zoning
By-Law No. 1990-22;
AND ~ the Planning Act, 1983, Sections 34 and 38, give the authority for the
Council of a local municipality to pass by-laws to amend the zoning by-law to
authorize the temporary use of land, buildings and structures for any purpose set
out therein that is otherwise prohibited by the By-law;

R:W THEREFORE the Council of the Corporation of the Township of Medonte enacts as
follows:
1 . That for the purpose of this By-law, a temporary detached dwelling shall be
defined as follows:
"A detached dwelling for temporary use only for the period cormnencing
October 9, 1990 and expiring October 9, 1993, in accordance with the
provisions of Section 38 of the Planning Act, 1983, as amended."
2. That Schedule A 1, Zone Map, forming part of Zoning By-law 1990-22, is hereby
amended by the addition of "* 1" to the lands in part of Lot 1, Concession 1 0 ,
as shown on Schedule A attached, and that Schedule A attached forms part of
this By-law.
3. That in addition to the uses permitted in the Rural Zone in Subsection 2.19.2
of Zoning By-law 1990-22, and notwithstanding the maximum number of dwellings
permitted on a lot in Clause 2.19.4(c), on the lands shown as "*1" on Schedule
A of this By-law one (C1) temporary detached dwelling unit may be permitted.
4. That notwithstanding the minimum gross floor area for a dwelling in Clause
2. 1 9. 4 ( c), the minimum and maximum gross floor area for a temporary detached
dwelling shall be fifty (50) square metres and eighty--five (85) square metres
respectively.

5. That this By-law shall take effect and shall come into force pursuant to the
provisions of and Regulations made under the Planning Act, 1 983 and amendments
thereto.

hereinafter called "the Owner"

hereinafter called "the Township"
OF THE SECOND PART
. WITNESSES THAT
WHERFAS the Owner owns the land described in Schedule "A" to this
agreement, which is hereinafter referred to as "the land";
AND WHERFAS the Owner has requested the Township to amend the Township
Zoning By-law to permit the land to be developed in accordance with his
application;
AND WHERFAS the Township considers the Owner's request to be in the public
interest, provided that certain conditions as hereinafter set out are
complied with.
N:W'I'HERER)RE THE Owner covenants and agrees with the Township as follows:
1. This agreement affects the land described in Schedule "A" hereto and
the Owner hereby consents to the registration of this agreement
against the title to the land.
. 2. The Owner agrees to locate the temporary detached dwelling on the
land in accordance with the Site Plan Sketch attached as Schedule "B"
hereto.
3. The Owner will, before occupancy of the temporary detached dwelling,

provide connections to the existing sewage disposal systeltl and water
supply to the satisfaction of the Simcoe County District Health Unit.
The Owner agrees that, if an increased daily sewage flow puts undo
strain on the existing sewage system and the system fails, it will be
the Owner's responsibility to repair or replace the system to the
satisfaction of the Simcoe County District Health Unit.
The Owner agrees that, prior to ceasing to own the subject property,
he will remove the temporary detached dwelling.

6. The Owner shall be released from all obligations contained herein
upon the removal of the ternporary detached dwelling, at which time
the Township shall execute a Release in registrable form to be
registered on title at the expense of the Owner.
7.
This agreement shall be read with such changes of gender and number
as the context may require and shall enure to the benefit of and be
binding upon the parties hereto and their respective successors and
assigns.
