1991-008 Medonte 1 THE CORPORATION OF THE TOWNSHIP OF MEDONTE BY-LAW NO. 1991- 08 A By-law to amend Zoning By-law No. 82-25, as amended and Zoning By-law 1990-22, as amended e WHEREAS the Council of the Corporation of the Township of Medonte enacted Zoning By-law No. 82-25, as amended; e AND WHEREAS on July 24, 1990, the Council of the Corporation of the Township of Medonte enacted Zoning By-law 1990-22 to provide for updated, comprehensive zoning for the entire Township of Medonte and that By-law is not yet in effect at the date of passage of this By-law; AND WHEREAS the Planning Act, 1983, Section 34, gives the authority for the council of a local municipality to pass by-laws to amend the zoning by-law; NOW THEREFORE the Council of the Corporation of the Township of Medonte enacts as follows: 1. That Schedule A, Map 1, forming part of zoning By-law 1990-22, as amended, is hereby further amended by adding the notation "See Map 6" to a portion of the lands in Lot 11, Concession 13, and by adding Schedule A, Map 6, rezoning these lands to the Rural Estate Exception (R2-1) Zone, the Low Environmental Sensitivity (ES2) Zone and the Public Open Space (OS1) Zone as shown on Schedule A attached, and that Schedule A attached forms part of this By-law. e 2. That Schedule "A", Map "3", forming part of Zoning By- law No. 82-25, as amended, is hereby further amended by adding the notation "See Map "10"" to a portion of the lands in Lot 11, Concession 13, and by adding Schedule "A", Map "10", rezoning these lands to the Rural Estate Exception (R2-1) Zone, the Low Environmental Sensitivity (ES2) Zone and the Public Open Space (OSl) Zone as shown on Schedule B attached, and that Schedule B attached forms part of this By-law. e 3. That a new Subsection 2.2.4 "R2 Zone Exceptions" is hereby added to Subsection 2.2 "Rural Estate (R2) Zone" of Zoning By-law 1990-22 following Subsection 2.2.3, "R2 Zone Regulations": "2.2.4 R2 Zone Exceptions R2-1 Notwithstanding any other prov~s~on of this By-law to the contrary, the lands in part of Lot 11, Concession 13, shown as R2-1 on Schedule A, Map 1, e e e e 4. - 2 may be used for a maximum of thirty-two (32) rural estate lots, subject to the following provisions: the minimum lot area in the R2-1 Zone shall be 4000 square metres; the total area of a lot, including any lands zoned R2-1 and ES2, shall be a minimum of 8090 square metres; the minimum lot frontage shall be 41 metres; for a lot surrounded by streets, the front lot line shall mean the longest lot line of the lot and the minimum yard requirement for all yards and for all buildings and structures, including accessory buildings and structures, shall be twelve (12) metres; and, the minimum setback for any building, structure or vegetative disturbance shall be 7.5 metres from any lands shown as Low Environmental Sensitivity (ES2) Zone, and the twenty-three ( 23) metre minimum setback requirement for buildings and structures from watercourses in Subsection 3.7.1 shall only apply to those lots where the watercourse lies outside the boundary of the Low Environmental Sensitivity (ES2) Zone. In all other respects, the provisions of the Rural Estate (R2) Zone shall apply." That a new Subsection 2.21.26 "R2-1" is hereby added to Subsection 2.21 "Zone Exceptions" of Zoning By-law No. 82-25, as amended, following Subsection 2.21. 25, "RU- 10" : " 2 . 21. 2 6 R2-1 The lands in part of Lot 11, Concession 13, shown as R2-1 on Schedule "A", Map "3", may be used for a maximum of thirty-two (32) rural estate lots, subject to the following provisions: the minimum lot area in the R2-1 Zone shall be 4000 square metres; the total area of a lot, including any lands zoned R2-1 and ES2, shall be a minimum of 8090 square metres; 3 the minimum lot frontage shall be 41 metres; e for a lot surrounded by streets, the front lot line shall mean the longest lot line of the lot and the minimum yard requirement for all buildings and structures, including accessory buildings and structures, shall be 12 metres; and, e the minimum setback for any building, structure or vegetative disturbance shall be 7.5 metres from any lands shown as Low Environmental Sensitivity (ES2) Zone, and the minimum setback for buildings and structures shall be twenty-three (23) metres from a watercourse on a lot where the watercourse lies outside the Low Environmental Sensitivity (ES2) Zone. In all other respects, the provisions of the Rural Estate (R2) Zone shall apply." 5. That, upon Zoning By-law 1990-22 coming into force, Zoning By-law 82-25, as amended by this By-law, ceases to apply to the above-noted lands. 6. That this By-law shall take effect and shall come into force pursuant to the provisions of and Regulations made under the Planning Act. e Read a first time this 25th day of February , 1991.
