1991-020 Medonte THE CDRPORATION OF THE TOWNSHIP OF MEJX)NTE BY-LAW NUMBER 1991-20 a By-law to prohibit the obstruction of Highways and Bridges. the Municipal Act, R.S.O. 1980, Chapter 302, Sections 315.1 and 315.4 the Corporation to pass By-laws prohibiting the obstruction of - THEREFORE the Council of the Corporation of the Township of Medonte hereby as follows: DEFINITIONS (a) "bridge" shall mean a bridge fonning part of a highway or on, over or across which a highway passes. (b) "Corporation" shall mean the Corporation of the Township of Medonte. ~ ( c) "highway" shall mean a carmon and public highway under the jurisdiction of the Council of the Corporation and includes any untravelled portion thereof. 2 OBSTRUCrIONS ( a) No person shall obstruct, encumber, injure or foul a highway or bridge. (b) No person shall build or maintain a fence or sign on a highway. (c) No person shall place or deposit a sign or any other thing calculated to obstruct or interfere with public travel on a highway or bridge. (d) Any person who contravenes the provlslons of paragraph 2(a), 2(b) or 2(c) of this By-law shall remove such obstruction, at the expense of such person, within 3 days after receipt of a written request for such rerroval fram the Corporation. Such written request shall be deemed to have been received on the third day following the date of mailing by pre-paid registered post. ~ 3 PENALTY Any person who contravenes any of the provlslons of this By-law shall be guilty of an offence and shall be liable to a fine of not more than $2,000. 00 , exclusive of costs, for each contravention and each day of contravention shall constitute a separate offence. 4 VALIDITY ~ If any provision of this By-law is, for any reason, declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the By-law as a whole, or any part thereof other than the provision so declared to be invalid and it is hereby declared to be the intention that all the remaining provisions of this By-law shall continue to be in full force and effect until repealed, notwithstanding that one or more provisions thereof shall have been declared to be invalid.
