1991-026 Medonte THE CORPORATION OF THE TOWNSHIP OF MEDONTE BY-LAW NO. 1991 -26 A BY-LAW TO STOP UP, CLOSE AND SELL part of the untravelled portion of the original road allowance between Lots 5 and 6, Concession 10, and part of the untravelled portion of the given road across the easterly half of Lot 6, Concession 10, in the Township of Medonte, County of Simcoe, more particularly described in Schedule "A" attached hereto. ~ WHEREAS pursuant to Section 298( 1) of the Municipal Act, R.S.O. 1980, Chapter 302, and amendments thereto, Council is empowered to stop up and close any part of a highway; AND WHEREAS pursuant to Section 298(1) of the said Municipal Act, Council is empowered to sell any part of a highway which is legally stopped up and closed; - AND WHEREAS pursuant to Section 316 of the said Municipal Act, as amended, Council is required to set the sale price of the lands to be sold by by-law, and to offer to the owner of the lands abutting, the lands to be sold; AND WHEREAS that part of the original road allowance between Lots 5 and 6, Concession 10, and that part of the untravelled portion of the given road across the easterly half of Lot 6, Concession 10, more 'particularly described in Schedule "A" attached hereto are no longer required for municipal purposes; AND WHEREAS pursuant to Section 301(1) of the said Municipal Act, the Clerk of the Township of Medonte did cause a Notice of the proposed By-law to stop up, close and sell the lands described in Schedule "A" to be published for four consecutive weeks in a newspaper or newspapers of local circulation, and did cause such notice to be posted up for at least one month in six of the most public places in the immediate neighbourhood of the said lands; NOW THEREFORE THE COUNCIL OF THE TOWNSHIP OF MEDONTE HEREBY ENACTS AS FOLLOWS: 1. Stop Up and Close - This Council does hereby stop up and close the untravelled portion of the original road allowance, between Lots 5 and 6, Concession 10, and the untravelled portion of the given road across the easterly half of Lot 6, Concession 10, more particularly described in Schedule "A" attached hereto. t 2. Authorization of Sale - This Council does hereby authorize the sale of the lands described in Schedule "A" attached hereto, to the owner or owners of the abutting lands. 3. Sale Price - In accordance with Section 316 of the said Municipal Act, this Council hereby sets the sale price for the said lands at the rate of zero dollars per acre. t 4. Execution of Documents - The Reeve and Clerk are hereby authorized to sign all documents to carry out the intent of this By-law. 5. Clerk's Affidavit - There shall be attached to this By-law as Schedule "B" an Affidavit of Gary Cunnington, Clerk of the Corporation of the Township of Medonte, setting out the procedures taken for the publishing and posting of the said Notice pursuant to the provisions of the Municipal Act. 6. In the event that the owner of the lands abutting the lands described in Schedule "A" hereto does not exercise the right to purchase specified above within a period of thirty (30) days of the date of the passage of this by-law, the Council of the Township of Medonte may sell the said lands to any other person at the price set out herein, or at a greater price. 7. By-law no. 1990-34 of the Corporation of the Township of Medonte is hereby repealed. The Deponent I am the Clerk of the Corporation of the Township of Medonte, and as such have knowledge of the facts herein deposed to. 2. Publication and Posting Pursuant to Section 301 of the Municipal Act, R.S.O. 1980, Chapter 302, and amendments thereto, I did cause there to be published in the Coldwater Canadian, a newspaper of local circulation, and to be posted up in six of the most public places in the linmediate neighbourhood of the said highway, a Notice of the proposal by the Corporation of the Township of Medonte to pass a by-law to stop up, close and to sell the origian1 road allowance between Lots 5 and 6, Concession 10 and part of the untravelled portion of the given road across the eater 1 y half of Lot 6, Concession 1 0, in the Township of Medonte, County of Simcoe, more particularly described as Parts 3 and 4 on Plan 51R-21689. 3. Copy of Notice Attached to this my Affidavit as Exhibit "A" is a copy of the actual Notice as it appeared in the Coldwater Canadian. ~ Dates of Publication and Posting The first publication was on the 1st day of August and it continued thereafter for 4 consecutive weeks, the last publication being on the 22nd day of.Allgus:t~t''f4The posting in six of the most public places in the linmediate neighbourhood of the said highway took place on the 18th day of July and such Notices remained on the sites for at least one month. 4. e 5. Additional Notification Notice of the proposed road closing was sent to Bell Canada, Ontario Hydro, Department of Public Works, Ministry of the Environment, Ministry of Natural Resources and Ministry of Transportation and Carmunications, and they have all advised in writing that they have no objection to the road closing. e 4L Council Meeting The proposed by-law came before the Municipal Council at its regular meeting on the 26th day of AugustAWd at that time, no person or persons made any claim that his land would be prejudicially affect by the By-law, nor did any person apply to be heard. 6.
