1991-027 Medonte 1 THE CORPORATION OF THE TOWNSHIP OF MEDONTE BY-LAW NO. 1991- 27 A By-law to amend Zoning By-law No. 82-25, as amended and Zoning By-law 1990-22, as amended e WHEREAS the Council of the Corporation of the Township of Medonte enacted Zoning By-law No. 82-25, as amended; e AND WHEREAS on July 24, 1990, the Council of the Corporation of the Township of Medonte enacted Zoning By-law 1990-22 to provide for updated, comprehensive zoning for the entire Township of Medonte and that By-law is not yet in effect at the date of passage of this By-law; AND WHEREAS the Planning Act, 1983, Section 34, gives the authority for the council of a local municipality to pass by-laws to amend the zoning by-law; NOW THEREFORE the Council of the Corporation of the Township of Medonte enacts as follows: 1. That Schedule A, Map 2, forming part of Zoning By-law 1990-22, as amended, is hereby amended by rezoning lands in Part of Lot 55, Concession 1 to the Residential Holding Exception (Rl-8 (H)) Zone, to the Residential Exception (Rl-9) Zone and to the Residential Holding (R1(H)) Zone as shown on Schedule A attached, and that Schedule A attached forms part of this By-law. 2. That Schedule "A", Map "5", forming part of Zoning By- law No. 82-25, as amended, is hereby further amended by rezoning lands in Part of Lot 55, Concession 1 to the General Residential Holding Exception (Rl-8(H)) Zone, to the General Residential Exception (Rl-9) Zone and to the General Residential Holding (R1(H)) Zone as shown on Schedule B attached, and that Schedule B attached forms part of this By-law. e e 3. That Subsection 2.1.4 "R1 Zone Exceptions" of Zoning By-law 1990-22, as amended, is hereby amended by the addition of the following "Rl-8 (Lot 55, Concession 1)" and "Rl-9 (Lot 55, Concession 1) after "Rl-7 (Lot 12, Concession 8)": "Rl-8 Notwithstanding any other provision of this By-law to the contrary, the lands in part of Lot 55, Concession 1, shown as Rl-8 on Schedule A, Map 2, may be used for a maximum of seventy (70) 2 residential provisions: lots, subject to the following the minimum lot area in the Rl-8 Zone shall be 1660 square metres; the minimum lot frontage shall be 18 metres. e In all other respects, the provisions of the Residential (R1) Zone shall apply." "Rl-9 e Notwithstanding any other prov1s1on of this By-law to the contrary, the lands in part of Lot 55, Concession 1, shown as Rl-9 on Schedule A, Map 2, may be used only for a municipal water storage tower or standpipe, subject to the following provisions: the minimum lot area in the Rl-9 Zone shall be 1060 square metres; the minimum lot frontage shall be 6 metres. In all other respects the prov1s1ons of the Residential (R1) Zone shall apply." 4. That new Subsections 2.21.28 "R1-8" and 2.21.29 "Rl-9" are hereby added to Subsection 2. 21 "Zone Exceptions" of Zoning By-law No. 82-25, as amended, following Subsection 2.21.27, "RU-11": e "2.21.28 Rl-8 e Notwithstanding any other prov1s1on of this By-law to the contrary, the lands in part of Lot 55, Concession 1, shown as Rl-8 on Schedule A, Map 5, may be used for a maximum of seventy (70) residential lots, subject to the following provisions: the m1n1mum lot area in the Rl-8 Zone shall be 1660 square metres; the minimum lot frontage shall be 18 metres. In all other respects, the prov1s1ons of the Residential (R1) Zone shall apply." 3 "Rl-9 Notwithstanding any other provision of this By-law to the contrary, the lands in part of Lot 55, Concession 1, shown as Rl-9 on Schedule A, Map 5, may be used only for a municipal water storage tower or standpipe, subject to the following provisions: _ the minimum lot area in the Rl-9 Zone shall be 1060 square metres; the minimum lot frontage shall be 6 metres. _ In all other respects the prov1s1ons of the Residential (R1) Zone shall apply." 5. Holding Zone Provision (Zoning By-law 1990-22, as amended) (a) Holding (H) Zones are established and are identified on Schedule A, Map 2 of Zoning By-law 1990-22, as amended, by the letter (H) in parentheses following the zone sYmbols. (b) Where the zone sYmbol is followed by the letter (H) in parentheses, the provisions, requirements and restrictions of the zone sYmbol shall be the primary use category and such provisions shall apply to the zone, but only after a by-law to remove the letter (H) following the zone sYmbol comes into effect pursuant to Section 35 of the Planning Act. _ (c) Prior to the removal of the Holding Zone (H) sYmbol, only those uses, lawfully existing as of the date of passing of this By-law, are permitted. 6. Holding Zone Provision (Zoning By-law 82-25, as amended) e ( a) Holding (H) Zones are established and are identified on Schedule A, Map 5 of Zoning By-law 82-25, as amended, by the letter (H) in parentheses following the zone sYmbols. (b) Where the zone sYmbol is followed by the letter (H) in parentheses, the prov is ions, requirements and restrictions of the zone sYmbol shall be the primary use category and such provisions shall apply to the zone, but only after a by-law to remove the letter (H) following the zone sYmbol comes into effect pursuant to Section 35 of the Planning Act. 4 (c) Prior to the removal of the Holding Zone (H) symbol, only those uses, lawfully existing as of the date of passing of this By-law, are permitted. (d) Notwithstanding any other provision of this By-law to the contrary, the lands in Part of Lot 55, Concession 1, shown as R1(H) shall have a minimum lot area of 2025 square metres and a minimum lot frontage of 30 metres. _ 7 . That, upon Zoning By-law 1990-22 coming into force, Zoning By-law 82-25, as amended by this By-law, ceases to apply to the above-noted lands. _ 8. That this By-law shall take effect and shall come into force pursuant to the provisions of and Regulations made under the Planning Act. Read a first time this 23rd day of September , 1991.
