BY-LAW NO. 1991 - 29

A BY-LAW TO AUTHORIZE THE SALE OF part of the untravelled portion
of the original road allowance between Lots 5 and 6, Concession 10,
and part of the untravelled portion of the given road across the
easterly half of Lot 6, Concession 10, in the township of Medonte,
county of Simcoe, more particularly described in Schedule "A"
attached hereto.

WHEREAS pursuant to Sections 298 (1) and 316 of the Municipal Act,
R.S.O. 1980, Chapter 302, Council passed By-law 1991-26 on the 26th
day of August, 1991, to stop up, close and sell that part of the
original road allowance between Lots 5 and 6, Concession 10, and
that part of the untravelled portion of the given road across the
easterly half of Lot 6, Concession 10, more particularly described
in Schedule "A" attached hereto, to the owner or owners of the
abutting lands;
AND WHEREAS certain of the abutting owners declined to exercise
their right to purchase any portion of the lands described in
Schedule "A", or failed to exercise their right to purchase any
portion of the lands described in Schedule "A" attached hereto
within the 30 day period following the date of passage of By-law
1991-26, as required under the provisions of the said By-law;
AND WHEREAS pursuant to Section 316 (3) of the said Municipal Act,
the Municipality may proceed to sell the lands described in
Schedule "A" to any other person at the price set out under By-law
1991-26, or at a greater price, in the event that the abutting
owners entitled to purchase the said lands fail to exercise their
right to purchase within the period fixed by By-law;
NOW THEREFORE THE COUNCIL OF THE TOWNSHIP OF MEDONTE HERBY ENACTS
AS FOLLOWS:
1. Authorization of Sale - This Council does hereby authorize the
sale of the lands described in Schedule "A" attached hereto
to the remaining owners of the abutting lands, Bradley William
Blackwell and Joanne Aileen Blackwell, as Joint Tenants.

Sale Price - In accordance with Section 316 of the said
Municipal Act, this Council hereby sets the sale price for the
said lands at the price $2.00.
3. Execution of Documents - The Reeve and Clerk are herby
authorized to sign all documents to carry out the intent of
this By-law.

Conveyance to Munici~ality - Prior to the conveyance by the
Municipality of the lands described in Schedule "A" attached
hereto, a deed in registrable form in favour of the
Municipality for the lands described as Part of Lot 6,
Concession 10, Township of Medonte, County of Simcoe, being
Part 1 on Plan 51R-21689, executed by the registered owners
therefore, shall be delivered to the Municipality.
BY-LAW READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED ON
THE 15th day of October , 1991.
