1992-036 Medonte THE CORPORATION OF THE TOWNSHIP OF MEOONTE BY-LAW No. 1992-36 BE:llI; a By-law to deem Plan M-99 not to be a registered Plan of Subdivision for subdivision control purposes. STNlUIORY AU'lHJRIZATION - WHEREAS Subsection 4 of Section 50 of the Planning Act, R.S.O. 1990, c. P. 13 authorizes a ffilli1icipality to designate any Plan of Subdivision or part thereof that has been registered for eight years or more as not being a Plan of Subdivision for subdivision control purposes; DATE OF RHITS'lRATION AND WHEREAS Plan M-99 was registered on the 18th day of May, 1977; SUBDIVISION 1\GREEMENI' - AND WHEREAS the Mlli1icipa1ity had entered into a Subdivision Agreement providing for the orderly development of the lands set out in Plan M-99 with Brock & Colbourne Developments Limited, Jack Rumble and Jaudon Martin dated the 12th day of October, 1976; KJN-a:H'LIANCE wrrn SUBDIVISION .AGREEMENI' AND WHEREAS neither Brock & Colbourne Developments Limited, Jack Rumble and Jaudon Martin nor their successors in title have complied with the obligations imposed on the developer lli1der the Subdivision Agreement governing the development of Plan M- 99; PUBLIC INI'EREST - D:ERH;IS'lRATION AND WHEREAS C0lli1ci1 considers it in the public interest to deem Plan M-99 which applies to the same lands not to be Plans of Subdivision for subdivision control purposes in order to ensure the orderly development of the land; HJW 'I1:IEREFORE BE IT El'mCl'ED as a By-law of the Corporation of the Township of Medonte as follows: 2. D:EEMDK; - PIAN M-99 - That pursuant to Subsection 4 of Section 50 of the Planning ACt, R.S.O. 1990 c. P.13 (hereinafter called the "Act") the parts of Plan M-99 described as follows are hereby designated to be parts of the Plan of Subdivision which shall be deemed not to be parts of the Registered Plan of Subdivision for the purposes of Subsection 3 of Section 50 of the Act: (a) Lots 1 - 22 inclusive, and Blocks A and B, on Plan M-99, in the Village of Hil1sda1e (formerly in the Township of Medonte) COlli1ty of Simcoe, as more particularly described in Schedule "A" attached hereto; - 3. lUl'ICE That pursuant to Subsection 29 of Section 50 of the Act, the Clerk shall give notice of the passing of this By-law to each person appearing to be the owner of the lands, within 30 days of the date of passage of this By-law. - 2 - 4. :REJTISTERED MAIL The said Notice shall be sent by registered mail to the owners of the land to which this By-law applies, at their last known address.
