1992-049 Medonte THE CORPORATION OF THE TOWNSHIP OF MEDONTE BY-LAW NO. 1992- 4'1. A By-law to amend Zoning By-law No. 1990-22 WHEREAS the Council of the Corporation of the Township of Medonte enacted Zoning By-law No. 1990-22, as amended: e AND WHEREAS the Planning Act, R.S.O. 1990, Ch. P.13, Section 34, gives the authority for the council of a local municipality to pass by-laws to amend the zoning by-law: NOW THEREFORE the Council of the Corporation of the Township of Medonte enacts as follows: e 1. That Zoning By-law No. 1991-27 is hereby repealed in its entirety. 2. That Schedule A, Map 2, forming part of zoning By-law No. 1990-22, as amended, is hereby further amended by rezoning the lands in part of Lot 55, Concession 1, shown on Schedules A and B attached, from the Rural Exception (RU- 1) Zone to the Residential Exception (Rl-9) Zone and the Residential Exception Holding (R1-10(H)) Zone, and that Schedules A and B attached form part of this By-law. 3. That new subsections Rl-9 and R1-10 are hereby added to Subsection 2.1.4 "R1 Zone Exceptions" of zoning By-law No. 1990-22, following Rl-8: "Rl-9 (Lot 55, Concession 1) e Notwithstanding any other prov~s~on of this By-law to the contrary, the lands in part of Lot 55, Concession 1, shown as Rl-9 on Schedule A, Map 2, may be used only for a municipal water storage tower or standpipe, subject to the following provisions: the minimum lot area in the Rl-9 Zone shall be 1600 square metres; the minimum lot frontage shall be 6 metres. e In all other respects, the provisions of the Residential (Rl) Zone shall apply. Rl-lO (Lot 55, Concession 1) Notwithstanding any other prov~s~on of this By-law to the contrary, the lands in part of Lot 55, Concession 1, shown as Rl-lO on Schedule A, Map 2, may be used for a maximum of seventy-one (71) residential lots, subject to the following provisions: the minimum lot area in the Rl-lO Zone shall be 1660 square metres; the minimum lot frontage shall be 18 metres; a maximum of twenty-one lots in the R1-10 Zone shall have a minimum gross floor area of 93 square metres, which lots are shown on Schedule B attached to this By-law as Lots 1, 3, 5, 7, 9, 11, 13, 15, 17, 18, 20, 22, 23, 26, 29, 33, 43, 62, 64, 66, and 68. e In all other respects, the provisions of the Residential (Rl) Zone shall apply." 4. That this By-law shall take effect and shall come into force pursuant to the provisions of and Regulations made under the Planning Act. e 5. That By-law 1992-47 is hereby repealed. The Corporation of the Township of Medonte has received an application to change the zoning of Part of Lot 55, Concession 1. 2. This By-law will change the zoning on a portion of the subject lands from the "Rural Exception (RU-l) Zone" to the "Residential Exception (Rl-9) Zone" and the remainder to the "Residential Exception Holding (Rl- 10(H)) Zone". 3. The Residential Exception (Rl-9) Zone will allow the use of one lot, within a plan of subdivision in Hillsdale, for the erection and use of a municipal water storage tower or standpipe. This lot has less frontage and area than required for a standard residential lot in the Rl Zone. 4. The balance of the applicant's land will be zoned Residential Exception Holding (Rl-10(H)), which will ultimately allow the development of a maximum of seventy-one (71) residential lots. The lots will have a minimum frontage of 18 metres and a minimum lot area of 1660 square metres. As well, a maximum of 21 of these 71 lots may have a smaller minimum gross floor area of 93 square metres for a detached dwelling, and these lots are specifically identified in this By-law. The (H) Holding notation restricts the use of these lands at present to lawfully existing uses until Council removes the (H) symbol in accordance with the provisions of Subsection 3.26 of Zoning By-law 1990-22, as amended. 5. The changes in this By-law, with the exception of the lower minimum gross floor area for certain specified lots, were previously adopted by Council under By-law 1991-27 which came into force on September 23, 1991.
