1985-008 Medonte THE CORPORATION OF THE TOWNSHIP OF MEDONTE BY LAW NUMBER 85-8 A By-Law of the Corporation of the Township of Medonte to authorize an encroachment on a Road Allowance, Lot 68, Concession 1 , Township of Medonte WHEREAS a building has been erected on the east side of the road allowance between Flos and Medonte Townships opposite Lot 68 ~ AND WHEREAS it has been discovered that the said building encoraches on part of the road allowance up to approximately twenty feet ~ AND WHEREAS the owner of the said building has applied to Council to permit the maintenance of the said building in its present posi tion; AND WHEREAS it is provided by Clause 101, of Section 210 of the Municipal Act, R. S. O. 1980 c.302, that by-laws may be passed for permitting existing buildings to encroach upon a highway. NOW THEREFORE, the Council of the Corporation of the Township of Medonte enacts as follows: 1. That the owner from time to time of the building erected on the east side of the said road allowance, may maintain and use the said building which encroaches up to approximately twenty feet ~ on the east side of the said road allowance. 2. That the owner of the said building from time to time shall maintain public liability insurance in the amount of One Million Dollars ($1,000,000.00) at least and assign the benefit thereof to the Corporation ~ of the Township of Medonte from all liability which may arise from permitting the maintenance of the said building encroaching upon that part of the road allowance described in paragraph one hereof. 3. That the owner from time to time of the said building shall pay to the Corporation of the Township of Medonte an annual fee of Ten Dollars ($10.00) for the privilege of maintaining the said encroachment. 2 - THE CORPORA nON OF THE TOWNSHIP OF MEDONTE BY-LAW NUMBER 85-8 ~ '+. That the licence to permit the said building to encroach upon the said Highway contained herein is revocable at the sole option of the Corporation of the Township of Medonte upon the destruction or demolition of the building on the present location. This By-Law shall come into force and have effect immediately upon the final passing thereof. ~ READ a first, second and third time and finally passed this 15th day of July, 1985. AS you know, your mother purchased the west 100 feet of Lot 68, in the fint: Concession of the Township of Medonte by Deed dated the 29th of September, 1929, although she did not register it until the 14th of April, 1944. This Deed came from Herb Dennis and Was conveyed to Susan Morton. Subsequently, Mr. Herb Dennis attei1i>ted to convey the west 25 reet of the said 100 feet in to a Mr. UrquJ;-.art. by Deed dated the 13th of August and registered the 26th of November, 1934, as number 12260. Mr. Arthur Barry Urquhart subsequently sold this 25 feet to James B. Fairbrass &nd h18 wife by Deed dated the 24th of April, 1948, and registered the 7th day of May, 1948. It is 10 be noted that Mr. Fairbrass and his wife took ti Ue from Urquhart and Mr. Urquhart obtained a deed from Mr. Dennis in 1934 which was registered as number 12260, whereas your mother's deed was not registered until 1944 as number 13283. Although Affl~avit8 can be obtained from both Alex and John Morton it still presents a problem and Mr. Douglas G. Haig, the solicitor fot: Mr. and 'Mr.. A.reher, is now trying to correct the matter with my help. Apparently, a survey of these prembes va.s made and at the time the work was done, about 1958 or 19S9, we did not oonuibute any money to such lIIurvey as we felt that it did not affect us. Mr.. Turner, a client of Mr. Stephen C. French, 121 Richmond Street West, Toronto, ordered this survey and I understand that Mr. French has a copy of it in his file. Hr. &1g, tha solicitoc for Hr.
