1986-006 Medonte THE CORPORA nON OF THE TOWNSHIP OF MEDONTE BY -LA W NUMBER 86-6 A BY-LAW TO PROVIDE FOR THE REMUNERAnON AND EXPENSES FOR MEMBERS OF COUNCIL, CERTAIN LOCAL BOARDS AND EXPENSES FOR EMPLOYEES WHEREAS, pursuant to the Municipal Act, R.S.O. 1980, Chapter 302, as amended, the Council of a municipality may by by-law provide for ~ remuneration and expenses for its members, for its appointees to local boards and other bodies and for expenses for employees; AND WHEREAS the said Act provides for salary, expenses and allowances paid by local boards to be established by the Council of a Municipality. ~ NOW THEREFORE THE COUNCIL OF THE TOWNSHIP OF MEDONTE HEREBY ENACTS AS FOLLOWS: INTERPRET AnON 1 . In this by-law and in the attached schedules, the following terms shall apply: (a) "MUNICIPALITY" means the Corporation of the Township of Medonte. "COUNCIL" means the Council of the Municipality. (b) (c) "LOCAL BOARD" means a local board as defined in The Municipal Affairs Act. (d) "OTHER BODY" means any body other than a local board, or the Council of a Municipality or a Council Committee. (e) "EX OFFICIO MEMBER" means and includes a member or a local board or other body. ~ i) who, by statute is entitled to be a member or that board or body by virtue of his office as Head of Councilor as a specified class of Council member, or ii) who serves as a member of the board or body pursuant to his appointment under section 213 of the Municipal Act. ~ (f) "COUNCIL COMMITTEE" means any standing or special committee, or subcommittee thereof, established by Council regardless of the name by which it is identified or the fact that persons other than Council members may be included in its membership. 2. Council members shall receive remuneration as determined according to the provisions of Schedule "A" appended to and forming part of this by-law for their services as Council members of the Municipality. 3. Persons, other than members of Council appointed by the Council as members of a local board or other body shall receive remuneration as determined according to the provisions of Schedule "B" appended to and forming part of this by-law for their services as members of such board or body. (1) The salary and allowance paid by a local board of the municipality to a member of the Board I who has been appointed to such membership by a person or a body other th,an Council shall be paid the same remuneration as members appointed by Council. (2) For the purpose of the clause "local board of the Municipality" means a local board that has no members appointed by a municipality other than those members appointed by the Council. EXPENSES ~ 5. (1) The Municipal Treasurer shall, in accordance with the provisiOns of schedule "C" appended hereto and forming part of this by-law, make payments to i) a Council member or a Municipal employee ~ ii) a person appointed by the Council as a member of a local board or a member of any other body, or iii) an ex officio member of a local board, other than a public utility commission, or an ex officio member of any other body, in respect of expenses incurrred by such person that come within the appropriate description of expenses in Schedule "C". (2) For the purpose of this clause and Schedule "D", Municipal Employee" means an Officer, servant or other employee of the Municipality, but does not include: i) Any person who is a "Council Member" or who received remuneration from the municipality solely as a result of being a member of a "local board" or "other body"; ii) A volunteer fire fighter paid an honorarium, allowance or salary for such services either by the municipality or pursuant to a fire protection agreement, provided such fire fighter is not the fire chief; iii) an employee of a "local board" i v) the municipal auditor, or v) any persons or firm engaged by retainer or under contract for the purpose of providing advice or services in respect of legal, planning, engineering or like matters. ~ 6. (1) The expenses paid by a Municipality to members of the board who have been appointed as members by a person or body other than the Council shall be in accordance with the provisions of Schedule "C". - (2) F or the purpose of subclause (1) "local board of the Municipality" means a local board that has no members appointed by a municipality other than those members appinted by the Council. ADMINISTRA nON 7. Notwithstanding any other provisiOn of this by-law, where a person is entitled to received remuneration or expenses under this by-law from the Municipality in respect of his membership on an "other body" in respect of a certain period or certain times of expenditure and where he has received or is entitled to receive remuneration or expenses from that "other body" in respect of the same period or for the same items of expenditure, he shall deduct the remuneration and expenses he has received from the other body or is entitled to receive from the remuneration and expenses that but for this clause would be payable to him under this by-law in respect of his membership on the board for that period and those items and the amounts remaining, if any, shall be the amounts to which he is entitled under this by-law as remuneration or expenses for that period and those items. The remuneration provided for in clause 2 of this by-law shall be paid by the Treasurer of the Municipality from the funds provided by Council and the Treasurer shall pay the said remuneration in monthly instalments on or about the 15th day of each month, which remuneration shall be in respect of the services rendered for the current month. 9. Notwithstanding clause 8, where a person who is a member of Council or has been appointed by the Council as a member of a local board or other body or an ex officio member of a local board or other body fails to submit any information or documentation required to be submitted in support of a claim for remuneration or expenses, the Treasurer may pay such portion of the regular monthty"instaJment as may be authorized without supporting documentation and the remainder shall be. paid forthwith after such necessary documentation is submitted. (1) Beginning the year 1981, the Municipal Treasurer shall on or before the 28th day of February in each year submit to Council an itemized statement of the remuneration and expenses paid pursuant to this by-law in the preceding year to: - 10. - i) each member of Council in respect of his services as a member of Councilor as an Officer of the Municipality in the preceding year, ii) each person, whether a Council member or otherwise, appointed by the Council to a local board or other body in respect of his services as a member of that board or body in the preceding year, iii) each ex officio member of a local board or body in respect of his services as a member of that board or body in the preceding year. (2) The form of the statement mentioned in subclause 1 shall be approved by the Council and the statement may be subject to audit. 11. The statement submitted under clause 10 shall be in the form set out in Schedule "D" appended to and forming part of this by-law but the Treasurer may include in the statement any additional information that he or the Council sees fi t. ~ 12. This by-law shall come into force on the date of its final passing and shall be deemed to be in effect from January 1, 1986. BY-LA W read a first, second and third time and finally passed this 11 th day of February, 1986. t Page 10f 1 SCHEDULE "A" TO BY-LAW NUMBER 86-6 OF THE TOWNSHIP OF MEDONTE Remuneration - Members of Council 1. The annual remuneration of the Reeve shall be $3,500.00 plus $45.00 per Council Meeting. ~ 2. The annual remuneration of a Councillor shall be $2,500.00 plus $40.00 per Council Meeting. 3. The Reeve shall receive a per diem payment of $35.00 and Council shall receive a per diem payment of $30.00 for attendance at Conferences, Seminars and out-of-town meetings related to municipal affairs to which the Reeve or Council are authorized or delegated to attend. ~ 4. Members of Council appointed to serve on the following boards shall be entitled to receive the same per diem payments as members of the Council of the County of Simcoe appointed to such board, except that members will not be entitled to received a per diem allowance pursuant to Clause (7) herein: a) Family and Chiilkdtreml'ls Service of the County of Simcoe b) Simcoe County District Health Unit c) Simcoe County Museum and Archives 5. One-third of any remuneration and/or payment paid under Clauses 1 to 7 inclusive herein, shall be deemed to be an expense allowance pursuant to Section 251 of the Municipal Act, R.S.O. 1980, Chapter 302, as amended. ~ ~ Page 1 of 1 SCHEDULE "B" TO BY-LAW NUMBER 86-6 OF THE TOWNSHIP OF MEDONTE 1. Remuneration in the amount of $35.00 per meeting for the Chairman and $30.00 per meeting for the members shall be paid to persons other than Members of Council appointed to the following boards or other bodies. (1) Committee of Adjustment . 2. Remuneration to be paid pursuant to Clause 1 herein shall be paid on or about the date of the meeting in each month, subject to the Township Treasurer receiving a report from the Secretary; of the local board, detailing the attendance of each appointee. 3. Appointees shall be entitled to receive a per diem payment of $35.00 for the Chairman and $30.00 for members for attendance at Conferences, Seminars and out-of-town meetings related to municipal affairs, to which the appointee is authorized or delegated to attend. . 4. Each Member of the Committee of Adjustment shall be paid the part time labour rate for inspection of applications to the Committee. . ~ page I 01 L SCHEDULE "C" TO BY-LAW NUMBER 86-6 OF THE TOWNSHIP OF MEDONTE EXPENSE POLICY FOR MEMBERS OF COUNCIL MILEAGE All members of Couocil authorized to be on Township business shall be paid at the rate of $ .23 per kilometer ($ .37 per mile) actually driven with the exception of that the member will not be paid by the Township if he/she receives the mileage payment from another source. LUNCHEONS . (a) The Township will be responsible for Councilor Committee luncheon meetings when such meetings are called by Council or the committee concerned. (b) Council members shall have the discret10n! I to invite Visitors for lunch or dinner in connection with Township business and such expenses shall be borne by the Township. . CONFERENCES, CONVENnONS AND SEMINARS (a) Attendance at conferences, conventions or seminars by members of Council shall be pre-authorized by Council (b) Mileage shall be paid in accordance with the mileage policy herein. (c) Members of Council shall be allowed all reasonable out-of-pocket expenses including the following: i) Hotel/motel accomodation - actual cost ii) Parking - actual cost iii) Registration - actual cost iv) Meals and entertainment - $30.00 per day no receipt required ADVANCES When a member of Council is authorized to attend a conference or convention , the Treasurer shall have the authority to make advances to meet estimated expenses. EXPENSE STATEMENTS . Statements for expenses shall be submitted to the Treasurer in a form recommended by the Treasurer and approved by Council. LOCAL BOARDS AND OTHER BODIES The expense policies herein shall be the expense policies for all members appointed to local boards and other bodies. ~ .L Ll.6'- L Vi L- SCHEDULE "C" TO BY -LA W NUMBER 86-6 OF THE TOWNSHIP OF MEDONTE EXPENSE POLICY FOR MEMBERS OF TOWNSHIP STAFF MILEAGE Members of Township staff authorized to be on Township business shall be paid at the rate of $ .23 per Kilometer ($ .37 per mile) actually driven, with the exception that the members will not be paid by the Township if he/she receives mileage payment from another source. ~ LUNCHEONS Senior staff shall have the discretion to invite visitors for lunch or dinner in connection with Township business and such expenses shall be borne by the Township. CONFERENCES, CONVENnONS AND SEMINARS ~ (a) Attendance at conferences, conventions and semmars by members of staff shall be pre-authorized by Council. (b) Mileage shall be paid in accordance with the mileage rate policy herein. (c) Members of staff shall be allowed all reasonable out-of-pocket expenses, including the following: i) Hotel/Motel accomodation - actual cost ii) Parking - actual cost iii) Registration - actual cost iv) Meals and entertainment - $30.00 per day no receipts required. Per diem rate of $30.00 on weekends and night meetings other than Council shall apply TRAINING COURSES (a) Attendance at training schools by members of staff requiring overnight accomodation shall be pre-authorized by Council. (b) Mileage ( one round trip ) shall be paid in accordance with the mileage policy herein. ~ (c) Staff members shall be allowed all reasonable out-of-pocket expenses, including the following: i) Hotel accomodation - actual cost ii) Parking - actual cost iii) Course registration or tution - actual cost iv) Meals - maximum $ 30.00per day - ADVANCES When a member of staff is authorized to attend a conference, convention or seminar, the Treasurer shall have the authority to make advances to meet estimated expenses. EXPENSE STATEMENTS Statements for expenses shall be submitted to the Treasurer in a form recommeded by the Treasurer and approved by Council.
