1987-009 Medonte By-law to regulate the erection, alteration and construction of buildings within the Township of Medonte THE CORPORATION OF THE TOWNSHIP OF MEDONTE BY-LAW NUMBER 87-9 BEING A BY-LAW to regulate the erection, alteration and construction of buildings within the Township of Medonte WHEREAS Section 5(2) of the Building Code Act permits Council to pass By-Laws regulating Building Permit Fees AND WHEREAS it is necessary to regulate the erection, alteration, construction and moving of buildings within the Township of Medonte - NOW, THEREFORE, the Municipal Council of the Township of Medonte enacts as follows: 1) Any erection, alteration, construction or moving of buildings within the Township of Medonte must be done in compliance with the Ontario Building Code, the Ontario Plumbing Code, the Ontario Fire Code and this By-Law. - 2) This By-Law shall apply to all buildings constructed, altered, moved to or added to in the Township but shall not affect any interior alterations which do not affect the structural soundness of the building. 3) The Township of Medonte or its agents shall not be liable either directly or indirectly for any loss or injury to life or property due to any failure of any construction on any building or structures erected under this By-Law. 4) No one shall commence with the erection or alteration of any building or part of any building until a permit for such erection, alteration or moving has been obtained from the Township Building Inspector by the owner or his agent. 5) A Building Permit shall be valid for a period of one year from date of issuance. If construction is noe started within a period of one year, a new building permit must be obtained. 6) If construction or alteration begins within the one year period, and should the construction or alteration continue for a period of two years, it shall be necessary for the own er or contractor to obtain a new permit. The fee structure for permits shall be a) b) New house, cottages and chalets Cornmercial and Industrial Buildings per 1000 square feet All otner ouildings, finished or unfinished or additions , 750 square feet or more, residential garages, new foundations or basements under existing buildings and alterations to existing buildings and small storage buildings 100 sq. ft. to 750. sq. ft. Below ground swimrning pools and above ground permanent swimming pools Chimney installation to existing buildings Additions or alterations to a Plumbing System c) ~ d) e) ~ f) $250.00 $ 65.00 $ 75.00 $ 40.00 $ 20.00 $ 40.00 8) The Council of the Township shall appoint a Building Inspector who shall hold office from year to year or until a successor is appointed. 9) The duties of the Building Inspector shall be to insepct all buildings and enforce the requirements of this By-Law; to keep a record of all applications for permits plans etc., as well as records of all permits issued; and to act under the direction of the Council in all matters pertaining to the Building By-law. 10) All applications for Building Permits shall be accompanied by two detailed sets of plans in compliance with the Ontario Building Code and the Ontario Plumbing Code';:' One set will be returned with the building permit. THE CORPORATION OF THE TOWNSHIP OF MEDONTE BY-LAW NUMBER 87-9 10) Inspections shall be as follows and the Building Inspector shall requIre at least 24 hours notice for each inspection required. 1) First Inspection to check all forms and soil for footings and set back. 2) Second inspection to check blocks, plates etc. and tile drainage before backfill. 3) Third inspection to check frame work. . 4) Four inspection to check insulation and plumbing. 5) Fifth and or final inspection to issue occupancy permit. 11) All residential dwellings and other buildings shall be constructed in accordance with the setback and yard requirements as laid out in the Township Zoning By-Law. This information may be obtained from the Township Office. - 12) Any addition to existing mobile homes and residential buildings to increase the living quarters must increase the size to comply with Zoning By-Law requirements. 13) All buildings erected along County of Simcoe Roads must comply with the By-Laws of Simcoe County. 14) All entrances for residential dwellings along Township Roads must be approved by the Township Roads Superintendent; And it will be the responsibility of the owner to provide the required entrance culvert. 15) Any construction or alteration on any controlled access Highway must be aPJ>f.:s)-yed by the Ministry of Transportation and Communications before a Township Building Permit will be issued. 16) No residential building or alteration shall be constructed without the exterior being completed within 24 months. 17) No changes in plans or specification shall be made during the progress of the construction for which a permit has been issued without prior approval of the Building Inspector. ~ 18) No person shall pass any stove or furnace pipes or allow any such pipes to pass or to be carried through the roof or sides of any building owned or operated by him without a Building Permit. 19) It shall be the duty of every applicant who wishes to install a seDtic tank or other method for the disposal of waste to ensure that the requHel!lel!ts of the Ministry of Health of Ontario and the Simcoe County Health Unit are complied with and no building permit shall be issued by the Township until an approval has been issued by the Health Unit. 20) All basement"; must be backfilled and heated effective December 1 if the house is not completed until the following spring. t 21) The council may by resolution make further regulations as to method of construction, required materials and other building factors under this by-law. 22) Every person who contravenes any of the provisions of this By-Law is guilty of an offence under the ProvIncial Offences Act and upon conviction thereof shall be liable to a fine as laid out in Section 24 of the Building Code, Chapter 51, R.S.O., 1980 or Section 321 of the MuniClpal Act, Chapter 302, R.S.O., 1980. THE CORPORA nON OF THE TOWNSHIP OF MEDONTE BY-LAW NUMBER 87-9 23) This By-Law shall come into force and take effect from the date of the final passing and shall remain in force until repealed or amended by Council of the Township of Medonte. 24) By-Law 86-3 is hereby repealed. ~ READ a first, second and third time and passed this 24th day of March, 1987. - Reeve -=~...._--- ~ ~
