Trustees welcomed Trustee Tracey Sharpe,
newly appointed to represent Native
communities on the Board. Earlier in the
month, trustees welcomed Student Trustee

Community Use of Facilities Policy
Approved
Trustees approved the revised Policy 2340,
Community Use of Facilities. The policy was
revised to reflect the priority of school
functions and to support school co-curricular
use of buildings. A copy of the policy is

School Facility Survey Report Results
Mike Graham, Superintendent of Facility
Services, reviewed local results of a school
facility survey that boards must conduct
annually. Respondents rated school facilities
in five categories including cleanliness,
condition, comfort, access and partnership.
The SCDSB' s positive results reflect the
excellent work of the maintenance and
custodial staff and the overall teamwork that
exist in Simcoe County District School Board
public schools.
Removal of Proposed School Site from Plan
The Board approved removing from the cun-ent
capital strategic plan the elementary school
project Oliginally proposed for a site near Little
Lake.
Collingwood Area Walking Zones
Walking zones were approved for the
following Collingwood schools: Collingwood
replacement elementary school; Cameron
Street; Connaught; Mountain View.
Transfer of Funds for School Renovations
The Board approved transferring $36,500 from
the cafeteria reserve fund to renovate the
cafeteria and replace outdated equipment at
Park Street Collegiate in Orillia.
SEAC Appointments
Trustees approved the following appointments
to the Special Education Advisory Committee:
David Munro to represent Candlelighter's
Simcoe; Kathy Knapp to represent Barrie and
District Association for People with Special
Needs; Bonnie Jeremy to represent Epilepsy
Ontario with Jocelyn Williams as alternate.
Modified School Year Program Update
Trustees endorsed the following plarming
process pertaining to the consideration of new
modified school year programs:

Reading RecoveryTM Update
The School Services Standing Committee
report included infonnation about the
Reading RecoveryTM program that is beina

Implemented in the SCDSB. The program is
an effective early literacy intervention,
designed to dramatically reduce the number /' r . i
of children with reading and writing ;.. u'
difficulties. Through the prOgra~ed
teachers identify at-risk children and deliver
a short-tenn program in an intensive, daily,
one-to-one instructional format. Prior to the
Board meeting, trustees attended the official
opening of the Reading RecoveryTM Teacher
Training Centre at Emma King Elementary
School. Reading RecoveryTM founder Dame
Marie Clay participated. Chairperson
Chambers congratulated staff for the
impressive impact they are making with the
reading development of children in the
program.

Dear Ian:
I respectfully suggest that Oro-Medonte Council have another look at the Criteria for
Preservation of ecological and hydrological Features of the Oro Moraine, discussed at
the Jan. 8th meeting of the Oro Moraine Committee. I can only address the ecological
aspects of this proposa1.
The natural areas, natural heritage features of the Orc Moraine are weB known. For
example they are shown on Schedule B of the Official Plan and they are shown on Fig. 7
of the Hydrogeological Study of the Oro Moraine... done by Azumith. In addition Teny
Green of the Couchiching Conservancy has supplied Nick MacDonald with the latest
mapping done by the Conservancy study group on the Oro Moraine.
I suggest that the Proposed Study Methodology is flawed and much of it has already
been done. A day or two on a computer will bring it all together. If this is done at all it
should be done after the field work is completed. They are not even suggesting a full
season of field work.
What is real1y needed is at least on ful1 field season - March to September - surveying
these areas. This should be done by a team composed of at least a botanist, forester,
ornithologist, herpetologist and entemologist.
When their field reports are prepared then the areas can properly be assessed for their
relative importance for classification for preservation.
There is some evidence that some rare and endangered plants and at leasL<<ne species of
bird is found on the Oro Moraine. If this is verified it would increase the degree of
preservation for the areas where these species are found.
As a field naturalist with 58 years experience in Ontario, as a fonner executive director of
both the Federation of Ontario Naturalists and the Coalition on the Niagara Escarpment
and as an Oro Medonte taxpayer I suggest that the Meridian proposal is flawed and may
be ecologically uns?und. Ground Truth suggests a religious cult.
I appreciate the leadership that Neil Craig and you have shown over the past few years jn
the field of environmental protection. I appreciate the constraints you mentioned, bur this
proposal would bring the study in only a month or two later that presently planned.

1 am in receipt of your recent correspondence with regard to the criteria for the preservation of ecological and
hydrological features of the arc Moraine.
1 appreciate your concerns with regard to the method of assessment.taken with respect to the Oro-Moraine
Study. Due to the complexity of the issues, I have requested that our consultants provide assistance in preparing
a response. Martha Scott from Azimuth Environmental Consulting has addressed your comments accordingly,
and her response is attached for your perusal.
As stated at our last meeting, it is the municipality's intention to collect as much existing information as
possible, in order to provide the basis for a land use strategy on the Oro Moraine that is based on science. I am
confident that the work to be carried out will achieve that goal.
Your latest correspondence with a copy of the response will be forwarded to the Steering Committee for
discussion.
In addition, there will be fieldwork carried out as part of this project and I am sure that you along with various
other individuals will be consulted on how this can best be accomplished.
I would like to thank you for your time and comments. Because of interested ratepayers like you. it is why
Oro-Medonte is a better place to live.

This correspondence will address some of the issues raised by Mr. Jim Woodford
(Federation of Ontario Naturalists) in his letter dated January lOth to the Mayor of Oro-
Medonte. Mr. Woodford's correspondence elucidated his concerns regarding the
proposed methodology for the preservation of ecological and hydrological features of the
moraine. The presentation of January OSth was preliminary and will, of course, be subject
to refinements once further details have been presented at our next meeting in March.
Although Mr. Woodford's commitment to obtaining a complete inventory of flora and
fauna currently present on the moraine for the purposes of identifying vulnerable,
threatened or endangered species is appreciated, the factor of species rarity in the
landscape is only one of a suite of factors that should be incorporated into an assessment
of lands worthy of preservation and their relationship to existing hydrological factors (i.e.
recharge/discharge function) that the committee has already recognized as being
significant There will be no attempts to duplicate ongoing studies and observations that
involve a lot - to - lot inventory of plant, mammal, bird, reptile and insect species.
Although these data would be necessary for the compilation of a detailed natural history
of the area, this kind ofinfonnation is not necessary to identify significant vegetation
worthy of preservation that will ultimately provide habitat for rare species.
UnfortUnately, practical considerations dictate that the study must be completed and a
report generated by the end of 2002. This short time - frame does not, however, imply
that the work will be ecologically unsound.
The recommended strategy for the prioritization of environmentally sensitive areas on the
moraine will be based on ecological principles that relate features of existing parcels of
land (i.e. potential habitats) to functions identified as significant by recognized scientific
authorities. Infonnation contained within the Natural Heritage Training Manual for
Section 2.3 of the Provincial Policy Statement clearly indicates criteria for assessing
habitat quality, based on patch size, shape, arrangement and function, In addition, this
document outlines criteria for evaluating significant woodlots, wildlife and significant
linkage areas that would create wildlife passage corridors between significant areas. The

OMNR utilizes this type of document in much of their fieldwork. In addition, the
Ecological Land Classification for Southern Ontario classifies vegetation in a relatively
simple manner so that habitat types can be identified and compared on a province-wide
basis. The mandate of this assignment is to be able to identify natural core areas, linkage
areas, rural areas and concentrations of settlement so that natural areas can be preserved
in blocks that are as large as possible. The preservation of large areas of natural
vegetation will, by virtue of their size and higher quality interior habitat provide food and
shelter resources for populations of rare species. The broad-based approach will also
attempt to link features and functions of the natural environment to groundwater
functions such as recharge that are vital in maintaining the character of the provincially
significant wetlands that encircle the moraine.
I believe that the problem here is one of scale. The work done by the Nature
Conservancy and the Field Naturalists is directed towards a natural history approach in
which species are examined at an organism level and the keeping of accurate inventories
is important. Thus, the significance of areas is based on the species observed to live there
now. As such, detailed surveys over multiple seasons are required to ensure that
occurrences are not missed. The presence or absence of a species on its own does not
ensure that the habitat is sustainable and the population will be maintained. From a
community ecology perspective, however, the features and functions approach is used to
identify significant blocks of habitat that ultimately will provide resources needed to
sustain these rare species.
Hopefully, there will be full co-operation between the various groups involved in this
project so that existing records of species can be linked to habitat type in the
environmental assessment process.

Martha Scott's memo has clarified Meridian's proposal.
She states "There will be no attempts to duplicate ongoing studies and
observations.... "
She further states "... this kind of information is not neccessary to
identify significant vegetation worthy of preservation...." Perhaps she will
tell the committee what kind of information she will use.
This is the essence of the difference between what Meridian proposes and
what I think is vital to prepare a report that will be the basis of the
preservation of the Oro Moraine.There must be extensive work on the ground
in beautiful Oro-Medonte, not in an office in Barrie.
In 1967, the then Premier John Robarts, asked me to be Secretary and
coordinate the work of a committee charged with finding ways to protect the
Niagara Escarpment. The report of that committee resulted in 1) the Gertler
Report; 2)the Niagara Escarpment Commission and finally the designation of
the Niagara Escarpment as a World Biosphere Reserve.
In 1979 I was Executive Director of the Coalition on the Niagara Escarpment
and along with Ron Reid, then with the Federation of Ontario Naturalists, we
played a key role to ensure that the important natural feaures were included
in the Escarpment Plan.
The Couchiching Conservancy in in the second year of a study that I think
will provide much of the information needed to write the type of report I
think is necessary. There is also the Breeding Bird Atlas Project.
I suggest the Oro Moraine Committee obtain expert advice as to how they
should proceed on this vital matter. There are well-qualified people at the
Universities of Guelph and Waterloo.
The type of report I think is neccesary in similar the the Carden IBA
Report. The first response to that Report is that the Nature Conservancy of
Canada is negotiating to buy 3000 acres of the Carden Plain at a cost of
several million dollars. With a good report we can attract that kind of
support.

As a practical test of the field-oriented study I am advocating I suggest
you contact John Lounds of the Nature Conservancy of Canada and Monte Hummel
of the World Wildlife Fund and ask them what type of report and what
criteria they need for their organizations to get involved in helping to
preserve the Orc Moraine.

As you are aware the Oak Ridges Moraine Conservation Plan contains Sec. 3
Protecting Ecological and Hydrologicallntergrity. This sets out detailed
criteria for protecting moraines.
I have been advised that Oro-Medonte Council would be wise to adopt a
section similiar to this for the Oro Moraine. The Council is planning to
restrict development to exisitng settlements and aproved areas and to
protect significant natural features. A provincially approved set of
criteria would hold up well if the Council's decisions were challenged at
the OMB.
This would allow the Oro Moraine Steering Group to refocus the study of the
Oro Moraine.
It might consider dividing the study into two - hydrogeological and
ecological. The two studies could be melded into a final report.

and many other groups. We have offered free garbage bags for clean-up projects of
greenspaces, parks, a ravine, trail, shoreline or waterways. We've also provided information
on, or encouraged, habitat restoration, school or community composting or recycling
projects and community-wide beautification campaigns to instill community pride.

your community identify and spearhead local clean-up and beautification projects and to

As Spring, and Maple Syrup Time 2002 approach, Springwater Township Council
hereby issues The Grand Challenge!
The Elmvale Maple Syrup Festival will take place on Saturday, April 20, 2002, in the
community of Elmvale. Springwater's team of Lumberjacks is now in training, to meet
one and all who will make the journey to face this, the Ultimate Challenge. Last year's
winners, from the Township of Clearview, will, I am certain be on hand to defend their
crown. We invite you to enter a team to participate in this fine tradition, and uphold
your honour as a Lumberjack.
This year, we invite a brief written greeting (sample enclosed), along with a photo, for
inclusion in the Festival Program. This material would be best e-mailed to the attention
of the Clerk's Office at springwater@simcoe.net.
The Festival Program has not yet been finalized, so we cannot provide specific times at

Welcome 10 the 37th annual Elmira Maple Syrup Feslival!
The Festival gives all of us a chance to enjoy the spring
weather and taste one of the sweetest gifts of nature. There
is no comparison to pure, fresh maple syrup, especially
when poured over pancakes or apple frillers.
On behalf of Council and the residents of Elmira, I want
to thank the many volunteers that make the Elmira Maple
Syrup Festival so enjoyable. Without their help, it would
not be possible to put on such a greal event. Proceeds
raised today will be used to support local non-profit
organizations.
I hope you enjoy the Festival and that you will come

3.0 PROPERTIES & COMMERCIAL DEVELOPMENT COMMITTEE
i) The results of the further presentations of the Lake Simcoe Regional Airport
Agreement and the Council deliberations were reviewed. R. Hough confirmed
that the Township of Oro-Medonte has approved and adopted both the Land
Sale Policy and the Lake Simcoe Regional Airport Agreement. S. Trotter
confirmed that the City of Barrie has 9Pproved and adopted both the Land Sale /(' n /
.. .Polic.y.an~ the La~~ Simcoe Regional Airport Agreement. W. Gardy reviewed O-r---tf
that the City of Onlha has adopted the concept of the Land Sale Policy; however
to date, Orillia Council has not ratified the Lake Simcoe Regional Airport
Agreement. W, Gardy and F. Smith reviewed comments in the form of a staff
report from the City of Orillia Manager regarding the tripartite agreement,
specifically regarding apportionment rates. The Lake Simcoe .Regional Airport
Commission directed the Grillia representatives to report to their respective
Council regarding the discussion.
It was also discussed that once all three municipal partners have entered into the
Lake Simcoe Regional Airport Agreement and the solicitor's representing the
three Municipalities have met and finalized the document, the applicable by-law's
would be passed.
ii) W. Dickie reviewed that the airport currently has various firms that have
indicated verbal interest in commercial hangar development at the airport under
the concept of land sales. Direction was given to the Property & Commercial
Development Committee (consisting of L. Leach, R. Hough and F. Smith) to
meet with staff and establish a form of invitation for commercial development
and criteria and report back to the Commission at the January 2002 meeting.
iii) M. Drumm reviewed correspondence addressed to Barrie Vascular Imaging
regarding the closure of this companies tenant, Advance Flight Training Center.
4.0 AIRPORT OPERATIONS
i) M. Drumm reviewed that the Lake Simcoe Regional Airport Snow Removal
Contract for the term of November 1999 to March 2002 is due for review and
optional two-year extension. As a result of the impeccable service received from
the existing contractor, M. Drumm requested that the contract be renewed for an
additional two years, as specified in the Snow Removal contract to include 2003
and 2004. The renewed contract will include a modest increase of approximately
6.5% only to the per hour equipment rates, which is attributed to CPI and rising
fuel costs. The stand-by charges will remain at 1999 levels for the duration of
the contract.

extension of the Snow Removal Contract for a term to include 2003
and 2004, with Garry Priest Trucking Ltd., as presented."

5.0 FINANCIAL REPORT

Commission. All other matters are to be directed to the President of the Lake
Simcoe Regional Airport Commission. It was noted that staff members within
the City of Barrie Treasury Department and Municipal Works Department and
staff members within the Township of Oro-Medonte Public Works Department
should contact airport staff directly as their services directly affect the day to day
operation of the Lake Simcoe Regional Airport;
As a result of the Christmas refreshments provided for the Commission meeting,

The Council of the Township ofOro-Medonte at their Committee of the Whole meeting held January 9,2002,
passed the following recommendation:

It is recommended that the correspondence from the City of Toronto re: Municipal Litter Abatement,
be received, and that the Ministry of the Environment be requested to amend Bill 90, Ontario's Waste
Diversion Act, to include brand owner responsibility for municipal litter abatement by providing full
fun ding for municipal litter abatement programs or by implementing deposit return programs, and that
the local MP and MPP be advised accordingly. Carried.
Council at their regular Council Meeting held January 16, 2002 ratified the above noted recommendation.
Council understands that Bill 90 was not passed in the fall session of the Ontario Legislature but that the bill has
been carried over to the next session beginning in March. At that time, Council trusts you will support and amend
Bill 90 to include brand owner responsibility for municipal litter abatement by providing full funding for municipal
litter abatement programs or by implementing deposit return programs.

RE: THEME OF JUNE HOSTED MEETING
Dear Mayor and Council,
There are three issues that are of significance to business in Oro-Medonte. They are as
follows:
1) Plans for widening Hwy #11
2) De-regulation of Hydro
e 3) Changing responsibilities for inspection of septic systems.
The Chamber envisions timed presentations with question and answer sessions on these
topics.
It is important that the Chamber take a leadership role in specific aspects of such a
meeting. The Chamber would like to contact and organize the speakers. Accordingly, it
is necessary that the Chamber be notified by the end of February 2002. The Chamber
looks forward to working with the Township to organize the June meeting and welcomes
requests for further information.

staff subsidy is supplied through Human Resources Development Canada. The position is
defined as a job creation program, ending July 26/02 and will not be renewed as such.

RE: LETTER OF PROPOSAL AND 2002 BUDGET
Dear Mayor and Council,
Please fmd enclosed a copy of the 2002 budget projections as requested. These projections are
based on the operating needs for Chamber functions only, and include the Chamber being located
in a trailer facility adjacent to Hwy #11.

Our projections are based on the results of investigating options for a trailer facility. Enclosed is
a copy of the ad for the used trailer being considered, which, as of January 25/02 was still
availa ble. The purchase of this trailer would be less than half the cost of any alternatives to date.
Economics suggest that the purchase of this trailer outweigh leasing, with or without the option to
purchase a new trailer.
In order for this used trailer to be utilized as a Chamber office, immediate consideration is
necessary. Should this trailer not be the option selected, it will be necessary to adjust the budget
projections accordingly. Also included in our budget projections, is the cost of renting a site for
the trailer.
We have projected a full year for the Chamber Office to be open and operating on the basis that
April 1 st is the start date of the fiscal year. Changes in respect to the start date of the fiscal year
would also require adjustments to the budget projections.
The areas that we have left blank, are those that depend on the wishes of the Township and are
left to your discretion.
We trust that we have provided the information requested and welcome your response. We also
welcome the opportunity to present and/or attend the deliberations of this proposal.

IBACKGROUND I
On December 21, 2001, correspondence was received requesting that the road
allowance known as Line 8 South between Lakeshore Road and Lakeview
Boulevard (or portion thereof) be stopped up, closed and sold to the
correspondent, a resident of Line 8 South.
As further background, staff is currently in the process of stopping up, closing
and selling the road allowance known as Lakeview Boulevard from Line 8 South
west to Ora Road.
A map of the subject area is attached for information.

SUBJECT: Sale of Surplus Lands
IBACKGROUND
I
During the process entailed in the sale of surplus lands, specifically those which
are termed "restrictive" within the Township, a review of Schedule "A" of By-law
Number 96-35 (To Establish a Procedure for the Sale of Real Property) was
initiated to determine whether the options available to Council to dispose of such
property did, in fact, serve Council's and the Township's interests.
I ANALYSIS
I
Schedule 'A' to By-law Number 96-35 gives two options with regard to disposal of
property: by tender, and by engaging a real estate firm or brokerage. No
provision is made for the sale of property, which is to be conveyed to a
landowner who abuts the real property or who claims a legal interest in the
property. Additionally, provision is not made for the sale of property to such
landowner where the property is unable to be independently developed for
residential use by virtue of zoning requirements or lack of direct access to, or
frontage on, an open public road.
The draft amendment to Schedule 'A' (Attachment 1) provides a third option to
address these inadequacies. In some instances, this third option would be less
costly to the prospective buyer, and would allow Council to forgo the necessity of
calling tenders or engaging a real estate firm or brokerage.
Further, should Council wish to exercise its right under Ontario Regulation
815/94 (Attachment 2) in this instance, to avoid the necessity of an appraisal on

land that does not have direct access to a highway if sold to the owner of land
abutting that land, appraisal costs would be averted.
A draft amendment to replace Schedule 'A' of By-law Number 96-35 is attached
for comment. The amended portions are highlighted in bold. The amendments
to the by-law give Council another option in dealing with disposal of property. As
is now the case, Council determines in every case the option to be used in
disposal of such property by resolution of Council.

to By-law No. 96-35
Procedure - Sale of Real Property
1. The Clerk shall publish a notice of the intended sale of the real property at least once
in one (1) newspaper having local circulation in the Township. The notice shall
specify that anyone wishing to comment on the proposed sale may do so by
delivering such comment in writing to the Clerk at the Township offices. The final
date for submitting such comments will be specified in the notice. Any comments
received shall be considered by Council, which in its sole discretion shall decide if
any further action shall be taken on same.
2. Obtain a survey of the real property proposed to be disposed of from a Registered
Ontario Land Surveyor, if deemed necessary.
3. Obtain an appraisal of the real property proposed to be disposed. For those properties
specifically exempted by Regulation from the appraisal requirement, Council may, in
its discretion, obtain an appraisal. An appraisal shall be a written opinion of the
market value of the real property and shall be prepared by a registered member of
the Appraisal Institute of Canada in good standing and such appraiser shall not
be a real estate agent nor be directly connected with any real estate brokerage
firm.
4.1 Council shall determine in its sole discretion, by resolution, to dispose of the
surplus real property by either of the three (3) following methods; sale by public
tender, sale by real estate firm or broker, or direct sale to a landowner.
4.2 Should Council determine to sell the real property by tender, the following apply:
(a) Costs incurred or anticipated to dispose of the real property such as legal fees,
survey, appraisal, encumbrances, advertising and improvements, shall be
established.
(b) An estimated bid amount shall be established which shall not be less than the
appraised value plus the additional costs referred to in Clause 4.2(a) above.
Notwithstanding the foregoing, Council may accept an amount less than the
estimated bid amount.
(c) An advertisement shall be placed in at least three (3) newspapers having general
circulation in the Township and which in combination are intended to provide
coverage throughout the entire geographic area of the Township. The
advertisement shall include a brief description of the property, including a small
location sketch and shall specify the final date that offers will be accepted and
shall include the following statement "the highest or any offer may not necessarily
be accepted,"

(d) The tender documents shall be delivered in person to the Clerk by the date
specified therein.
4.3 Should Council determine to engage a real estate firm or broker to sell the real
property, the following applies:
(a) Costs incurred or anticipated to dispose of the real property such as legal fees,
survey, appraisal, encumbrances, advertising and improvements shall be
established.
(b) A listing amount shall be established which shall not be less than the appraised
value plus the additional costs referred to in Clause 4.3(a) above. Notwithstanding
the foregoing, Council may accept an amount less than the listing amount.
(c) An advertisement shall be placed in at least three (3) newspapers having general
circulation in the Township inviting real estate brokers to submit a listing
agreement to Council for consideration.
(d) The accepted listing agreement, including commission percentage, must be
approved by resolution of Council and the approval shall include authorization for
the Mayor and Clerk to sign.
(e) The offers shall be submitted to the Clerk on the standard Ontario Real Estate
Offer to Purchase forms and shall provide for an irrevocable period of at least
fourteen (14) days.
4.4 Should Council determine to sell the real property directly to a landowner(s),
the landowner to whom the real property is to be conveyed must be a
landowner (other than a mortgagee or chargee) who abuts the real property
or an owner of other land in the Township (other than a mortgagee or
chargee) who claims legal interest in the property such as, but not limited to:
an easement, a right-of-way, possesory title or a restrictive covenant. The
real property to be conveyed must be unable to be independently developed
for residential use by virtue of zoning requirements or lack of direct access to
or frontage on an open, public road and the following shall apply:
(a) Costs incurred or anticipated to dispose of the real property such as legal
fees, survey, appraisal, encumbrances, advertising and improvements, shall
be established.
(b) An estimated purchase amount shall be established which shall not be less
than the appraised value plus the additional costs referred to in Clause 4.4(a)
above. Notwithstanding the foregoing, Council may accept an amount less
than the estimated purchase amount.

SUBJECT: By-law to Regulate and Control Dogs within the
Township of Oro-Medonte

IBACKGROUND
In January, 1994, the Township of Oro-Medonte passed By-law Number 94-37,
"A By-law for Licensing and Regulating of Dogs and Kennels and for the Control
of Dogs within the Township of Oro-Medonte". This by-law provided for licensing
of individual dogs, regulating kennels, and providing for the control of dogs
"running at large". As defined by the by-law, a dog shall be deemed to be
running at large when found elsewhere than on the property of the owner and
not under the control of a competent and responsible person". The by-law also
set fees and fines for such licensing and control.
In May of 2001, a deputation of residents of Harbourwood approached Council
regarding dogs running at large in their neighbourhood. The deputants
requested Council to consider implementing a by-law to provide for leashing of
dogs, as well as requiring an owner to remove dog excrement (or "poop and
scoop") .
Council received the information provided by the deputation and the related
correspondence (Attachment 1) on May 16, 2001, and referred the matter to
staff for a report.

During a two-week period from May 22 to June 1, 2001 a Township By-law
Officer attended Harbourwood Subdivision and Park on a complaint from a
resident. The Report of Inspection during that time frame (Attachment 2) notes
no dogs running at large. The Orillia SPCA also attended at least one to two
times weekly as routine patrol. Further correspondence, dated January 24,
2002, was received by the Mayor in this regard (Attachment 3).

I ANALYSIS
Township of Oro-Medonte By-law 94-37 speaks only to licensing dogs and
regulating dogs found to be running at large. The by-law does not address
leashing of dogs or removal of dog excrement.
Staff researched several surrounding municipalities with respect to these issues.
The reach of the by-laws researched varies, as do the fines. Considering the
scope of the two outstanding issues, by-law enforcement and signage would be
at some cost to the municipality.
Currently, the SPCA is contracted by the Township to enforce violations of dogs
running at large as well as to provide pound facilities for such animals. The
SPCA would also enforce the additional infractions of failing to leash a dog and
non-removal of dog excrement. The Manager of the SPCA has confirmed that the
current contracted costs would not change to include the two new infractions.
Costs would be reviewed in mid-July to determine the amount of increase, if any.
It is the intent of staff to inform the general public of the new by-law regulations
by publication in the newspaper as well as through an insert in the Tax Bill.
Although the by-law would apply to all public and private lands within the
Township, signage would be placed only on municipally owned recreational
property. The fine for an offence under the current by-law would extend to the
offences committed under the leashing and removal of excrement sections to be
added to By-law number 94-37.
A draft by-law to amend by-law number 94-37 to addresses the leashing of dogs
and the removal of dog excrement, is attached for review (Attachment 4).

I RECOMMENDATION
I
1. That this report be received and adopted.
2. That the Clerk be authorized to bring forward the appropriate by-law, for
Council's consideration, to amend By-law Number 94-37 to regulate the
leashing of dogs and the removal of dog excrement on public or private
property within the Township of Oro-Medonte.
3. That the contract with the SPCA be brought forward to Council in July, 2002
for a review of the financial impact of enforcement of leashing of dogs and
removal of dog excrement.
4. That Ms. B. Parcells be advised of Council's decision in this regard.

Subject: Harbourwood Subdivision
I have resided in this subdivision for the past 2 years. It is a wonderful area ,however, there is a
vanderlism problem caused by a few individuals (young people) in our parks,} know for a fact that
it has been reported to the town, at a cost the town has had to make repairs. I believe if there was
a police presence during the evening and night less of this behaviour would occur.
In addition there are dogs running loose everywhere. I have been at the school bus stop when out
of no where 5 dogs(large) just appeared. I was glad I was there as some of the children were smaller
than the dogs, Some of the dogs were know ,none of the owners were present. Think of the possible
danger of one dog getting excited the rest followeing and the children became the target of their
excitement. All this on township property-Harbourwood Park. This is just one incident of many.
Dogs run astay at all hours. Garbage day is a feast. Bags are ripped, garbage ends up all over the
place. My husband does not work on Mondays and in the last few months he has gathered up our
neihbours garbage rebaged it on a number of occasions,chased the dogs away ,to await the garbage
pick up, God for bid that the garbage person would have to gather up garbage other than what was
in a container. It could be right in front of them and they leave it. . There appears to be no
enforcement by the Township even though legislation exit. This is a serious problem, one I believe
the Township should be overseeing.
I would also like to recommend to Council that a By-Law be enacted that there be a "POOP and
SCOOP" by -law. This should pertain to aU subdivisions and all Parks in the Township. Do you
know how many germs and parasites are spread by dog (animaIJfeces.? This is a Health and litter
issue. We see people walk their dogs to the park for the prime purpose for their animals to
defecate, leave the feces there and walk home. There are others that pick up after their dog then
throw the bag in the park. Every spring my husband has been able to collect a 3(4- full wheelbarrow
wheelbarrow full of dog feces from in front of our yard by the roadway. In addition I request that
all parks have garbage containers. One should be placed at all entrances and a few within the Parks
depending on the park size. This is a simple request, one which exits in most cities and towns.
The above mentioned issues are all serious and I believe fall within the Township's responsibilties
and I am requesting that action be taken.

On May 23,2001 a delegation from Harbourwood subdivision met with Council regarding dogs at
large in our neighbourhood. There was a lengthy discussion by the Council ,culminating with
strong support from the Councillors for both a "poop & scoop" and leash By-Law. At that
time it was stated that the matter would be referred to staff for formulation. WE left with the
understanding that this should be accomplished within three(3) months. It is now January
24,2002 , nine (9) months since that meeting and to date no member of the delegation has
been contacted by the Township. Councillor Hughes I know during that time frame has brought
the matter to your attention and has queried the lack of action ,yet there is still no action. It would
appear there is a breakdown between Council and Township staff or perhaps just incapable staff
as this matter is not a complicated issue to address, and should in fact have been dealt
with within two (2) months.
It was my hope that a letter of this nature would not be necessary but recent incidents have led
me to alert you for the need of such a by-law. In the last couple of weeks while driving, my
husband, family and I have had near misses with three different dogs dashing out on to
the road and having to take evasive action. On two of those occasions narrowly evading
an accident. On the third incident after being frightened by the first two upon seeing the
darting dog I told my husband to hit the dog as our lives are worth more than his,
however he was able to stop the car in time as the road was dry unlike the first two
situations. Locations of the incidents were Howard St, Elvin St, and Lakeshore in the vicinity of
the marina.
In addition the dogs are loose again on garbage day, one in particular has a feast each of those
days, leaving a mess on the roadway.
If as stated by the various Councillors that they recognize this to be a serious problem in
their respected wards, it begs the question why has nothing been done?

BY-LAW NO. 2002-
Being a By-law to Amend By-law Number 94-37 to regulate the Leashing of Dogs
and the Removal of Dog Excrement on Public and Private Property
WHEREAS the Municipal Act, R.S.O. 1990, Chapter MA5, as amended, Section
210, Subsection 8, provides that Councils of local municipalities may pass a by-law
regulating the leashing of dogs;
AND WHEREAS the Municipal Act, R.S.O. 1990, Chapter M.45, as amended,
Section 210, Subsection 9, provides that Councils of local municipalities may pass
a by-law to require an owner of a dog to remove forthwith, excrement left by the
dog anywhere in the municipality;
AND WHEREAS the Council of The Corporation of the Township of Oro-Medonte
did, on the 10th day of January, 1994, pass By-law Number 94-37 for licensing and
regulating of dogs and kennels and for the control of dogs within the Township of
Oro-Medonte;
AND WHEREAS Council of The Corporation of the Township of Oro-Medonte
deems it necessary for health and safety reasons, to regulate the leashing of dogs
and the removal of excrement left by dogs on public and private property within
the municipality;
NOW THEREFORE, Council of The Corporation of the Township of Oro-Medonte
hereby enacts as follows:
"
1. That By-law No. 94-37 is amended by the addition of the following:
016. An owner of a dog, or the person accompanying a dog, shall keep the
dog leashed when the dog is on land in the municipality other than that of
the owner, unless prior consent is given by the person owning the land on
which the dog is found. "Under Control" in this paragraph means the owner
or person accompanying the dog must be physically able to control the dog.

17. Every person who owns, controls or harbours a dog shall immediately
remove any excrement left by such dog on public or private lands in
the Township of Oro-Medonte.
17.1 Notwithstanding Section 1, proof that the owner is either a blind
person or an otherwise physically disabled person shall constitute a
defense to the prosecution of such an offence.
18. Any person may appear before a Justice of the Peace and swear an
information charging the owner of the dog with a breach of this by-
law."

They are Community Choirs
The Choirs were formed to offer an opportunity for
anyone 8 to 18 years of age to be part of a musical
experience. Throughout history and in every culture,
music has been written to capture expressions of the
people in work, play, celebration, protest, spiritual
pursuits, and simple entertainment. As a community
choir we are able to select freely from this vast treasure
trove of musical delights and hopefully also celebrate
our human diversity.
A quick history
The children's choir was formed as a single group in
the Fall of 1995 with 9 members. Since then it has
grown to as many as 34 members. The choir has
performed at a variety of venues -- from banquets to
Ploughing Matches, from Kiwanis festivals to schools
and churches. In 200 I the choir was divided into two
groups, The Oro-Medonte Children's Choir and the
Oro-Medonte Youth Choir.
The Oro-Medonte Children's Choir
This choir is open to any young person from the age of
8 and up. There is a strong emphasis placed on
learning the basic skills of reading music, hearing
pitch, developing the ability to sing harmonies, and
learning good vocal and choral technique. Members
are introduced to a variety of repertoire and will
participate in a variety of Concerts.
The Oro-Medonte Youth Choir
In order to fully realize the developing singers'
potential, a second choir was added. This choir will
includes young people from the ages of 12-18 (by
audition). The repertoire for this choir will be
significantly more advanced and utilize greater vocal
skills, reading ability and choral technique.
About the Director
Marilyn Gregory was born and raised in Saskatchewan
before attending Bethel College, Kansas to obtain her
degree in Vocal Performance. In addition she received
training in classical and jazz piano and in drama. She
taught music and theatre in Leamington for two years
and then worked in Musical Theatre in and around
Toronto from 1988-1993. During the 1993 season in
the Stratford Festival Theatre, Marilyn met her
husband, Bob, and moved to Hawkestone. There she
began teaching voice and piano, founded the Oro-
Medonte Children's Choir and the Hawkestone Singers
and has performed locally with jazz ensembles and
community theatre groups.
Who can join the Choirs?
Anyone between the ages of8 to 18 can join the choirs.
Marilyn Gregory believes everyone can sing and no one
is restricted from participating provided they are
enthusiastic about learning to sing in a choir and
Serious about their part in rehearsals and performances.
The youth choir requires greater musical skills and
therefore auditioning is required. To know what is
expected in auditions, contact Marilyn Gregory.
What can you expect to learn?
As a choir member you will learn to read music, to sing
melody and harmony (two or three parts) and to sing a
wide variety of music. Some of this music will be quite
contemporary and some of it will be very old but all of
it will give you something to enjoy and appreciate.
Most importantly, we will learn some of the basics of
good singing and how to help each other to be part of a
choir that sings well together. It is very important that
everyone brings out the best in each fellow choir
member.
About the Rehearsals
Rehearsals take place in the Hawkestone Community
Hall on Thursday evenings. The Children's Choir
(ages 8 & up) begins at 6:30pm and finish at 7:30pm.
The Youth Choir (12-18) will begin at 7:30 and finish
at 9:00pm.
About Performances
The choir performs at six to eight venues per term.
These usually take place during the final month of the:
term. There is a concert held in conjunction with the
Hawkestone Singers and special guests at the end of
each term -- a Christmas Concert in December and a ~
Cabaret in May. On these days we hold one concert at
2:00pm and one at 7:30pm.
The OMCC has annually taken part in the Kiwanis
Festivals in the area. As the choir develops, we look
forward to the prospect of future choir tours and taking
part in choral festivals held regularly across the
country

What additional costs are involved?
An annual fee of $10 will be applied for uniform
rentals.
A package of music will be provided to each chorister
which will be returned to the music library at the end

Everyone plays a valuable role. The enthusiasm and
attentiveness of each member helps to make every
rehearsal productive and exciting.
Attendance is very important as it is with any
successful team. We learn new material each rehearsal
and it is best when everyone keeps pace. If you are
unable to attend, leave a message at 487-6385 prior to
the rehearsal. If a member misses more than 3
rehearsals or concerts during a tenn, the family will be
contacted to discuss concerns.

As part of the learning experience in the Oro-Medonte
Children's Choir you will aJso learn to be a good
performer. Presentation, energy, focus and decorum
are all part of the skills of choral performance.

Each choir member will be able to pay a $10 annual fee
for the use of a uniform for performances.

Newsletters are sent home with the choir members to
keep everyone informed of upcoming performances and
events or changes to previously scheduled events.

you receive them.
Parent/Guardian Assistance
Parents' and guardians' roles are valued in the Oro-
Medonte Children's Choir. Supporting each choir
participant plays an important part in the child's
development (e.g. reviewing music, transporting
children, etc.). There are other ways a parent/guardian
may be able to help (e.g. bringing a tray of desserts for
the closing concert, assisting with riser set-up and take-
down, chaperoning the choir, etc.)

The parent committee is an important part of the day-

items as social convening, bookings, marketing and
communication, uniforms, and planning. Anyone who

The Oro-Medonte Children's And Youth Choirs is a
registered non-profit business which falls under the
management of a board of directors. The day to day
operations and fund-raising are managed by a choir
manager, the musical director and the parent's

I BACKGROUND
I
An application has been received to merge four lots on a registered plan of
subdivision in order to provide for one buildable lot with an existing dwelling of
approximately 8000 square feet and boathouse of approximately 900 square feet.
This request was received and circulated to all department heads for comments
and all comments are addressed.
The process in which to merge these four lots which are within a registered plan
of subdivision is through a deeming by-law.
The subject property is located at 27 Windfields Drive east of Line 4 South. A
map is attached for Council's reference.
The Assessment office records for the subject property show the property with
four property roll numbers with the same person (Michael Higgins) owning all
parcels. The applicant has been made aware that the only way to separate these
parcels in the future is through a consent application considered by the
Committee of Adjustment. Once consolidate the property would be
approximately 8 acres in total lot area and would contain a creek and
environmentally protected area at the eastern boundary of the property.
It is recommended that Council give favorable consideration to the deeming of
these lots through the attached deeming by-law.

IBACKGROUND
On January 31, 2002 a letter was received from the Ontario Municipal Board in
regards to acting as the approval authority for the above noted subdivision files
which were approved by the Ontario Municipal Board in 1994. A copy of this
letter is attached.
This request was discussed with the Township Solicitor to ensure all options for
the Municipality were available prior to a decision being submitted to Council
for consideration.
These subdivision applications were received and approved under a previous
Planning Act, which did not permit the Ontario Municipal Board to delegate the
final approval of the files to the Municipality. The Township of Oro-Medonte in
1994 at the time of the subdivision approval by the Board did not have delegated
approval authority approved by the Minister of Municipal Affairs and Housing.
Section 51(56.1) of the new Planning Act does provide that prior to final approval
and registration of the subdivision, the Board can delegate the final approval of
the plan to the approval authority (now the Township of Oro-Medonte);
however, this did not exist in the Planning Act in 1994 at the time of Board's

On this basis, it would appear that the Ontario Municipal Board does not have
the authority to delegate the above noted subdivision files to the Township. This
has now been confirmed verbally with the legal counsel for the Ontario
Municipal Board; however in order to close the request from the Ontario
Municipal Board the attached letter should be sent.

1. That this report be received and adopted; and
2. That the response prepared by the Planner with respect to delegation of
Subdivision File Nos. 43T-93019 (Valdoro), 43T-93022 (Sabiston), and 43T-91031

Township of Oro-Medonte
The Board is currently undertaking an extensive review of its files. The above noted files have been identified as
one of the older subdivision files at the Board. A Board decision has been issued on these matters and we are
awaiting the clearance of conditions of draft plan approval. In addition, to facilitate the clearance of conditions, the
Board has been canvassing the applicants (either directly or through their consultants) with respect to have their
various draft plans of subdivisions delegated to the Township of Oro-Medonte. The Board is also canvassing the
Township of Oro-Medonte on the delegation of subdivision approval.
Specifically, the Board is requesting your position on the delegation of final subdivision approval to the Township
ofOro-Medonte. Under Section 51(56.1) of the Planning Act, the Board may by order, provide that final approval
for the plan of subdivision be given by the approval authority. In order to delegate responsibility for fmal approval,
the Board requires consent from the applicants (either directly or through their consultants), and the Township of
Oro-Medonte. Please advise in writing (or by fax) if you consent to have the Township of Oro-Medonte act as the
approval authority on the above referenced subdivision files.
With respect to Subdivision File No. 43T-93019 by 850892 Ontario Limited (OMB File No. S940054), the Board
has received written confirmation, dated August 21, 2001, indicating that the applicants consent to have this draft
plan of subdivision delegated to the Township of Oro-Medonte in order to act as the approval authority. With
respect to Subdivision File No. 43T-91031 by Seeley and Amil Aggregates Ltd. (OMB File No. S930038), the
Board has received written confirmation, dated November 2, 2001, indicating that Mr. Bengt Schumacher, the
executor of the estate of E. Schumacher, consents to have this draft plan of subdivision delegated to the Township of
Oro-Medonte.

In accordance with your letter of January 29,2002 on the above noted files the Township provides the
following response.
While Section 51(56.1) of the new Act provides the authority prior to fmal approval for the Board to
delegate the fmal approval of the plan to the approval authority (now the Township ofOro-Medonte);
this did not exist in the Planning Act in 1994. On this basis, the Township's position is that the Board
does not have the authority to delegate the above noted subdivision files to the Township and would have
concern if such a transfer occurred without the proper authority.

Correspondence was received by the Committee of the Whole at its meeting on January 9, 2002
from the Program Co-ordinator of the Y.M,C.A. of Barrie, requesting the use of Memorial Park from
July 2nd through to August 23rd, 2002 to offer Junior and Senior Day Camps. This request was
referred to staff for a report.
The Y.M.C.A., a non-profit organization, has rented Memorial Park for the past two years to run day
camp programs. The provision of these programs has been at no cost to the Township. The
maximum number of registrants for the summer camp is 120 children per week.
In 2001, the total number of registrants for the eight-week period was 1,293 children, with 140 of
those being Oro-Medonte residents.

The registration fee is $100.00 per week for Y.M.C.A. members and $115.00 per week for non-
members. As part of Agreement No. PR 2001-01 with the Y.M.C.A., Oro-Medonte residents pay the
$100.00 per week member fee. Advertising for the program is done through the Y.M.C.A. brochure
and registration is on a "first come, first serve basis".
Expenses incurred by the Y.M.C.A. for the programs are as follows:
Fourteen (14) Day Camp Staff - ($7.00 per hour x 40 hours per week
for eight (8) weeks)
Buses - ($300.00 per day x 40 days)
Equipment and Supplies - ($500.00 per week x eight (8) weeks)
Administration - ($10.00 per child x number of registrants) (maximum
of 960 registrants)
Park Rental - ($150.00 per week x eight (8) weeks)

Staff is presently in the process of reviewing and developing suitable programs to be delivered from
two sites within the Township - Memorial Park and the Oro-Medonte Community Centre. As part of
this review, partnerships with various organizations are being explored, as is the use of the "Park
House" in the provision of such programs. The on-going partnership with the Y.M.C.A. would
complement new efforts being investigated for the 2002 summer season.
1. THAT the Township of Oro-Medonte enters into an agreement with the Y.M.C.A. for the operation
of Day Camp Programs at Memorial Park from July 2nd to August 23rd, 2002.
2. THAT the Mayor and Clerk be authorized to execute an agreement with the Y.M.C.A. and that the
Clerk be authorized to bring forward the appropriate By-law.
3. THAT Council receives and adopts this report.

AGREEMENT BETWEEN:

The undersigned have examined the conditions of the AGREEMENT pertaining to the operation of a Day
Camp, have visited the site and are fully informed as to the nature and conditions of the site.
The undersigned hereby offer to run a Day Camp program at Memorial Park and have use of the two (2)
pavilions and one (l) storage area in the large pavilion, and the general use of the park property for a rental
rate of$1,200.00 (one thousand and two hundred dollars).
TERMS AND CONDITIONS:
1. The Barrie YMCA will pay the Township $1,200.00 rental for the use of said buildings and park
property. This amount is due by July 3, 2001.
2. The Barrie YMCA will occupy the one (1) storage area in the large pavilion for use ofthe Day Camp
Director and staff&om June 26 to September 1,2001, Monday to Friday, 8:00 a.m. to 5:00 p.m. There
will be limited access to the area for preparation during the month of June 2000.
3. The Barrie YMCA will have use of both pavilions and general use ofthe entire property for their Day
Camp program.
4. The Barrie YMCA day camp staff will remove the luncheon garbage on a daily basis.
5. The Barrie YMCA will provide to the Township with proof ofliability insurance naming the Township
of Oro-Medonte as additionally insured and shall protect the municipality against all claims for all
damage or injury, including death, to any person or persons, and for any damage to any property of the
municipality.
6. The Barrie YMCA will comply with any laws, statues, by-laws and regulations that are applicable to a
daily Day Camp operation for children aged 5 - 12 years.

7. The Barrie YMCA understands that the general public will continue to have use ofthe park during the
operation of the Day Camp.
8. Either party can terminate this AGREEMENT by providing a ten-day written notice to the other party
prior to the termination date.
