Questions About Water Taking

Oro-Medonte Council is considering taking a bold step to regulate water taking at
the Township level.
I Support the concept oflocal control over water, but I have serious reservations
over what is happening in Oro-Medonte.
First, there must be peer-reviewed scientific studies in place that provide the
Township with the volume of water that may be taken on a sustainable basis, allowing for
future demands in the Township.
There must be peer-reviewed scientific studies that determine that the water Oro-
Medonte plans to regulate actually "belongs" to Oro-Medonte. This will involve drilling
deep wells and analyzing water samples.
Second, why the unseemly haste to push this matter through? The Province is
planning legislation that will give all municipalities some control over water.
The Lake Simcoe Region Conservation Authority has prime responsibility over
water in Oro-Medonte. Why is not an active player? The Water Taking Report should
have had major input from them. Why did it have this vital input not?
Oro-Medonte should stop work on water taking until clear directives come
from the Province of Ontario on the role of municipalities in water regulation. If
Oro-Medonte goes ahead it will be the first water taking local by-law and will likely
be challenged at the OMB at considerable cost to Oro-Medonte Ratepayers.
Third, this initiative, if it continues, will be closely watched by the ever-growing
water taking and bottling industry, other major water takers and various levels of .
government For example Coca Cola Corp. takes water south of Owen Sound. Industry
will not welcome new regulations.

All the policy papers, supporting documents, and the zoning by-law will be
subject to intensive review and examination as will the people and companies who wrote
them.
Herein lies a problem.
Nick MacDonald wrote the present policy paper. Mr. MacDonald appeared at the
Gold Mountain SpriDgs OMB Hearing in support of commercial water taking and the
building of a water-bottling plant in Oro-Medonte. Mr. MacDonald's OMB perfonnance
was not an auspicious one and his testimony was severely critized by Hearing Chair
Susan Fish.
Mr. MacDonald's OMB testimony was in defiance of Council who voted 7 - 0
against building the bottling plant.
Question: Can Council risk having Mr. MacDonald testify against its water taking
policy at an OMB hearing?
Question: Is a policy written by someone in favour of commercial water taking
and building a water bottling plant in the Township in the best interests of Oro-Medonte?
Mr. Kimble of Horseshoe Resort voiced concerns about the Township's initiative
at a public meeting. The Resort holds two water-taking pennits and is one of the largest
water-takers in the Township.
Mr. MacDonald does planning work for Mr. Kimble and on May 5,2004 he
appeared before the Planning Advisory Committee asking for planning changes on behalf
of Horseshoe Resort.
Question: Can a consultant serve two clients who may be on opposing sides of an
important policy matter.
Question: Should Council detennine if this represents a conflict-of-interest?
The way things stand MacDonald might be called by both Oro-Medonte and
Horseshoe Resort to testify at an OMB Hearing!
Oro-Medonte should immediately enact Conflict-of-Interest Guidelines for
consultants and advisors employed by the Township.
Question: Should Oro-Medonte Council then decide ifMr. MacDonald is the
best-qualified consultant, considering the above concerns. to write the Township's water
taking policy and zoning by-law and steer it through the regulatory processes?
If Council decides he is not the right person for this job then it should consider
putting the matter of providing Policy papers and a Zoning By-law for Township

consultants who qualify under the new Conflict-of-Interest Guidelines.

As an Oro-Medonte Ratepayer I have a right to answers, in writing, to the
following questions:
1 - Since January 2003 how much has Oro-Medonte paid Nick MacDonald and
Meridian for consulting and other services?
2 - Why is so much planning work outsourced when there are two staff planners?
There would be an objectivity and transparency if the work was done by the staff. When
we have the answer to the above question Oro-Medonte could hire more staffplanners.
3 - Why are projects like the Water Taking policy paper not put up for Tender?
This would ensure that tax dollars are being well spent.
4 - Why did Council not appoint an Advisory Committee to oversee the Water
Taking Project?

Dear Mayor Craig and Council:
At our meeting on June 3, 2004, the club became aware of the provincial legislation Bill II,
and the requests to each township from the Ontario Federation of ATV Clubs to use local
roads as a means to get from one part of their trail system to another.
Ori1lia District Snowmobile Club supports the use of the road-ways within the township if the
A TV Clubs have an approved trail plan in place, have third party liability insurance, have a
provincially registration plan in place, and are capable of policing the trail system.
Where use of a road allowance and/or where there is an existing snowmobile trail on public
lands, we are hopeful that ATV clubs would be respectful of the snowmobile club in late fall
and once grooming operations begin. In no way do we support the A TV clubs use of trails on
private land where the snowmobile club has negotiated an agreement with the landowner. It
is the A TV Club's responsibility to develop their trail system on private lands and to procure
their land use agreements.
Therefore the Orillia District Snowmobile Club supports the OFSC resolution stating that
"the Ontario Federation of Snowmobile Clubs support the authorized use of ATV's on
specific municipal roads when such use is part of a community-based plan for controlled
A TV travel that includes approved access to suitable off-road A TV opportunities as well as
planned enforcement programs and other defined measures to control both inadvertent and
deliberate A TV trespass."

ATVs Warned Off Snowmobile Trails
(Barrie, ON, May 12,2004): Stay off snowmobiJe trails on private land. That's the message
to ATV riders this summer &om The Ontario Federation of Snowmobile Clubs (OFSC)
following trespass comPlaints &om many local snowmobile clubs and landowners.
Illegal trail use by A TV riders is the leading cause of snowmobile trail closures in many
communities surrounded by private land. Often, A TV s have few authorized places to
travel locally, so riders trespass by using closed snowmobile trails on private property -
despite snowmobile clubs warnings to keep off, and without landowner permission. Most
landowners, who give special permission for snowmobilers to ride a club trail on their
property during the winter, do not want anyone on their land in other seasons. So if A TV
trespass occurs, it can mean permanent closure of a trail by the landowner, so
snowmobilers cannot even use it during the winter.
"Lack of permissible places for A TV s to ride is becoming a serious threat to the integrity
of our provincial snowmobile trail system, so the OFSC is encouraging A TV groups to
develop their own trails," stated OFSC General Manager Paul Shaughnessy. "Having
A TV trails is essential now that many municipalities are considering by-laws that, if not
properly developed, could allow A TV s to use local roads, thereby increasing deliberate
and inadvertent trespass on our trails."
Shaughnessy is referring to a provision of Bill 11 with which many municipalities are
currently struggling. It allows a municipality to decide if A TV s can use their roads.
Recently, the OFSC took an unequivocal position regarding A TV access to municipal
roads:
"The Ontario Federation of Snowmobile Club supports the authorized use of A TVs
on specific municipal roads when such use is part of a community-based plan for.
controlled ATV travel that includes approved access to suitable off-road A TV
opportunities as well as planned enforcement programs and other defined
measures to control both inadvertent and deliberate ATV trespass. >>
The OFSC concludes that, if a municipality allows use of its roads by A TV s without
A TV s having existing, legal trails to ride, then that municipality is effectively making its
own roads the local A TV trail network. It is also tacitly promoting A TV trespass on
I
private land, especially on closed snowmobile trails during the off-season. It is unlikely
that either of these consequences is an intended or desirable outcome for any
municipality.
"We fully support the desire of A TV riders to have trails of their own to ride," concluded
Shaughnessy, "and also recognize their need to move from A TV trail to A TV trail by
road just as snowmobilers must with snowmobile trails in the winter. So we believe the
priorities are to develop pennissible local A TV trails, and then to allow road access
where necessary."
The Ontario Federation of Snowmobile Clubs is dedicated to providing strong leadership
and support to member clubs and volunteers, to establishing and maintaining quality
snowmobile trails which are used in a safe and environmentally responsible manner, and
to furthering the enjoyment of organized snowmobiling.

Whereas many Ontario municipalities are contemplating the passage of
A TV road access by-laws which must balance the wishes of A TV users,
tourism operators, and service businesses with the concerns of
landowners, enforcement agencies, and other trail users and operators;
Therefore be it Resolved that the Ontario Federation of Snowmobile
Club supports the authorized use of A TV s on specific municipal roads
when such use is part of a community-based plan for controlled A TV
travel that includes approved access to suitable off-road A TV
opportunities as well as planned enforcement programs and other defined
measures to control both inadvertent and deliberate A TV trespass.

As you may have heard, this government has "uploaded" responsibility for bear
management back to the province and the Ministry of Natural Resources (MNR) has
taken the lead role in coordinating the new Bear Wise program. This program is the first
step in a comprehensive nuisance bear management strategy that will improve public
safety in bear-country communities.
I am writing to provide you with an update on the progress of Bear Wise, and to
encourage your community's involvement to help us further develop and implement this
important bear management strategy.
Bear Wise is based on four cornerstones: reporting, response, prevention, and
awareness and education. The key to the success of the program is the involvement of
everyone living in, or visiting, bear country. For example, studies show that the vast
majority of human-bear conflicts are the result of improperly stored garbage. Removing
birdfeeders, pet food and other attractants, ensuring garbage is secured indoors or in
bear-proof garbage containers until the morning of pick-up, and putting up electric
fencing around dumps, orchards or beehives, are just some of the ways we can reduce
human-bear conflicts.
The Ontario Provincial Police (OPP) recently signed an agreement with the Ministry of
Natural Resources fully supporting the Bear Wise program and clarifying roles and
responsibilities regarding response to bear situations.
Under this agreement, the OPP will respond to emergency bear calls, with the ministry
providing back-up as needed. People with non-emergency bear problems, or who want
information on preventing bear problems, can call the ministry's Bear Wise toll-free
number 1-866-514-BEAR (2327). The toll-free number is accessible 24 hours a day,
seven days a week during bear season. Information is also available from the ministry's
bear website at bears.mnr.gov.on.ca.

I am pleased that this agreement regarding roles and responsibilities has been
endorsed by the Ontario Association of Police Chiefs. Sault Ste. Marie and North Bay
are two of the first municipal police forces to sign on and we trust other communities will
soon join.
The ministry will also implement an improved bear harvest management system, an
enhanced population monitoring system, and more vigorous data collection and
analysis. Our goal is to provide better bear management while keeping bear populations
sustainable and ensuring the continuation of bear hunting opportunities and associated
economic benefits.
Since the Bear Wise program was launched, staff from my ministry have met with more
than 160 communities to get input about what they need from us to best deal with bear
issues. Some communities have begun to implement bear awareness programs and I
applaud those efforts.
If you have not already done so, I encourage you to contact your local MNR district
office to talk about how we can work together to reduce human-bear conflicts in your
community. There is also provincial funding available for community prevention and
public awareness programs.
We all have a role to play. I am confident that with your participation, the Bear Wise
strategy will help us reduce problem bear activity - and improve the safety and quality
of life for everyone living in bear country.

Lake Simcoe Watershed Plan - Public Consultation Sessions
I am pleased to invite you, your Mayor and Council, Commissioners and staff to one of our public consultation
sessions to discuss the state of the environmental health of the watershed and what action should take place.
See attached flyer for dates and locations. Your involvement, advice and support for the process is a critical
success factor to the development of our Lake Simcoe Watershed Plan.
I hope you have all had the chance to review the "State of the Lake Simcoe Watershed Report - 2003" prepared
by the Lake Simcoe Environmental Management Strategy partners. This report defines the current environmental
conditions within the Lake Simcoe Watershed and the socio-economic pressures impacting the health of the
watershed. It is the first step in the development of an overall Lake Simcoe Watershed Plan and will act as a
benchmark for measuring future changes within the watershed.
The Lake Simcoe Environmental Management Strategy partners are beginning the preparation for a basin-wide
watershed plan in order to identify priority actions to improve the environmental health of the watershed. Through
these public consultation sessions, we are hoping to involve as many stakeholders as possible, whether they
represent interest groups, landowners or individuals interested in our watershed. Please feel free to invite others
that you think may benefit from this session.

The' Nianara.Hilnli1lon WastePlan is. a joint initiative hy the Region of Niagara and the

05% diversion is achieved in both municipalities. Under the Niagara-Hamilton
WEtlllcPlan the two municipalities will be undertaking an Environmental Assessment
(EAl Study that will address the social, economic, and environmental concerns of
residents to find tho hest way to manage this waste.
'fhe development of the Niagara-Hamilton WastePlan has been guided by a Joint
Working Group made up of political and publiC members from both COmmunities. The
JoinlWorking Group has developed the foundation for this new initiative.
At the roquc;:t of tho ,joint Working Group, a meeting with local MPPswas convened in
llarty :?004 to raise awareness nbout tho Waste Plan initiative and begin a dialogue with
loelll reprcwntiltlves. Ti,e Joint Working Group has recognized that limited landfill

In response to growing concerns with the illegal use of All Terrain Vehicle's" (ATV's)
on NVCA, municipal, provincial and private lands the following resolution has been
supported by the NVCA Executive and awaits a decision by the NVCA's Full
Authority on August 13.2004 :
Recommended that:
Due to the current and future environmental damages associated with All
Terrain Vehicle (A TV) use on the significant lands within our watershed and
due to the minimum all around enforcement efforts available to control their
use on private, provincial. municipal and NVCA lands be it resolved that the
Land and Water Advisory Committee recommend to the NVCA Full Authority
Membership that all NVCA Municipalities be encouraged to not permit legal
travel on their municipal roadways and that this resolution be forwarded to all
NVCA member municipalities

We, the Directors of Ontario's Lake Country Tourism Marketing Board greatly
appreciate your generous support of the projects we have undertaken over the past
three years to increase the number of visitors to our regional communities.
Along with the other Lake Country communities, your support is reflected in the
passage of a motion to budget $10,000 per year for the period 2004-2006. You have
seen our plans for 2004. We look forward to presenting a progress report in the New
Year, and you are kept up-to-date by your representative to our Board, Chris Carter..
We are continuing to build our sectors into viable, active associations which can
best develop promotions to appeal to their specific audiences as well as the general
public. We have four associations in operation now and two more coming on-stream
very soon.
In order for us to avoid a "break in the action", we would appreciate receiving the
first of the three support payments ($10,000) as soon as possible.

Re: Proposed Area Specific Development Charge for Shanty Bay Estates Ltd.
(formerly MSL Property) located on Pt. Lots 27 an.d 28, Concession 3.
Shanty Bay Estates Ltd. (Fred Picavet in Trust) entered into an agreement of Purchase
and Sale with the National Bank of Canada on May 7, 2004 for the above mentioned
property. Said offer was accepted by the Bank on May 10,2004. The Agreement will be
finalized on July 30, 2004.
last Week, the undersigned received a telephone call from his planner, Ms, Celeste
Phillips, infonlling him that a public meeting had been held that concerns the subject
property. We were not aware of such a meeting and had not been notified of same by
the Nationall3ank, or we would have been in attendance. On July 7, 2004, after
contacting Mr. Nick McDonald, the Township Planner, the undersigned attended at the
Township Of;~ces and talked to your director of Engineering, Mr. Keith Mathieson and
your clerk, Ms. Marilyn Pennycook, who were kind enough to supply the undersigned
with a copy of report P02004-24 prepared by Nick McDonald, dated May 19, 2004,
which includG~d a report by R. G. Robinson and Associates (Barrie) Ltd. under File No.
12-00004-10 dated April 2004, as well as a letter from Robinson's office dated June 2,
2004 to Mr. Mathieson.
The report assumes that the Shanty Bay Estates Development will consist of 94 lots. If
same can be, guaranteed by the Township of Orc-Medonte, we then concur with the
report and a9ree that the cost per .Iot of $4,560.65 is reasonable. However page 6 (the
last page) of the report talks about 92 lots, The cost then adds up to $4,659.79 per lot
and not $4,f,,60.65 per lot as indicated. Furthermore, your Mr. Nick McDonald talks of
possibly a partially serviced subdivision of only 30 lots, which would give you a total of
139 lots to divide the costs per lot or $6,660.52/Lot. In which case, Arbourwood is not
entitled to allY recoveries as their cost would equal 109 x $6,660.50 = $725,996.68
compared to $725.812.15 expensed.

A message was left on Friday, July 9, 2004 with Mr. Rick Groves, the author of the
report. A further call to-day prior to the sending of this letter revealed that Mr. Groves is
on vacation so we were not able to review our findings with Mr. Groves,
We have instructed Terraprobe to re-commence work on the site and check the current
nitrate levels. We wish to start off on a positive note with the Township of Oro-Medonte
and hereby rE!quest that you defer the present request for the Area Specific
Development Charge until such time we have the results from our studies and have the
necessary mE~etings with the regulatory authorities enabling us to finalize the draft plan,
which we intend to actively pursue.

It has been brought to our attention by tbe waste and recycling coJlection contractor, that waste and
recycling collection can no longer be performed along BrambeJ Road. In March 2004, the issue of
access was brought to the attention of the County and the Township of Oro Medonte by the
contractor. Currently the only way that coUection can be performed is to back in or out of the road.
The contractor feels this is a serious safety concern with overhanging trees and twists in the road, as
weB as the potential for children playing being a major issue, at this busier time of year,
It is our understanding that the Township communicated with you as the representative of the Road
Association in order to seek approval for, :a wiBing host driveway for vehicle turnaround.,
construction of a proper turnaround in a designated piece of private property, or construction of a
suitable shed that would sit at the entrance of Brambet Road on the 4th Line. The first two
recommendations would allow the continued collection on the road and the latter would need to be
considered if collection were to cease on Brambel Road. If a shed were to be constructed, which the
County in no Conn or manner is supporting or requesting, the County would assume no responsibility
or liability for such a stmcture. or any unauthorized drop-off at this location or any items that were
left behind being in excess of allowable quantities.
Recently, the contractor received notification from the Township that the residents along Brambel
Road cannot accommodate either of the suggestions that would allow access to the collection
vehicles, As a result of this the contractor has advised the County that waste and recycling collec.tion
will no longer be provided along this private road, due: to safety concerns. They will, however,
provide service at the entrance of the road at the 41b Line. The following clauses in the contract
would pertain to the discontinuation of service along this private road:
2: 12.lOThe Contractor shalJ demonstrate establishment and maintenance of a health and safety
program with objectives and standards consistent with applicable legislation and with
owner's health and safety policy and requirements,
2:12.12The Contractor shall include health and safety pro\'isions in their management systems to
reach and maintain consistently high level of health and safety.

With regards to the letter dated July 8th from the Cty. Of Simcoe, requiring the residents to bring their waste to the
end of Brambel Rd. & Line 4.
I meet with the Cty and the Contract earlier this spring to look at the concerns brought forward by Mid Ontario.
They suggested that backing out of this road had become a health and safety issue with their employees and
could no longer continue to back out of this road.
I told them I would contact the residents on the street to see if come solution could be found.
I talked to Mr. Yeaman on a number of occasions, making him aware of the problem and possible solutions.
The solutions considered was to construct a turn around at the end of the street, which happen to be on his
property or allow the Contractor to continue threw the end of Brambel Road on a private lane to Ridge Road.
Mid Ontario was willing to wail until I had a opportunity to see if a solution could be made with the home owners.
Mr. Yeaman brought this problem to their association but were not willing to allow the construction of a turn
around.
Mid Onatrio review the private lane idea and said their trucks could not travel this lane.
After Mr. Yeaman made me aware of the associations position I contacted Mid Ontario which resulted in a letter to
the Cty. and now this correspondence to the residents.

GROUND:
On August 1,2002, correspondence was received from Sam and Sharon Gignac, requesting that the
Township transfer that portion of the road allowance on Lakeview Avenue which abuts their property
(Lots 97 and 98, Plan 798).
The lands comprising Plans 606 and 798 are shown on the attached map (Attachment #1). Plan
606 was registered as a plan of subdivision in 1912. In 1934 Plan 798 was laid over Plan 606. Plan
798 was bounded by Lakeview Avenue on the north and Lake Simcoe on the south. Lakeview
Avenue was deeded to the Township as part of Plan 798. The unopened road allowances deeded to
the Township in Plan 606 (Cedar, Jory, Hambly, Palling, Sunnyside, Indian Trail, Maple Road),
remain as they were deeded.
The Corporation of the Township of Oro, by By-law No. 90-56, stopped up and closed part of
Symond Avenue and all of Lakeview Avenue on Plan 798, Township of Oro, designated as Parts 1
to 15 inclusive on Reference Plan 51R-20265. A request in 2000 to purchase Part 1 of Lakeview
Avenue, prompted the Township to correspond with all the abutting owners on Lakeview Avenue and
Symond Avenue to determine their interest in purchasing the road allowance. At that time, interest
was shown by the owner of the lands north of Lakeview Avenue and the owner abutting Part 7.
However, only one part of the road allowance, Part 7, was sold. The present applicants did not
purchase Part 2 at that time; and now request that Council reconsider the sale.

The lands directly north of Lakeview Avenue (between Lakeview and Cove) were sold in July of
2001. Since 2001, three of the properties north of Lakeview Avenue have been sold to separate
owners. The remainder of the lands are owned by one person (hatched to show a dwelling unit on
Attachment #1. An easement over Lakeview Avenue was granted by the Committee of Adjustment in
September, 2001 to allow for construction of this dwelling unit. A further easement application has
been submitted (July, 2004) by the owner of the two lots sold at Cedar and Jory to allow for
construction of a dwelling.
The portion of the closed road allowance that is the subject of the request by Mr. and Mrs. Gignac is
Part 2 of Plan 51 R-20265, as shown on Attachment #1.

A site inspection was undertaken by the Chief Administrative Officer, the Road Superintendent, the
Senior Planner and the Clerk to obtain an overview of Lakeview Avenue and the entire parcel of land
that lies north of Lakeview Avenue. Discussion included accessibility for winter maintenance and the
accommodation of future possible drainage over Township property.
It is the recommendation of staff that no further sales of the Lakeview Avenue/Symond Avenue road
allowances be approved until such time as an assessment is made of drainage needs south of
Highway 11. Future use of Township road allowances is a key factor in this area in the development
of a managed drainage plan. It is also recommended that Mr. and Mrs. Gignac be advised that
Council cannot grant their request to purchase Part 2, 51 R-20265.
I RECOMMENDATION
I
1. That Report ADM2004-032 be received and adopted.
2. That the portion of the original road allowance known as Part of Lakeview Avenue, Plan 798
(Oro), more particularly described as Part 2, 51R-20265, be retained by the Township.
3. That no further sales of the closed road allowance known as Lakeview Avenue/Symond Avenue
(Parts 1 to 15, 51 R-2026S) be approved until such time as an assessment is made of drainage
management needs in the area.
4. That no further sales of the unopened road allowances on Plan 606 known as Cedar Walk, Jory
Avenue, Hambly Avenue, Palling Avenue, Sunnyside Avenue, and Indian Trail be approved until
such time as an assessment is made of drainage management needs in the area.
5. That the applicant be advised of Council's decision.

BACKGROUND:
After the flood at the Old Town Hall which caused extensive damage to the records/documents
stored in the basement vault, Council directed that staff encourage the Simcoe County Archives to
apply for funding from the Canadian Council of Archives to restore and preserve the Township's
historically significant documents.
ANAL YSIS:
The County estimate for restoration of approximately 25 Assessment Rolls/Collector's Rolls (from
1880's to 1940's) was $9,583.16 for student staffing and $500.00 to $600.00 for consumable
supplies for the project (masks, gloves, suits, etc.) Funding from the Canadian Council of Archives
was not sought by the County Archivist.
After consideration of various alternatives and costs, an in-house solution to the retention of the
damaged records was decided upon. To minimize the health risk to staff and maximize the amount of
material to be retained, Assessment Rolls/Collector's Rolls were transferred to digital images. Two
students, hired for the summer roads crews, were seconded for two weeks to perform the digital
imaging and destruction. The destruction process was carried out in consultation with the History
Association and in accordance with the Township's records retention by-law.

Staff were successful in obtaining a wage subsidy from the Ministry of Municipal Affairs (Rural
Summer Jobs Service) to offset the salaries of the students working on the project. This subsidy
resulted in a saving of $534.00. The total cost of the project, including materials (gloves, coveralls,
masks, etc.) was $4059.14. The damaged historical Township documents are now in a format that is
accessible, readable and retrievable for research purposes.

ACKGROUND:
On April 6, 2004, correspondence was received from Bloom & Lanys, Barristers and Solicitors
representing Huronia Homes Ltd. (Mr. L. Orsi), requesting that the Township transfer lands to the
applicant to proceed with the proposed plan of subdivision. The applicant has deposited the required
$5000.00.
Huronia Homes has entered into a Subdivision Agreement with the Township. The Director of
Engineering and Environmental Services has advised that the requested lands are required by the
developer to meet the conditions of the agreement.

IANAL YSIS
Mr. Orsi has made a request that the Township transfer to Huronia Homes Ltd. Parts 14, 16, 17, 18,
20,21,22, Plan 51R-16674 which are located in his new plan of subdivision on Bidwell Road. The
lands for proposed transfer are highlighted on the attached map. (Attachment #1).
The lands are divided as follows:
1. In 1993 the Township of Oro closed the Road Allowance comprised of Parts 14,16, 17, 18
and 21, 51 R-1667 4 by By-law 93-8. These lands were not transferred from the Township to
any other owner at that time.
2. The presently traveled road (Bidwell Road) is comprised of Parts 13,15,19,23,26, 51R-
16674.
3. Parts 20 and 22, 51 R-1667 4 are not part of the original closed road or of the presently
traveled Bidwell Road.
Parts 16, 17, 18, 20, 21 and 22 make up a substantial part of Lot 1 of the new plan of subdivision.
As well, Part 14 is part of Lot 13 of this new plan. Through negotiations with staff, Mr. Orsi of Huronia
Homes has accepted, with Council approval, that the selling price for the lands be $22,000.00 - the
'price Mr. Orsi paid for the lot last year. The $5000.00 the Township holds for this application would
meet the costs associated with the transfer (legal, advertising, etc.)
.It is recommended that the subject lands be declared surplus and conveyed to Huronia Homes.
Parts 14,16,17,18 and 21, 51R-16674 (road allowance) have been permanently closed. Parts 20
and 22 would have to be declared surplus and dealt with under "Sale of Surplus Lands" procedure

1. That Report ADM2004-034 be received and adopted.
2. That Parts 14, 16, 17, 18 20, 21 and 22, 51R-16674 be declared surplus to the needs of the
municipality.

In November, 2003, FSP Holdings Inc. entered into a Road Improvement Agreement with the
Township to upgrade Line 1 North, 400 metres north of County Road #22. At the time of entering
into the Agreement, FSP Holdings Inc. posted securities in the amount of $30,000.00 to ensure the
works were completed.
Mr. and Mrs. Bertram are now requesting release of the $30,000.00 securities, as the road upgrades
have been completed.
Mr. AI Lees of R. G. Robinson and Associates Ltd. and Mr. Keith Mathieson, inspected the road on
June 29, 2004 and have no concerns with the completed construction.
Township staff has been circulated and all concerns have been satisfied.
1. THAT Report No. EES2004-36 be received and adopted.

On April 14, 2004 Council received a report FD 2004-04 regarding the re-naming and
re-numbering of portions of Line 8 South. At that time the recommendation was that.
the report indicating the need to re-name and re-number portions of Line 8 South be
received and that the affected residents be notified and provided an opportunity to
provide input to Council on the changes.
On May 31, 2004 a notice and a copy of the report was sent by first class mail to all
affected residents, 25 residents in total. A Public Meeting as required by the Municipal
Act was held on June 16, 2004 at which time the following comments were received:

John Sarjeant - 633 Line 8 South (to become 169 Rail Trail Drive)- supportive of name
and numbering change - had slow response time from ambulance in past, recommend
the street be re-named to "Rail Trail Way" as the majority of traffic in this area is utilizing
the trail
Phil Houghtling - 971 Line 8 South (to become 271 Lakeshore Road East) - supportive
of name and number change - believes it would make common sense to rename to
Lakeshore Road
Verbal Comments
Darren Jack - 1001 Line 8 South (to become 159 Lakeshore Road East) - supportive
of name and numbering changes, concerned that emergency personnel will be able to
find their property, inquired about stopping up and closing that portion of Line 8 South
below Lakeshore Road which is the access to his house
James Fildey - 942 Line 8 South (to become 362 Lakeshore Road East) - not
supportive of change, believes there is currently no difficulty in finding the two affected
streets, believes there is too much work involved for the residents which is not
warranted
As indicated in the previous report, the changes have been deemed to be ne,pessary to
ensure that emergency services are not delayed in their response times 'to the two
affected areas. It is therefore recommended that these changes be implemented as
soon as possible.
All affected residents were notified in writing that this report would be presented to
Council at the July 14, 2004 meeting should they wish to attend to listen to Council's
decision on this matter.

The southerly section will be re-named to Lakeshore Road East and re-numbered
between the existing assigned municipal numbers. Those residents affected by this
change will be provided a notice with their new number and replacement green sign.
The Public Works department would be responsible for the removal of the Line 8 South
signs and the installation of the new street signs including the additional directional
signage to Mr. Jack's property.

The northerly section required a new street name as well as the appropriate re-
numbering. One resident in the area in their written submission proposed "Rail Trail
Way" given the proximity of the trail to the affected area and its usage by the affected
residents. It is recommended that Rail Trail Drive would be more appropriate and
would recognize that this is a connecting road to other roads in this subdivision and not
a cul-de-sac. This proposed name change would be consistent with the Township's
street naming policy by recognizing a geographic feature in the area.
The Clerk's Department circulated the proposed name "Rail Trail Drive" to all the
neighbouring municipalities for comment in regards to potential name conflict and no
concerns were received.
On this basis, it is recommended that the portion of Line 8 South between Spinghome
Road and the rail trail be re-named to "Rail Trail Drive" and that the residents be
notified accordingly of their new addresses (name and number) and provided their
replacement green sign. The Public Works department would be responsible for the
replacement of the existing street signs with the new street name signs.

MMENDATIONS:
It is recommended to Council:
1. THAT Report No. PD 2004;.31 be received and adopted; and
2. . That Council authorize the renaming of the southern portion of Line 8 South from
#927/932 Line 8 South to #970/1001 Line 8 South to Lakeshore Road East;
3. That Council authorize the renumbering of all properties fronting on the new portion
of Lakeshore Road East;
4. That Council authorize the renaming of the portion of Line 8 South from the rail-trail
to Springhome Road to Rail Trail Drive and the renumbering of all properties fronting
on Rail Trail Drive;
5. That the County of Simcoe GIS Department be advised of the street name and
numbering changes; and that
6. The Clerk bring forward the appropriate by-law to implement the street naming
changes.

On May 26, 2004 Report PD 2004-23 was presented to Council for consideration of a draft
Background Study and By-law to amend the Development Charges for the Township of Oro-
Medonte. Report PD 2004-24 was a separate report requesting consideration of the implementation
of an area-specific charge for Concession 3, South Part of Lot 27 Part of Lot 28, 51 R 19629 Parts 1
to 4 (Oro) related to water system upgrades.
Discussion occurred at that meeting in regard to an amendment to the background study attached to
. Report PD 2004-23 to include a generator required at the Administration building for emergency
purposes and which would allow for the Administration Building to be utilized as the Alternate
Emergency Operations Centre in the event the Main Emergency Operations Centre at the 4th Line
. Fire Administration Centre is not operational. The Background Study was revised to include a charge
for the generator and the revised Background Study is dated June 21,2004 and was the document
presented at the public meeting on June 21, 2004. The increase in the Development Charge related
to the generator for each new single detached dwelling is $ 8.64.
This amendment brings the Development Charges proposed to be implemented by by-law to
$ 3,833.45 for each single detached dwelling and $ 3,243.68 for each other dwelling unit.
In accordance with the Development Charges Act prior to the consideration of the revised Township
Wide Development Charges by-law the following resolution is required to be adopted by Council:
"WHEREAS the Corporation of the Township of Oro-Medonte has determined that the development
of lands within the municipality will increase the need for municipal services;
AND WHEREAS it is deemed appropriate to ensure that new development pays for the increase in
the need for municipal services;
AND WHEREAS the Council of the Corporation of the Township of Oro-Medonte has held a public
meeting in accordance with the Development Charges Act, 1997 on June 21, 2004;
AND WHEREAS it has been determined that no additional public meeting is required in accordance
with Section 12(3) of the Development Charges Act, 1997;
NOW THEREFORE, Council resolves that:
a) the recommendations made in the Background Study attached to Report PD 2004-23, as
amended dated June 21, 2004 be adopted;
b) it intends to ensure that the increase in need for services attributable to the anticipated
development in the Municipality will be met by collecting an appropriate Development Charge;
and
c) no further public meeting is required in accordance with Section 12 (3) of the Development
Charges Act, 1997."
Subsequent to the adoption of the Township Wide Development Charges By-law the following
resolution is required to be adopted prior to the consideration of the Area Specific Development
Charges for Concession 3, South Part of Lot 27 and Part of Lot 28 (Oro).
"WHEREAS it is considered appropriate to collect Development Charges for water system upgrades
in Shanty Bay;
AND WHEREAS the Council of the Corporation of the Township of Oro-Medonte has held a public
meeting to consider such an Area-Specific Development Charge in accordance with the
Development Charges Act, 1997 on June 21,2004;
AND WHEREAS it has been determined that an additional public meeting should not be held;
NOW THEREFORE, Council resolve that no further public meeting is required in accordance with
Section 12(3) of the Development Charges Act, 1997."
