1. Background
The Couchiching Conservancy
The Couchiching Conservancy is a non-profit, non-government organization dedicated
to protecting the special natural features of this region for future generations. Since its
creation in 1993, the Couchiching Conservancy has worked with landowners and other
organizations to protect over 4600 acres of wetland, alvar and forest in the region
surrounding Orillia.
Goals of the Ora Moraine Project
The forested hills of the Oro Moraine, which stretch from Bass Lake to Craighurst, have
been identified as one of the most significant natural landscapes in this region. This
study was undertaken to provide a tool for better understanding the biological functions
of the Moraine, as well determining pressures and impacts of human encroachment.
The findings of this survey will be used to educate landowners about the importance of
their woodlands to the overall biological health of the Moraine, as well as encouraging
and supporting their individual interests in good stewardship and longer-term
conservation projects.
The Oro Moraine Habitat Project, which began in the fall of 2000, has three goals:
· to compile and analyze site-specific information on ecological significance and
land use threats;
· to educate and involve landowners in conservation of forests on the Moraine;
and
· to enlist the participation of a range of conservation agencies in specific, targeted
protection projects.
This report summarizes the findings of the biological field work, and thus relates
primarily to the first goal.

Most of the field work for this study was carried out by David J. Hawke, a wildlife
technician and naturalist who lives within the Moraine, Kerry Green coordinated
landowner contacts and project administration. Field assistance was also provided by
Catherine Trainor and Juliana Hawke. In later stages of the project, Ron Reid took on
the coordinating role for the project.
The Oro Moraine Habitat Project was guided by a Technical Committee, comprised of

2. The Study Process
Field work for this study took place over the spring to fall seasons of 2001 and 2002,
with related preparation, landowner contact, and reporting activities extending into the
winter seasons,
Identifying Boundaries for the Moraine and for Study Sites
A boundary for the Oro Moraine was needed to determine where to concentrate field
study efforts. Defining a specific boundary was difficult due to the mix of soil types,
geological history, water discharge/recharge areas, and municipal/political lines that
intersect with this area.
Four different boundaries were considered:
- a preliminary boundary established for a GIS mapping project by Sir Sanford
Fleming College students;
- a topographical boundary set at a common elevation (875 feet a.s.I.);
- soils mapping of Taiga sandy loam, Vasey loamy sand, Sargent sand;
- a planning boundary proposed by Azimuth Environmental Consulting Inc. for
the Township planning study.
In the final analysis, the boundary line used in this study is very similar to that used by
Azimuth. Spatial mapping provided by the Severn Sound Remedial Association
characterize current conditions within this boundary as shown in Table 1.

As shown on Figure 1, "Ora Moraine Significant Woodlands",a series of 49 study sites
were initially mapped for field work. Sites were determined by looking for areas of
continuous canopy coverage, based on air photos. Typically, sites are separated by
concession roads, hydro transmission corridors, or open farmland.
As the study progressed, some of these sites were dropped from further consideration
for field work, and a few were combined, Most of the sites not visited were either

outside the Moraine boundary, fragmented sites along the margin, or seriously
compromised by housing developments or aggregate extraction commitments.
In total, 31 sites were surveyed in detail in the field, including all of the large sites within
the core of the Moraine, and most of the remainder were visited at least briefly.
Identifying Priorities for Field Work
An initial ranking system was applied to the sites to determine an order of priority when
contacting landowners and conducting field visits, This was not to say that Landowner
A had a 'better' site than Landowner B, but rather was to determine if one site should be
visited first due to site conditions, potential/real impacts or impending development
pressure. The following criteria helped determine these priorities:
Priority A:
- large continuous canopy coverage (over 500 acres);
- contained 600 feet of buffer to an edge, indicating interior woodlot;
- forest cover was mainly hardwoods;
riparian areas present;
- old growth forest indicated to be present (on previous MNR mapping);
contains ANSI boundary.
(8 sites identified; all visited)
Priority B:
- medium continuous canopy coverage (200 to 500 acres);
contained 600 feet of buffer to an edge, indicating interior woodlot;
- forest cover was mainly hardwoods, or mixed with hardwood dominant;
- old growth forest indicated to be present (on previous MNR mapping),
(9 sites identified; all visited)
Priority C:
small amount of continuous canopy (100 to 200 acres);
minimal interior area;
- fragmented from a nearby larger site;
hardwood dominant or mixed forest.
(6 sites identified; 5 visited)
Priority D:
interior lacking or minimal (less than 600 feet buffer from interior to edge).
(4 sites identified; 2 visited)
Priority E:
majority of site zoned for woodland subdivision or aggregate extraction,
(13 sites identified; all visited briefly)

Over 245 people are registered woodland landowners within the Moraine study area.
Most were contacted by letter and/or telephone; of these, 137 landowners responded.
The majority of these (119) responded in favour of field staff visiting their property to
gather data for this project. A fairly large number of land owners (109) could not be
reached, or did not respond to the information sent out. A few landowners (18)
requested that field staff do not enter upon their lands to gather data, and these
requests were honored.
Overall, we were able to access just under half of the forested properties on the
Moraine (48% of the landowners; 49% of the forested area) while only 7% refused
access. The remainder could not be reached.
A special "thank you" is extended to those land owners who allowed us (at times invited
us) to view their property. They are thinking as stewards for the land, and their actions
and interest indicate that conservation options will be considered whenever land use
decisions are required.
Field Methods and Data Collection
Data sheets were created by the contractor based on previous samples and
experiences with wetland evaluations, woodlot surveys, bird atlas sheets, and specific,
local requirements of the project. Data were collected on the basis of individual
"stations", located on the basis of topographic features, canopy type, and landowner
permissions to represent as well as possible the range of ecological communities
present in each site.
Where access had not been granted, some data could often be obtained from a
'fenceline' survey on adjacent properties, as well as from roadside and air photo
interpretation.
Over two summer seasons, 183 field stations were set within 31 sites, including all of
the high-priority sites.
The reference guide Ecological Land Classification for Southern Ontario: First
Approximation and Its Application (1998) was used to determine forest type to the
community level. This guide lists many typical types of habitats, providing a systematic
breakdown of land cover from general terms to specific forms, Information was also

collected on flora and fauna encountered at each station, habitat characteristics, and
land use.
Data Summaries and landowner Site Reports
All the field data sheets were summarized by topic on Excel spreadsheets. Each site
was then summarized, providing a complete listing of information gleaned from all field
stations within that particular site. Data were also compared from that site against the
data summary for the entire Moraine.
A non-technical summary of this information was compiled for each site and sent to
landowners within that site. These landowner reports include a map of forest cover
types, background information about the Moraine and good stewardship practices, and
resource sheets about healthy woodlots and related topics. Individual follow-up with
these landowners will continue to take place in the coming months.

I am the Chairman of the Valley Bridge Club which has beening using the Community Room on the 4th
Line since December of last year on the terms outlined in the attached letter.
Chris Carter wrote me a fetter this week advising that the Township now proposes to charge us
$12.00 per hour to use the facility
Our group which is composed of mainly Senior Citizens has been operating since 1995 and if we
have to pay what is proposed, it will cause our Club to "fold",
We certainly don't want to be put out of business and we require the opportunity to tell our story to the
Committee and ask for consideration in the matter.

We take this opportunity to express our concern regarding the zoning by-law amendment proposed for the property
located on the south east corner of Line 2 North and Simcoe Road II. There are four main reasons why we object to
the amendment.
. Heightened Noise Level During Motocross Events
. Undesirable Increase in Traffic Volume
. A Large Surrounding Area is impacted
. A Similar facility is exists nearby on Old Second South in Springwater
Firstly, the noise associated with Motocross events is excessive. Events held during 2002 at the same facility
demonstrated just how loud and irritating teams of accelerating motorcycles accompanied by a public address system
can really be in a nonnally peaceful rural atmosphere.
Secondly, as parents of a young family, the increased traffic volume on Line 2 is a safety concern, Directing vehicles
along other routes would ease our immediate concern, however it would simply shift the worry to other parents.
The third point addresses the fact that a large portion of our community will be impacted by this amendment. We ask
the Mayor and Council Members to consider the concerns of the larger surrounding area and the relationship of this
amendment with the approved Official Plan for Oro-Medonte.
As a fourth point, a similar facility exists approximately 10 minutes away from the property in question (see point "A"
on the map on reverse). Is there a need for another event centre in the immediate vicinity of an established facility?
It goes without saying that we do not like to object to one's personal use of one's property - we expect the same
from our neighbours. The planned amendment however, extends beyond personal use and, if enacted, will
undoubtedly have a major impact on the surrounding community for years to come,

May 21 st, 2003.
My wife and I own a fifty acre farm located on Drury Mi11 Road, south of
the proposed moto-cross site. We purchased the property in 1996 as it was
secluded and on a dead end road with only three other homes. This type of
solitude is extremely hard to find in this day and age, and being located only
seven minutes from Barrie made it all the more attractive. Previous to
owning this property, we resided on Dwinnell Road, Concession One,
Springwater Township. Our home at that time was located a mile and one
half south east of Doctor Farrington's property that is located on the west
side of highway 400. His property became Farrington Motor Park, and we
were subjected to the constant whine of every dirt bike trial or event, as well
as having to listen to the ongoing public address system, announcing riders
positions, lap times etc. etc.
As tax payers in Oro-Medonte township, we are steadfastly opposed to the
proposed moto-cross site located at the Old Barrie Road and Second Line.
We feel it is unfair and unjust to subject residents and land owners in the
area to the unnecessary noise and traffic, when there is a motocross park
within ten kilometers of the proposed site. We feel the council should act
on behalf of the majority of taxpayers and owner/residents whose tranquility
will be jeopardized, by rejecting any permits associated with moto-cross or
bike racing at this proposed new site on the Second Line, Oro-Medonte.

that the possible grant ranges from $5,000.00 to $15,000,00. If
successful, the money would be used to pay down the cost of new
shelving. One quote has been received thus far.

6.2 Strategic Planning Committee - Kathy Stewart~ Chairman
Mrs. Stewart reported on the Committee meeting held on March 18,
2003. The committee will be meeting with Peter Abbott of SOLS at
2:00 p.m. on Wednesday, April 23, 2003 to develop a community needs
survey, G. Griffith and B. Molesworth will go over the sample survey
questions sent to us by Mr. Abbott and possibly caB a meeting before
April 23.
6.3 Fundraising Committee - Gwen Anne Walker, Chairman
Mrs. Walker reported that ticket sales for the Literary Affair
DinnerlDance were moving slowly but that she expects them to pick-up
over the next few weeks. The Friends are stilJ looking for items for the
silent auction.
Mr. Molesworth spoke about his experience with Friends groups and
how to raise their profile in the community. Discussion.
Mrs. Walker will carry forward the suggestions ofthe Library Board
regarding the Friends structure.

Dear Ms. Pennycook:
The Ontario Ministry of Transportation has retained URS Cole Sherman & Associates Ltd. and
McCormick Rankin Corporation to prepare a Study Design Report to document the need for
transportation improvements and evaluation of possible alternatives for necessary
improvements to Highway 11 between Barrie and Gravenhurst in Simcoe County and the
Muskoka area. The analysis area within which alternative transportation solutions will be
considered is shown on the following attachment.
The need for this study was identified in the Simcoe Area Transportation Needs Assessment
which was completed in June 2002. The findings of the Simcoe study indicated that additional
highway capacity is required to accommodate future north-south travel between Barrie and
Gravenhurst. This study will assess whether this additional capacity should be provided within
the existing Highway 11 corridor or if a new corridor within the identified analysis area is
required.
This study will address the following specific elements:
Need and justification for the transportation improvements;
Identification of key environmental features to be considered in evaluating possible
transportation options;
Consideration of the possible "alternatives to the undertaking" (e.g. roadway, marine, rail
and transit);
Consideration of the possible "alternatives methods for carrying out the undertaking" (e.g.
improvements within the Highway 11 corridor such as widening or local by-passes, new
corridor alternatives, etc.); and
Identification of a study area for a possible future Environmental Assessment.

The Study Design Report represents a preliminary step in the planning process and will be
prepared in accordance with the requirements of the Class Environmental Assessment for
Provincial Transportation Facilities (2000). External agency and public consultation will take
place throughout the study. Two rounds of Public Information Centres (PIC) will be held during
the study to present findings, alternatives and receive public input. Notices providing the time
and location for each PIC will be published in local newspapers. A notice will be published in
local newspapers, upon completion of the Study Design Report.

The subject property is currently designated General Commercial Area in the City's Official Plan, and zoned
Agriculture A, by Zoning By-law 85-95.
. The applicant is proposing to redesignate the property Residential Area in the City's Official Plan and
rezone the lands to Multiple Family Dwelling Second Density RM2-TH and! Apartment Dwelling First
Density RAl under Zoning By-law 85-95 to permit the development of 4 apartment buildings having 3,4,5
and 7 storeys, containing a total of 154 units and 10 street townhouses.
In addition to consideration of the rezoning application, the developer will present plans for the preservation

The CAO announced that the Town of New Tecumseth has appointed Mayor Larry
Keogh as their representative on this Board. Mayor Keogh sends his regrets as he is
unable to attend today's meeting due to previous commitments however he did advise
that he is looking forward to being part of the LSRCA's Board of Directors. The CAO
. thanked Councillor Gary Lamb, Bradford West Gwillimbury for his representation of the
Town of New Tecumseth up until now.
Chair Roy Bridge advised that he and the CAO attended the official opening of the
Nottawasaga Valley Conservation Authority's new Administrative Offices on April 22nd,
2003.
5. Deputations
(a) McNabb Drain - Township of Ramara - D. Dabis
Chair Bridge invited Mr. Diether Dabisregrding their concerns as they relate to the
McNabb Drain in the Township of Ramara. Mr. Dabis tabled information and
photographs for the Board's information and provided a history of the McNabb Drain
and further provided information on the pollu,tion problems facing Lake Simcoe as a
result of this Drain_
Mr. Dabis and Ms. Kaiser-Reid requested assistance from the Authority's Board of
Directors in helping to resolve this issue. Mr. Dabis recognized that the Authority has
conducted some water monitoring of the McNabb Drain and extended his thanks for
that.
Deputy Mayor John West asked Mr. Dabis if he has requested through the Minister of
the Environment that an Environmental Assessment(EA) be done on the McNabb
Drain. Mr. Dabis responded that he had not requested the EA, however he has asked
the MOE to investigate the functionality of this drain.
Deputy Mayor John West asked that the Board Members receive the presentation and
the tabled documents for information and that a letter be sent to the Minister of the
Environment requesting information on what is being done about the McNabb Drain.
The Director, Environmental Services advised that there has been no EA done to date

e) Source Protection Planning
The CAO advised the Members that on April 21st, 2003, the Eaves'Government
released the final report on the recommendations of the Advisory Committee on
Watershed-Based Source Protection Planning to the Minister of the Environment. The
CAO served on the Advisory Committee as an alternate member for Conservation
Ontario.
The CAO tabled a copy of the Executive Summaryforthe information of the Board. The
final report contained fifty-five recommendations on a provincial framework for
watershed-based source protection planning. The CAO reviewed some of the most key
recommendations for the Board.
The final report has been placed on the Environmental Bill of Rights (EBR) for public
review and comment by June 21st, 2003.

The CAO delivered a PowerPoint presentation to the Board of Directors in order to
provide information on how the LSRCA is positioned for Source Protection Planning
(SPP) project. As the LSRCA and the NVCA share watershed areas and expertise,
both Authorities have been working together in order to prepare for the possibility of
getting the work on SPP. The CAO asked for permission from the Board to continue
this work.
The CAO outlined that there are 36 Conservation Authorities in Ontario and there will
be 16 Source Protection Planning Units. The province recognizes that some Authorities
do not have the capabilities of dealing with SPP so they have joined them with other
CA's that do. .
Deputy Mayor Susan Para asked what assistance the Board could provide staff on this
initiative. The CAO responded that the Board Members could endorse Conservation
Ontario's position and that individual municipalities review the final document and
provide their comments to the Government.
Councillor Larry Corrigan requested some clarification on financing. The CAO explained
that throughout the process 15 modules were:; developed by the Advisory Committee,
one pertaining to financing. Both the municipalities and the province will have to
contribute to SPP. The CAO again advised that the next two months is critical for public
input and to express concerns.
Mayor Holec commended the CAO for the work done on SPP and recognizes why the
LSRCA has been chosen to lead this initiative. The LSRCA is very well positioned for
SPP and should be congratulated for their work.
Chair Bridge advised the Board that both the LSRCA and the NVCA were highly
commended at the Conservation Ontario Policies and Issues meeting for their work on
SPP and for having the foresight to work together.

The Honourable Ernie Eves, Premier of Ontario, has forwarded to me your letter of
March 6, 2003 about the potential costs of complying with the Nutrient Management Act and
the proposed ban on septage.
As a result of recently-held public consultations, the Ernie Eves government has made changes
to proposed regulations under the Nutrient Management Act that will ensure the long-term
competitiveness of Ontario's agri- food industry, while protecting the environment.
The changes include simplifying proposed regulations and applying them initially to new and
expanding large livestock farms. Existing large livestock farms would be covered by
regulations in 2005. Other farms would not be covered until 2008 at the earliest, depending
upon recommendations from a provincial advisory committee and the availability of
cost-shared funding.
This balanced approach demonstrates that we have listen~d to what people were saying.
Thanks to the input we received, the proposed regulations will be clearer and more flexible for
farmers, allowing them to invest with confidence in their operations, while protecting the
environment.
New directions include:
. making July 1, 2003 the implementation date of the proposed regulations for all new
livestock farms and those expanding into and within the large farm category;
. setting up a provincial advisory committee that would provide recommendations to the
government regarding specific nutrient management issues;

of contact for on-farm nutrient management issues, including monitoring; and

authority to ensure compliance with the regulations through investigations and enforcement.
As indicated, the implementation dates of the regulations for all operations (except new and
expanding livestock farms) would be tied to the availability of cost-shared funding. As stated
in the 2003 Ontario Budget, "No action wi]] be required of ongoing small farms until
consultations on a manageable and affordable implementation of the act are completed and
funding programs established. 11
Forecasted costs associated with the act must be based on the final regulations, which have not
yet been determined. Consequently, the economic impact of the act cannot be accurately
calculated until the regulations are finalized. As we develop standards and regulations in
consultation with stakeholders, we will examine all implications, including costs to farmers,
municipalities and other stakeholders.
The Ministry of the Environment is responsible for the proposed ban on septage so I have
taken the liberty of forwarding your letter to the Honourable Chris Stockwell, Minister of the

NEW DIRECTION ON NUTRIENT MANAGEMENT
The Nutrient Management Act received Royal Assent on June 27,2002. A series of
consultations began in August, 2002 to collect input from a variety of stakeholders on
draft regulations under the act.
Thirty-four information sessions and public consultation meetings were held across the
province over the fall and winter. They were conducted in two stages, covering two sets
of draft regulations. Hundreds of stakeholders attended and/or participated in the
proceedings and Ministers Jolms and Stockwell hosted many of them. The ministers also
discussed the draft regulations at many other meetings with farm organizations,
commodity groups and stakeholder organizations. More than 500 written submissions
were received, including those under the Environmental Bill of Rights Registry.
As a result of this input, several changes are being proposed to the government's
approach to nutrient management in the province. The changes would provide farmers
with greater flexibility to comply with standards and maintain the government's key
water and environmental protection objectives
The government is proposing to make the following changes regarding the
implementation of the regulations under the Nutrient Management Act:
· Making July 1, 2003 the implementation date of the proposed regulations for all new
livestock farms and those expanding into and within the large category (more than
300 Nutrient Units). A nutrient unit is the amount of manure that gives the fertilizer
replacement value of the lower of 43 kg (95 pounds) of nitrogen or 55 kg (121
pounds) of phosphate. One nutrient unit is equivalent to 6 finishing pigs, 0.7 Holstein
dairy cows, 1 beef cow including unweaned calf and replacements, 1 horse, 150
laying hens, or 6 veal calves, to list a few examples.
· Making 2005 the implementation date for existing large livestock farms (more than
300 Nutrient Units).
· Setting up a provincial advisory committee. It would provide recommendations to the
government regarding nutrient management issues. The committee would include
farmers, environmental scientists, municipal representatives and others.

· Some of the issues that would be referred to this committee for further examination
and recommendations are:
· when the proposed regulations would apply to aB types of farms except new

· restrictions regarding the siting and construction of nutrient storage, as we]]

. seasonal outdoor feeding area standards

. odour-related setbacks and standards
. winter spreading restrictions for nutrients from the pulp and paper sector
. Tying the implementation dates of any future regulations, other than for new and
expanding livestock farms, to the availability of cost-shared funding.
. A protocol would be established whereby the Ministry of the Environment would
have the ultimate authority to ensure compliance with the regulations through

TORONTO - As a result of recently-held public consultations, the Eme Eves government has

"Fanners have, for years, voluntarily used environmentally responsible practices, and the
government wi)} continue to encourage them to do so," Johns said. "We're concentrating first on
regulating the priority areas that people told us were important."
The government held 1 4 consuhation meetings and 15 information sessions between November and
February across the province on the stage two draft regulations. These meetings covered several
areas, including mandatory nutrient management strategies and plans; the construction and siting of
barns; training and certification for those involved in nutrient management plans and strategies and
winter spreading.
Consuhations were also held earlier on stage one draft regulations, which dealt with the content
requirements of nutrient management plans, and the calegories of livestock operations that would
be required to prepare these plans.

This is a follow-up to our correspondence of July 9 and 31, 2001.
Our concern at the time related to the delay in the development of
Greenforest Park and more specifically the development of access to the
lake. Another two years are up with no development in the works and no
communication as promised in relation to the status of this project.
Our concerns remain the same. It is now coming up to eight years that we
have lived here waiting for this promised development to finally unfold.
Why is this issue being overlooked? Surely, even for a beaurocracy
eight years is enough time to develope a few acres of parkland:

Dear. Mr. Hughes
Thank you for informing us of the meeting on this subject on May 21,2003. Unfortunately I was in Toronto and did
not get back until well after the meeting had started so we are taking this opportunity to provide our input through
this email.
While there may be a number of impacts on the street, the most obvious one is that of increased traffic. As you
are probably aware this street is used by the neighborhood more like a park path than a road. The children ride
their bikes. people jog and walk their dogs. The question then becomes, are the benefits to be derived from the
larger community such that the changing of the local neighborhood is warranted. As I understand it emergency
services are implying a benefit and assume that the benefit is reduced time and/or ease of locating a site. It is
hard to understand that, if vehicles are approaching from the west, how it would be quicker to come down the 4th
and then across Windfields would be quicker than going along the Ridge Road and down the 5th. As far as
locating a site is concerned I understand they have street maps on which the emergency numbers are identified
and therefore can tell whether to access from the 4th or the 5th.
The question becomes should the local neighborhood be degraded for only marginal benefit for the larger
neighborhood. We think not.
Another option, while I'm sure it would require some effort, would be to change the name on the western portion

Windfield Dr. Two Issues
Dear Jennifer;
Issue no 1.:
This is to bring to your attention the fact that the gate at the West
end of our street, Windfield Drive. E., is in complete disrepair.
It is of utmost importance to fix this problem because with the gate
down cars continue driving along the pathway only to find out at the
other end that there is no way out. This forces them to back-up
damaging both the path and the plant life.
Issue no. 2:
It has corne to our attention that rumors in relation to the connection
of Windield Dr E with Windfield Dr W have now turned into a
recommendation on page 8 of the Draft Fire Emergency Services Department
Master Plan.
We feel that it is quite irresponsible that such recommendations be made
without consulting with the residents affected by such a proposal. We at
4 Winfield Dr. E. were not approached in this regard.
It is our belief that concerns of residents are of crucial importance in
this matter. Of the seven homes affected on Windfield Dr. E. six have
at least two children of either pre school or school age living in those
homes. At our home we have two school age children and two high school
kids. We specifically chose a dead end street to live on so that we
could be assured of the safety of our children.
Please note us as being completely against the joining of the two
streets in question.
We understand that the issue relates to Fire Trucks not knowing or
being confused by the similar addresses. Something tells me that if a
local emergency task force is not familiar with its own territory then
maybe it's in the wrong business. On the other hand if the "confusion"
of the local Fire Department is a real issue , then maybe simply
change the name of one of the streets.

Subject: Proposed Motorcross track
Following our attendance at Councill\1eeting l\1ay 21st, 2003 we wish to submit
the following in writing.
l\1y wife and I would like to express our disapproval to the proposed motocross
course scheduled for the location ..Cone. 2 and Old Barrie Road. We moved to
Oro to enjoy peace and quiet in this wonderful rural environment. We are not
adversed to some noise, caused by the cultivating of lands, and regrettably the
gravel trucks from the gravel pit on the 1st line. However, we were highly
aggravated and disturbed by the constant droning of motorcycles and/or the
loudspeakers used to announce the various races.
We are indeed concerned with a number of other issues and concerns which were
raised at the meeting i.e. traffic, poHution, the environment, eet.
I brought up the fact than the traffic count on Old Barrie Road is already quite
high due to the mountain biking activities and general weekend traffic heading
North and feel that this should be a concern for the township.
As far as benefits for the Township, we fail to see any whatsoever. The only
people who would indeed benefit would be the promoters and the farmer
concerned... It is too bad that this man has gone ahead with extensive work
building a track, altering landscape by making jumps, ect. however, the
Township did express the fact that this was all done by the owner prior to
receiving approval for this track, and therefore is of his own doing.
One would have to agree that with Burl Creek having an existing course as well
as the one in Vespra (which by the way is audible to us as well) enough is
enough.
Our recommendation is to work with the owner of Burl Creek and perhaps
expand and improve the facilities already existing.

the attendance at the last meeting, we would hope that Council sees it fit to deny
this application.

II BACKGROUND:
The Township ofOro-Medonte presently leases a postage machine and meter from Pitney-Bowes at a monthly
cost inc1uding taxes of $538.28. The lease on the current equipment expires on April 30, 2004. Pitney Bowes
has proposed that the municipality upgrade to a newer model of postage machine and meter, being the DM 800.

II ANALYSIS:
The lease for the said newer model would be for a period of 66 months. The monthly cost including
taxes would be $560.38, being a monthly increase of $22.10 or $265.20 annually.
The OM 800 has the following enhanced features:
mixed envelope feeding allowing batches of mail with mixed thickness to be processed
improved transport path which will reduce damage to envelopes and time consuming
document stalls or jams
on-line updating of postal rates and adding of postage funds
low postage warning
automatic date change
Weigh-on-the-Way (WOW) technology is also offered. This automates mail processing so there is no
need to weigh individual pieces. The correct postage is applied to a variety of envelopes by stacking
mail in the feeder and pressing go. The monthly cost including taxes for this feature is $213.09 or
$2,557.08 annually. While this feature would result in time savings in mail processing, it is difficult to
state that the benefits would justify the cost.

mailroom technology. We have also received excellent service from Pitney-Bowes. As such, I
respectfully recommend that the provisions of the Purchasing and Tendering Procedures By-law
requiring quotes to be obtained be waived.

PLANNING FRAMEWORK
Background
The request of the applicant is to sever a new residential lot with an area of about 2 hectares (4.9
acres). The proposed lot would have frontage along Line 2 of about 121.9 metres (400 feet).
The retained parcel would have a lot area of about 38.8 hectares (96 acres), with a frontage of
about 990 metres along Bidwell Road and about 412 metres along Line 2.
Township Of Oro-Medonte Official Plan
The Oro-Medonte Official Plan permits lot creation in the Rural designation in accordance with
the following policies and criteria:
. . .. Only one new lot can be severed from a lot in the Rural designation that has
an area of at least 36 hectares or is the whole of an original Township lot
provided a lot has not been severed from the parcel after March 26, 1973.
In considering the creation of a new lot for residential purposes, the Committee of
Adjustment shall be satisfied that the proposed lot:
a) Will have a minimum lot area of 0.4 hectares;
b) Is of an appropriate size for residential use, with such a residential use
generally not requiring a lot size that exceeds2.0 hectares;
c) Fronts onto an existing public road that is maintained year round by the
Township or County;
d) Will not cause a traffic hazard as a result of its location on a curve or a
hill; and,
e) Can be serviced with an appropriate water supply and an appropriate
means of sewage disposal.
The subject lands are also located within the Environmental Protection Two Overlay designation.
The purpose of this designation is to identify lands which are characterized by "less critical"
environmental features such as woodlands and wildlife habitat and linkage areas. According to
Section F1.4.1, the following policies apply to lands within the EP2 Overlay designation:
New development on lands within the Environmental Protection Overlay
designation is generally discouraged by this Plan. The development of any use in
the Environmental Protection Two Overlay designation that requires either an
amendment to the Zoning By-law or to this Plan shall also be subject to the
preparation of an Environmental Impact Study (EIS) and a Management Plan
(MP) to the satisfaction of Council before such an amendment is adopted. An EIS
and MP may also be required if other approvals under the Planning Act are
required.
Zoning By-Law 97-95
Both the proposed and retained lots would comply with the Zoning By-law provisions applicable to
the A/RU Zone.
ANALYSIS
The application conforms with the primary policy for lot creation in the Rural designation on the
basis that the subject lands constitute the whole of an original Township lot and no prior
severance has been granted from the subject lands.
The proposed lot area of 2.0 hectares also complies with the permitted range of 0.4 to 2.0
hectares set out in criteria a) and b) of the Official Plan. It is noted however that criteria b) states
that "the proposed lot must be appropriate for residential use, with such a residential use
generally not requiring a lot size greater than 2.0 hectares." On the basis that 2.0 hectares
represents the maximum lot area, it is suggested that the policy limit of 2.0 hectares should only
be granted in limited cases where topographic or other circumstances require the creation of a
larger lot. Prior to granting the proposed severance, Committee should be satisfied that it is
necessary to permit the creation of a lot with the largest allowable area.
The Environmental Protection Two Overlay designation also applies to the subject land and
requires that an EIS and MP may be required for Planning Act approvals, which includes
consents. In consideration of this issue, it is evident that the primary feature identified by the EP2
Overlay is the mixed woodlot on the property. While a woodlot area provides an important habitat
feature and linkage, it is unlikely that an EIS and MP would ensure a greater degree of
compatibility than existing zoning provisions for residential uses. On this basis, and given the
discretion provided by the Official Plan for consent applications, an EIS is not considered to be
necessary to support the proposed application.
CONCLUSIONS
1. The application conforms with the technical criteria for lot creation set out in Section D.2.3.3
of the Official Plan.
2. An EIS and MP is not considered necessary for the proposed application.
RECOMMENDATION
If Committee is satisfied that the proposed lot area is appropriate and that an EIS and MP are not
required, it is recommended that Committee approve consent application 812/03 subject to the
following conditions:
1. That three copies of a Reference Plan of the severed lands prepared by an Ontario Land
Surveyor be submitted to the Committee Secretary;
2. That the applicant prepare and submit 3 original copies of the deeds for the parcel(s)
severed, one copy to be retained by the Municipality;
3. That the applicant dedicate to the Municipality 5% as a parkland contribution or pay
$500.00 for each to be created as cash-in-lieu of a parkland contribution pursuant to
subsection 53(12) of the Planning Act, R.S.O. 1990 c. P.13;
4. That all municipal taxes be paid to the Township of Oro-Medonte; and,
5. That the conditions of consent imposed by the Committee be fulfilled within one year from
the date of the giving of this notice as noted below.

Background
In 1979/1980, the applicant was granted consent to create a new lot (Part 1) having a lot area of
0.60 hectares (1.5 acres). The retained portion (Part 2), which was conveyed to the applicant's
son, had an area of 1 hectare (2.5 acres).
When the applicant brought the overhead power line to Part 1, the line inadvertently crossed over
into Part 2. The applicant now wishes to remedy this situation by transferring a portion of land
from Part 2 to Part 1 to ensure the overhead power line is located entirely within Part 1.
The lands proposed to be transferred from Part 2 to Part 1 have a width of 6.1 metres (20 feet)
and an total area of about 732 m2 (7,879 ft2).
Township Of Oro-Medonte Official Plan
The Rural policies of the Oro-Medonte Official Plan are silent with respect to the issue of
boundary adjustments, which are sometimes referred to as technical severances. In the absence
of specific policies relating to the application, Committee should consider the overall objectives of
the Rural designation:
1. To preserve and promote the rural character of the Township and the maintenace of the
open countryside; and,
2. To prevent the intrusion of land uses which are incompatible with the rural character and
resources activities of the area.
Zoning By-Law 97-95
Both the proposed and retained lots would comply with the Zoning By-law provisions applicable to
residential uses in the AIRU Zone which requires a minimum lot area of 0.4 hectares and a
minimum lot frontage of 45 metres.
There would be no situations 01 non-compliance created by the proposed boundary adjustment.
ANAL YSIS
The proposed severance is a technical severance and is considered to be an appropriate remedy
an existing encroachment caused by an overhead power line.
CONCLUSION
1. The application does not offend the objectives of the Rural designation of the Official Plan
and is deemed to generally conform with the severance policies of the Plan on the basis
that the application will not result in the creation of a new lot.
RECOMMENDATION
It is recommended that Committee approve consent application B13/03 subject to the following
conditions:
1. That three copies of a Reference Plan of the subject lands prepared by an Ontario Land
Surveyor be submitted to the Committee Secretary which identifies the power line and
the land proposed to be severed as a Part having a width of about 6.1 metres;
2. That the applicant prepare and submit 3 original copies of the deeds for the parcel(s)
severed, one copy to be retained by the Municipality;
3. That the provisions of Subsection 3 or 5 of Section 50 of The Planning Act apply to any
subsequent conveyance or transaction involving the parcel of land subject of this
consent; and,
4. That the conditions of consent imposed by the Committee be fulfilled within one year from
the date of the giving of this notice as noted below.

PLANNING FRAMEWORK
Background
The subject property is presently occupied by a one storey dwelling with an area of about 82 m2
(880 ft2) and a carport with an area of 20m2 (220 ft2).
It is the applicant's intent to replace the existing carport with a single car garage. The proposed
garage would have an area of 34.7m2 (374 ft2).
The Four Tests of the Minor Variance
Does the variance conform with the general intent of the Official Plan?
The property is designated Residential. The primary function of the Residential designation is to
identify and permit residential uses, including accessory uses. The proposed variance, which
would permit the construction of an attached garage is in keeping with the intent of the Official
Plan.
Does the variance conform with the general intent of the Zoning By-law?
One of the purposes of maintaining interior side yards in the Residential (R1) Zone is to maintain
suitable setbacks between residential dwellings in the interest of privacy and to protect the
character of a single detached residential community.
Based on a site inspection, it is noted that the subject lot is buffered to some extent by a
landscaped hedge. To some extent this should mitigate the impact of a reduced separation
between the proposed addition and the neighbouring residence. On this basis the variance is
deemed to conform with the general intent of the Zoning by-law.
Is the variance appropriate for the desirable development of the lot?
The addition of a single car garage is a common element in the surrounding residential area and
the garage is proposed to be built in what would appear to be the most logical location on the lot.
On this basis the proposal is considered appropriate for the desirable development of the subject
lot.
Is the variance minor?
On the basis that the variance will permit a reasonable expansion to an existing dwelling, the
requested relief is deemed to be minor on the basis that the expansion appears compatible with
surrounding uses and is consistent the character of the residential area.
CONCLUSIONS
1. The requested variance is in keeping with the general intent of the Official Plan.
2. The requested variance is in keeping with the spirit and intent of the Township's Zoning By-
law.
3. The requested variance will provide for the desirable development of the subject property.
4. The requested variance is deemed to be minor.
RECOMMENDATIONS
It is recommended that Committee grant minor variance A 13/03, stipulating the following
conditions:
1. That prior to issuance of a building permit, an Ontario Land Surveyor provide
verification to the Township of compliance with the Committee's decision by 1) pinning
the footing and 2) verifying in writing prior to pouring of the foundation by way of
survey/real property report prepared by an Ontario Land Surveyor;
2. That the setbacks be in conformity with the dimensions as set out in the application, as
submitted;
3. That the appropriate building permit be obtained from the Township's Chief Building
Official only after the Committee's decision becomes final and binding, as provided for
within the Planning Act R.S.O. 1990, c.P. 13; and,
4. That all municipal taxes be paid to the Township of Oro-Medonte.

I have prepared this memo to provide Council with an update on the status of the UCCI
applications. As Council is aware, Mr. Ucci has submitted an application to amend the County of
Simcoe Official Plan and the Township of Oro-Medonte Official Plan to permit the development of
an Adult Lifestyle Community in Lots 26 to 28 in Concession 5 (Oro).
Township and County Councils have already held public meetings on the applications. It should
be noted that along with the County of Simcoe application, the County will be potentially
considering the inclusion of general policies in the County Official Plan to deal with Adult Lifestyle
Communities throughout the County.
It is my opinion that it would be appropriate for Oro-Medonte Council to made a decision on the
application prior to County Council being in a position to make a decision.
In order to be in a position to provide Council with a recommendation on this application, the
following steps need to be undertaken/completed.
1. The County has retained Jagger Hims Limited to review the servicing and
hydrogeological reports on behalf of the County. Since the County initiated this peer
review, Township staff have not involved Azimuth Environmental in the review of the
application. In my opinion, the peer reviewer must be in a position to recommend that
from a technical perspective it is possible and feasible to develop this many units with the
services proposed. This support in principal would be required, as one component of the
package, to enable Council to consider the matter. It is my understanding that some
additional information has been requested by the peer reviewer on the application.
2. The County has also retained SAAR Environmental to review the Environmental Impact
Study prepared for the development. It is my understanding that SAAR will be
conducting field investigations in late Mayor early June to verify some of the information
contained within the proponent's Environmental Impact Study. In order for this

component of the review to be completed, both the peer reviewer and the proponents
consultants must be in a position to agree that the proposed development will not have a
negative impact on natural heritage features and related ecological functions.
3. I previously raised a number of questions with respect to the market analysis carried out
on behalf of the proponents by Clayton Research. A response to my questions has been
submitted. Given that the identification of the demand for the type of units proposed is a
key component of the planning justification, I have initiated discussions with the County to
determine whether the work carried out by Clayton should be peer reviewed by Hemson
Consulting. Hemson Consulting is currently preparing population projections for the
County and each of its municipalities and is also assisting the Town of Innisfil with
respect to the review of a proposal at Big Bay Point.
4. In a staff report, the Ministry of Municipal Affairs and Housing, acting as the approval
authority for the County of Simcoe Official Plan Amendment, has raised a number of
issues with respect to the proposed development. I have suggested to the proponents
that a detailed response to the issues raised be prepared for our consideration. The
proponent has indicated that such a response will be forthcoming.
Following the completion of the above, I will then be in a position to prepare a report to Council on
the application for Official Plan Amendment. It is hoped that such a report can be prepared in
June so that the application can be considered by Council prior to September 26, 2003, which is
effectively the last day that Council can make a major decision.
