TO THE ZONING BY-LAW
OF THE TOWNSHIP OF ORO-MEDONTE
TAKE NOTICE that the Council of the Corporation of the Township ofOro-Medonte will hold a Public Meeting on
Wednesday, November 19th, 2003 at 7:00 p.m. in the Municipal Council Chambers. The purpose of the public
meeting is to obtain public comments on proposed a amendment to the Zoning By-law under Sections 34 of the
Planning Act, R.S.O. 1990 c. P. 13.

THE PROPOSED Zoning By-law Amendment would rezone lands described as Part of Lots 2 and 3, Concession 6
(former Oro Township) being lands within Registered Plans 51M-8, 51M-9, 51M-30, and 51M-3l (formerly within
the Township ofOro) from the Private Recreation Exception (PR*114) to the Residential One Exception (Rl*l13)
Zone.
The lands proposed to be rezoned are currently owned by the Indian Park Association. The lands are subject to a
concurrent Consent Application B-38/03, approved on October 29, 2003, the purpose of which is to permit a
series of lot addition severances within the Sugarbush Subdivisions. Indian Park Association owns all the lands
within the Sugarbush Subdivisions between the existing lots and the Township roads. The conditional Consent
approval would sever these lands and add them to the abutting lots in order to provide direct access and frontage
on the Township road. The proposed rezoning would rezone the severed lands to the (Rl *113) zone so the same
zone regulations would apply to the lands of the enhanced lots.
No KEY MAP is provided. Copies of the draft reference plan surveys are available for inspection at the Township
Offices.
ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of or in
opposition to the proposed Amendments. If a person or public body that files an appeal of a decision ofthe Township
of Oro-Medonte in respect of the proposed Amendments does not make oral submission at the public meeting or
make written submissions to the Township before the proposed Amendments are adopted, the Ontario Municipal
Board may dismiss all or part of the appeal. If you wish to be notified of the adoption of the proposed Official Plan
and Zoning By-law Amendments, you must make a written request to Marilyn Pennycook, Township Clerk, at the
address noted below.
ADDITIONAL INFORMATION relating to the proposed Zoning By-law Amendment is available for inspection
between 8:30 a.m. and 4:30 p.m. at the Township of Oro-Medonte Administration Building, in the Planning
Department.

Dear Chris;
On behalf of the Hawkestone And Area Community Association, we would like to express our
appreciation for all of the work you and your staff have done and continue to do in our area.
There are numerous times I have seen them inspecting playground equipment, hall grounds, and
the community park. Often this has involved doing repairs and cleaning up glass and debris to
ensure the safety of those who use our facilities. (A thankless task when there are some who
would deliberately damage property.)
Additionally, Township staffhave removed construction debris when we restored the hall
garage, brought topsoil for us to lay sod in a section of the lawn, cut the grass going into the
park, keep the smelt season garbage cleared, to name but a few of the helpful tasks.
Although much of this may be part of the day to day work of the staff, our community and
Association feels very much obliged to them for their ongoing efforts which always seem to
done with a smile.

BACKGROUND
An application was submitted by Mr. Johnson to construct a deck on his property in the former
Township of Orillia. The property is currently zoned Residential Limited Service (RLS*2(H)). This
zoning was placed on the lands in 1997 because the lands did not front on a public road that was
assumed for maintenance purposes. The intent of the Holding provision was to ensure that an
agreement was registered on title acknowledging that municipal services are not available to
service this lot.
On the basis of discussions with Jerry Ball, the roads superintendent, it appears as if the road is
maintained by the Municipality but has never been assumed by the Township for maintenance
purposes. This means that an agreement is not required.
RECOMMENDATION
It is recommended that Council:
1 . Receive and adopt this report;
2. Adopt the attached By-law that removes the Holding provision from lands known as 14
Devitt Street, Township of Oro-Medonte.

BACKGROUND
An application was submitted by Mr. Hughes to construct a new home on lands along Highland
Drive within a recently registered Plan of Subdivision (Plan 51 M-592). The lands are zoned with
a Holding provision to ensure that a Site Plan Agreement is entered into between the Township
and the lot owner. The intent of the Site Plan Agreement is to ensure that the home, driveway
and amenity area are located appropriately and that a natural area remains on each lot.
Such a Site Plan Agreement has been entered into and it is now appropriate to remove the
Holding provision.
RECOMMENDATION
It is recommended that Council:
1 . Receive and adopt this report;
2. Adopt the attached By-law that removes the Holding provision from lands along Highland
Drive within Plan 51 M-592 owned by Mr. Hughes.

A. PROPOSAL/BACKGROUND
FSP Holdings Inc. received OMB approval early in 2003 for the "Settlers Ghost" golf course in Lot 41
and Part Lot 42, Concession 2 (Medonte) being Part 1, Reference Plan 51R-30187. The lands are
located on the north side of Horseshoe Valley Road east of the community of Craighurst. The owner
entered into the required Site Plan Agreement with the Township and posted the required Securities at
the end of October, 2003
The applicant has requested that the holding symbol on the lands be removed from the property. The
OMB final Order requires confirmation from the Township that the holding symbol has been removed.

By-laws to regulate the use of land pursuant to Section 34 of the Planning Act, R.S.O. 1990,

AND WHEREAS Council deems it appropriate to place the subject lands in the same residential
zone as the abutting residential lots to which the subject lands will be merged pursuant to
Provisional Consent B38/03;
AND WHEREAS the passage of such a by-law will conform with the Official Plan;
NOW THEREFORE the Council of the Corporation of the Township of Oro-Medonte enacts as
follows:
1. Schedule 'A16', to Zoning By-law No. 97-95 as amended, is hereby further amended by
rezoning those lands located in Part of Lots 2 and 3, Concession 6 (former Oro Township)
being lands within Registered Plans 51 M-8, 51 M-9, 51 M-30, and 51 M-31 from the Private
Recreation Exception (PR*114) to the Residential One Exception (R1*113) Zone as
shown on Schedule 'A' attached hereto and forming part of this By-law.
2. Section 7.113 *113 - REGISTERED PLANS M-S, M-9, M-30 AND M-31 (FORMER ORO)
is hereby amended by adding a new clause "d)" as follows:
"d) The minimum lot area and frontage shall be deemed to comply with the provisions
of this by-law.
3. This By-law shall come into effect upon the date of passage hereof, subject to the
provisions of the Planning Act, as amended.

BEING A BY-LAW TO CONFIRM THE PROCEEDINGS OF THE COUNCIL
MEETING HELD ON WEDNESDAY, NOVEMBER 19, 2003.
THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE
HEREBY ENACTS AS FOLLOWS:
1. THAT the action of the Council at its Council Meeting held on Wednesday,
November 19, 2003, and in respect to each Motion, Resolution and other actions
passed and taken by the Council at its said Meeting is, except where prior
approval of the Ontario Municipal Board is required, hereby adopted, ratified and
confirmed.
2. THAT the Mayor and the proper Officials of the Township are hereby authorized
and directed to do all things necessary to give effect to the said action or to
obtain approvals where required and to execute all documents as may be
necessary on behalf of the Council of the Corporation of the Township of Ora-
Medonte. And, the Clerk is hereby authorized and directed to affix the corporate
seal to all said documents.
