THE CORPORATION OF THE TOWNSHIP OF ORO
BY-LAW NO. 90-39
A By-Law of the Corporation of the Township of Oro
to regulate the parking of vehicles
WIIEREAS Section 210 of 'fhe Hunicipal Act, being
R.S.O. 1980 c.302, authorizes local municipalities to regulate
the parking of vehicles;
AND WHEREAS the Corporation of the Township of
Oro deems it advisable to pass a by-law pursuant to the said
Act:
NOW 'l'lmREFORE the Council of the Corporation
of the Township of Oro enacts as follows:

"By-Law
purposes
Enforcement Qfficer" means the By-Law Enforcement Officer so
designated from time to time by the Council of the Corporation
of the Township of Oro.
1. 02
"Highway" includes a common and public highway,
street, avenue, parkway, driveway, square, place, bridge, viaduct
or trussel, designed and intended for, or used by, the general
public for the passage of vehicles.
1. 03
"Intersection" means the area embraced within
the prolongation or connection of the lateral curblines, or,
if none, then the lateral boundary lines of two or more highways
that join one another at an angle, whether or not one highway
crosses the other.
1. 04
"Motor vehicle" includes an automobile, motorcycle,
motor assisted bicycle and any other vehicle propelled or driven
otherwise than by muscular power.
1. 05
"Park" or "Parking" when prohibited, means the
standing of a vehicle, whether occupied or not, except when
standing temporarily for the purpose of and while actually engaged
in loading or unloading merchandise or passengers.

"Person" shall mean and include an individual,
firm, partnership, corporation or limited company.

"Traffic Control
Device"
means any
sign,
or
roadway, curb or sidewalk marking, or other device erected or
placed under the authority of the Townsh p Council for the purpose
of guiding or directing traffic.
2.
OBEDIENCE TO TRAFFIC REGULATIONS
2.01
En~orcement of By-Laws
The Municipal By-Law Enforcement Officer appointed
by the Council of the Corporation of the Township of Oro shall
enforce the provisions of this By-law.
2.02
O~edience to Traffic Signs and Signals
Every person on any highway shal1 promptly obey
any signals given either by a Traffic Control Device or by a
Municipal By-Law Enforcement Officer, and shall, where applicable,
comply with the requirements of every traff c sign.
3.
PARKING
3.01
Method of Parking
No vehicle shall be parked or stopped on any
street unless on the right side of the street having regard

to the direction in which the vehicle had been proceeding, with
the right front and right rear wheels and runners not more than
0.15 meters from the curb or boundary of the roadway, as near
this as the condition of the streets permit.
4.
PARKING PROHIBITED IN SPECIFIED PLACES
4.01
No person shall park a vehicle in

a) on or over a sidewalk
b) on a boulevard
c) within an intersection
d) within a designated pedestrian crossover
e) within 3 meters of a fire hydrant
f) within 15 meters of any railway track, which is on or adjacent
to a roadway
g) within 9 meters of an intersection
h) in front of, or within 1.5 meters of the entrance to a public
lane or private driveway, or so as to prevent ingress or
egress to or from such lane or driveway
i) on any bridge or in any subway or wi thin 100 meters of a
bridge over, under or across which the highway passes
j) on any street in such manner as to obstruct traffic
k) in such position as will prevent the convenient removal
of any other vehicle previously parked
1) in front of the main entrance to or any emergency exit from
any theatre, hotel, auditorium or other building
m) in front of any hotel
n) on private property without authority from the owner or
occupant thereof
0) on property of the Corporation of the Township of Ora where
such parking is unauthorized
4.02
No Parking in Specified Places Where Signs on
Display
Where appropriate signs have been erected and
are on display, no person shall at any time park a vehicle on
any of the streets, parts of streets, or sides of streets named
or described in Schedule "A" to this By-law, during the periods
set out in Column 4 of the said Schedule.

4.03
Parking Prohibited Where Obstructing Winter Road
t-1aintenance
No person shall park or leave standing a vehicle
whether attended or unattended on a highway in such manner as
to interfere with the clearing of snow from any highway, or
interfere wi th the sanding or other winter maintenance of any
highway.
4.04
Temporary No Parking Signs
The By-Law Enforcement Officer is authorized
and directed to erect or place at his discretion temporary "No
Parking" signs on any highway used by the general public for
the passage of vehicles.
Temporary changes indicated by the
erection of such signs shall not be effective after the next
Council meeting, unless confirmed by resolution of Council at
such meeting, which resolution shall stipulate the length of
time such changes shall be in effect.
\Vi thout limiting the generality of the foregoing,
such signs shall be erected in the event of fire, or parades,
or while large assemblies are in an auditorium or otherwise,
for a reasonable period of time immediately preceding and
following such assemblies, provided however, that such "No
Parking" signs shall be erected one hour or more before such
parades or assemblies.
4. 05
Repairing of Vehicles
No person shall use any street for repairing,
servicing or painting of vehicles.
5.
BY-LAW JURISDICTION
This by-law shall apply to those roads and highways
under the jurisdiction of the Corporation of the Township of
Oro, and those roads and highways situate within the said Township
of Oro over which the County of Simcoe has jurisdiction.

6.
WILLFUL DAMAGE TO SIGNS OR SIGN^LS
6.01
No person shall without lawful authority attempt
to or in fact alter, deface, injure, knock down or remove any
official traffic control device or sign or insignia thereon
or any part thereof.
6.02
No person shall erect any traffic sign or signal
in the Township of Oro, except on the authority of Council.
6.03
No person shall place, maintain, or display upon
or in view of any highway, any s1'gn, ' 1 k'
s1gna , mar 1ng or device
which purports to be or is an imitation or resembles a prescribed
traffic sign or signal or which conceals from view or interferes
with the effectiveness of a prescribed traffic sign or signal.
7.
PEN^LTIES
7.01
Towing of Vehicles
Where the By-Law Enforcement Officer discovers
any vehicle parked or left in contravention of this by-law,
he may, in addition to imposing any other penalty contained
in this by-law, cause the said vehicle to be removed or taken
to, or placed and stored in a suitable place, and all costs
and charges for removing, care and storage thereof shall be
payable by the owner of the said vehicle, and shall be a lien
upon the vehicle which may be enforced in the manner provided
by Section 52 of the Mechanics' Lien Act.
7.02
Voluntary Payment of Penalties
\vhere a vehicle is found parked in contravention
of this by-law the Municipal By-Law Enforcement Officer shall
attach to the vehicle, or give to the person driving the vehicle
a parking infraction notice in the form of a serially numbered
notice, stating:
i) the licence number and concise description
of the vehicle;
ii) that the vehicle has violated the provisions
of this by-law;

iii) the date, time, place and nature of the
alleged offence
iv) that the owner or operator may report to
the municipal office of the Township of
Oro within 15 days after the date when
the ticket was attached or given, to make
a voluntary payment of the penalty in the
amount stipulated for the said offence;
v) that in the event of failure to so report
and make such payment, a summons will be
issued under the provisions of the Provincial
Offences Act.
7.03
General Penalty Provision
Every person who violates any provision of this
by-law is, upon conviction, guilty of an offence and shall be
liable to a fine of not more that $50.00, exclusive of costs.
8.
ONTARIO HIGHWAY TRAFFIC ACT TO GOVERN
8.01
The provisions of this by-law shall be subject
to the provisions of the Highway Traffic Act and amendments
thereto.
9.
BY-LAWS REPEALED
9.01
By-law No. 1147, 1152, 88-11, 89-14 and all by-laws
amending same be and are hereby repealed.
