Call to Order - Reading of Land Acknowledgement: The Township of Oro-Medonte acknowledges that we are situated on the traditional land of the Anishnaabek (A- nish- in- aa- beh) people, and ancestral territory of the Huron-Wendat. The Anishnaabek include the Odawa [Oh-DAH-wah], Ojibwe [O-jib-we] and Pottawatomi [boh-tah-WAH-toh-mee] nations, collectively known as the Three Fires Confederacy. Lowering Speed Limits in School Zones: A Crucial Step for Oro-Medonte's Safety and Well-being With the excellent recent report by your staff- Karla Musso Garcia on the implementation of more community safety zones in our township presented to you on August 14, as well as the recent letter to council from the SCDSB regarding improving safety in front of schools, I believe that all members of council now have the perfect opportunity to address the pressing issue that affects the safety of our children—speeding in school zones. I am here today to ask council members to revisit the speed limits in front of schools on our township roads and help advocate to lower the speed limit in school zones in the County of Simcoe. Some services are required by legislation to be delivered within the Municipality as an example this would include core functions of Conservation Authorities. Other services are provided at the Township's discretion either through specific service level agreement or at arm's length. How that delivery occurs remains the discretion of the Municipality. The Township currently operates within a two-year budget and planning cycle. Draft budgets are a presented to Council for consideration and approval every two years with budget recalibration presented to Council for adoption in the second year of the two- year cycle. During the 2024 recalibration process, through Council's due diligence process and a desire for transparency, a series of questions were posed regarding the delivery of non- legislated services by third party non-profit or not-for-profit organizations. These questions triggered additional information requests and submissions post the budget approval process. In an effort to streamline the documentation, review and subsequent adoption of the annual budget, staff have developed an application process and policy specific to these situations which would better enable Council to review the cost/benefit of these services and determine any other structures such as agreements etc. that it may deem appropriate. Analysis In the development of this policy, staff reviewed the Township's grants' policy, researched other municipalities' policies and also considered the application processes and requirements for upper tier contribution/grant processes. Staff also consulted with organizations who currently would be directly impacted by the passing of this policy and establishment of this process. The draft policy— POL-FIN-12 is appended to this report (Appendix A: Draft Financial Contributions — External Organizations Policy) and consists of four sections, with the process and eligibility included as section 4. This proposed policy would apply to those non-profit or not-for profit organizations who deliver non-legislated services as an extension of existing services delivered by the Township where alignment with Council endorsed Strategic and/or Master Plans can be demonstrated. The required documentation includes: - Previous fiscal year end financial statements prepared in accordance with relevant legislation; - Statement of proposed services to be delivered with anticipated outcomes for the upcoming year; - If funding had been received in the current year, a summary of results against forecasted outcomes; - Copies of corporate by-laws, articles of incorporation, terms of reference as applicate; - Application signed by an individual with signing authority affirming that the information provided is accurate and that the organization is compliant with relevant applicable legislation. Purpose The Township of Oro-Medonte delivers a variety of services to its residents and businesses. Many of these services are delivered on an ongoing basis with internal resources. Some of these services are legislated by upper tiers of government, others are discretionary in nature. To realize efficiencies while capitalizing on expertise, the Township may choose to partner with external non-profit or not-for-profit organizations who share both geographic responsibility and service mandates. These organizations who deliver these service independently from, but aligned to the Township, look to the Municipality for a financial contribution for the delivery of these services on behalf of Township residents and businesses as part of the municipal budgeting process. The Township has a responsibility to ensure that delivery entrusted to third party organizations is managed and monitored in a fashion that ensure its financial investment and interests and is done so in an open, transparent and consistent fashion which enables accountability in realizing benefits. This policy directly aligns to the Township's Strategic Plan and specifically the Financial Sustainability priority. 2. Applications to finance an organization's deficits or financial shortfalls. Applications that do not adequately demonstrate what service is/will be provided to Oro-Medonte residents and/or businesses. Terms and Conditions • The applicant organization, within the current year, must spend Township funding on the sole purpose for which it granted. • The recipient shall repay the whole or any part of the Township's funding contribution, as determined by the Township, if the recipient: - Ceases operations; - Ceases to operate as a non-profit or not for profit organization; - Has knowingly provided false information in its application; - Uses funds for purposes not approved by Council; or - Breaches any of these terms and conditions. • Funding will not be provided for accumulated deficits or funding shortfalls of any organization. • The term of funding shall be limited to one year unless Council has endorsed a multi-year commitment. • Renewals are not automatic. The Application Form is attached to this policy as Appendix A and includes a signed acknowledgement of being in Good Standing with all relevant legislation such as ONCA. Supporting documentation must include: • the organization's current Strategic Plan; • details of services/activities/outcomes provided on behalf of the Township's residents and/or businesses for the previous year (if financial support was provided); • details of proposed services/activities/anticipated outcomes for the coming year in support of funding request; • the organization's financial statements for the previous fiscal year as approved by the organization's Board of Directors and; • Articles of Incorporation & current By-laws/Terms of Reference. Upon receipt by the Clerk's office, application forms and documentation will be forwarded to the appropriate Township department for confirmation of completeness and clarity. Should the form and documentation be incomplete or unclear, the appropriate Township department staff will advise the applicant. Depending upon the issue, applicants may be permitted and/or requested to augment/modify their submissions. Incomplete or unclear applications and presentations may be rejected. Completed forms and documentation will be considered in the preparation of the next operating budget. Applicants, whose financial contribution request is >$10,000.00 will be invited to present the results of the previous years' service delivery, the proposed service delivery for the upcoming year, their financial position and address any questions from Council during a scheduled Council meeting. Council meetings may be livestreamed for public viewing and transparency. It should be noted that all materials submitted may form part of a public Council agenda and/or form part of the public record. Additional terms and conditions may be established by Council at the time of adopting the Township's operating budget. Background Council, pursuant to the By-law to Establish and Regulate a Fire Department, authorizes Oro-Medonte Fire & Emergency Services (OMFES) to provide services for Motor Vehicle Collisions (MVC) and Extrication. Specialized equipment and tools are required to conduct these services. These specialized sets of tools consist of a hydraulically operated spreader, cutter, and ram. Each tool conducts specific functions in an emergency situation when extricating a person(s) from a vehicle or machinery and specifically, are used to make access to trapped patients and/or manipulate obstacles that are preventing their removal. OMFES has three sets of battery-operated extrication tools and two sets of 20+ year old gasoline-driven extrication tools. The extrication equipment is strategically located throughout Oro-Medonte's five fire stations, to provide timely and efficient services to the residents and visitors of Oro-Medonte. Recently, the TNT extrication cutters housed on Rescue 3 at Station 3 (Headquarters) had a failure and were taken out of service. Analysis OMFES responded to 118 MVCs in 2023 and 84 so far in 2024. The recent failure of the TNT extrication cutters has left one of the two heavy rescue trucks in the municipality without the ability to perform one of our primary functions of extrication. The missing cutters directly impact the overall service delivery/safety available to our residents and visitors as they travel to and through our area. The tools in question are relied on to deal with emergency incidents throughout the west side of the municipality. A cost/service analysis was completed on repairing the damaged cutters. Staff did receive a repair quote ranging from $8,000415,000 depending on the issue, combined with a minimal repair quote of $1,500 on the broken cutters. In addition to the out-of-service cutters, there were several other issues that needed to be addressed. Many of the hydraulic lines that are connected to the cutters and other extrication tools are leaking and need to be repaired or replaced. The biggest issue with this set of extrication tools is the onboard generator located on Rescue 3 that drives these tools has stopped working. Additionally, this set of extrication tools is over 20 years old, taking them well past their service life and moreover, have fallen off the technology curve. For these reasons, staff advanced their replacement with a set of battery-operated tools that meet today's demands. Staff are informing Council of the purchase in accordance with the Township's purchasing By-law. Financial/Legal Implications/ Risk Management Pursuant to By-Law 2004-112, Purchasing and Tendering Procedures, an emergency means an event which occurs that requires immediate repair or replacement of equipment, services, or facilities in order to maintain a required public service or to prevent danger of life, limb, or property. The cost to replace the extrication tools was $56, 683. The replacement of the tools was not included in the approved capital budget and will be funded from the Township's reserves. By-law on October 23, 2019. In accordance with the Development Charges Act, 1997, the Township initiated the process of updating its D.C. By-law in 2023 and awarded the completion of the required Background Study to Watson & Associates Economists Ltd. Work commenced in June 2023 and has extended throughout 2024. Presentations were made to Council in January and August 2024. The required Public Meeting was established for September 11, 2024 and the notice was posted on the Township's website and circulated on August 21, 2024. By-law. The Public Meeting was held as advertised on September 11, 2024. No comments were received in advance of this meeting and no comments were received during the public meeting. Analysis As noted in the report presented on September 4, 2024, staff committed to report back to Council following the September 11, 2024 public meeting. No comments, questions or concerns have been raised as of October 1, 2024. As such, no changes will be made to the draft D. C. By-law as presented to Council at the August 14, 2024 Council Meeting and at the September 4, 2024 Development Services Meeting. The draft D.C. The By-law was updated to ensure consistency in language, titles, and intent. Additionally, the previous By-law limited the scope of intent by using the terminology "Machinery or Equipment" (excluding farming equipment). However, applicants were submitting applications for items such as pre-built homes, fibreglass pools, or construction materials, which were not covered under the existing By-law. The new proposed By-law has general applicability through the use of the "over-dimensional load" terminology, which encompasses height, width, length, and weight and continues to provide exemption to farming equipment and machinery. The previous By-law also had an embedded application form, requiring an update to the By-law to perform administrative updates to the application form. The purpose of this By-law is to update the By-Law title and terminology process before the 2025 permit period and to reference other applicable By-laws. During one of the routine sampling events on Bass Lake, staff identified a potential Blue-Green Algae Bloom on the North-side of the lake. Samples were submitted to MECP on June 20th and on June 28th, the MECP as well as the Health Unit confirmed the presence of toxic Blue-Green Algae. The municipality was notified and public signage was put up as well as notification on the SMDHU web site https://www.simcoemuskokahealth.org/Topics/Safe Water/bluegreenalgae copy1.aspx Permanent signage has been installed by the Township of Oro-Medonte, on behalf of the Health Unit, at public access points to Bass Lake, addressing the blue-qreen algae bloom. PWQMN (Provincial Water Quality Monitoring Network) Conducted three sampling runs at 12 sites throughout the " - watershed, collectingchemistry samples and corresponding Y p field data such as temperature, dissolved oxygen, conductivity, pH and turbidity. Stream Temperature 51 stream temperature loggers have been placed in streams across the watershed. The data is used to model thermal stability. Thermal stability is a classification to determine if a stream is cold, cool, or warm. Each class provides a unique habitat for temperature dependent species such as the coldwater spawning trout and salmon. SSEA staff continue with the 'intensive' thermal stability study conducted on portions of the Coldwater River subwatershed. This involves visiting all drainage areas and receiving waters to update drainage mapping. This multi-year project will provide background data and determine temperature classifications through modeling of all stream reaches, and helps to better understand where to focus future monitoring and stewardship efforts. Stream Benthic Invertebrates Staff have been sorting through bulk preserved samples to collect all benthic invertebrate specimens. Identified five benthic invertebrate samples from the Sturgeon River watershed, within the Township of Oro-Medonte and Township of Springwater. Climate Monitoring - Rain and Air Gauges Staff have installed four rain and one air temperature gauge. The data collected provides additional background information for monitoring projects in the Severn Sound and Township of Tiny Coastal Area, putting monitoring results into context. Weather Stations The Town of Midland and Township of Tiny (Lafontaine) weather stations have been checked regularly using the online portal. Regular data downloads are being completed on a monthly basis along with monthly rainfall updates. Meetings with municipal staff have generated lots of ideas and discussion on next steps and current funding opportunities to advance action items. The Township of Springwater is working with SSEA on developing their Local Climate Change Action Plan in 2024. To generate engagement, SSEA and the Township hosted public information sessions May 30th in Elmvale and July 11th at the Township hall in Midhurst. A community survey was launched to generate direct input from residents on the development of the plan. An email was sent to council to clarify and express disappointment regarding recent conversations at the council meeting, given the Library's ongoing collaboration with city staff. First, this petition should dispel the myth that only a handful of people are opposed to the connection fee. Opposition in our community is very strong, ongoing and widespread. I expect that opposition is equally strong in all Zone 1 developments. Just to clarify,while we are opposed to the fee,we are very supportive of the objective. Please be assured that the Oro-Medonte Property Owners' Association (OMPOA) and all those it represents, remains ready and willing to meet with the Township to negotiate a settlement of the Zone 1 water fee issue. We believe that a negotiated settlement is a much preferable outcome to this ongoing problem. Judging from the content of KPMG's August 1, 2024 report to Council, as delivered at the August 14tn Council meeting, it appears that KPMG is unaware that under section 7 of the Water Rights Guarantee Agreement, Horseshoe Resort/Freed may make changes to the Zone 1 water system, but, it must do so at its expense. The Corporation of The Township of Oro-Medonte By-Law No. 2024-105 Being a "By-Law to Require the Issuance of a Permit for Over Dimensional Loads" and to repeal By-Law 2009-009 Whereas Section 110 of the Highway Traffic Act, R.S.O. 1990, c. H.8, as amended, authorizes municipalities to grant a permit for use of a highway by vehicles in excess of the dimensional limits or weight limits identified in the Act; And Whereas the Municipal Act2002, S.O. 2001, c.25, as amended, Section 11, provides that municipalities may pass by-laws within the sphere of jurisdiction with respect to traffic on highways; And Whereas the Council of the Township of Oro-Medonte has enacted a By-law to provide for the imposition of fees or charges; And Whereas the Council of The Township of Oro-Medonte deems it necessary and desirable to pass a by-law requiring the issuance of a Permit for Over Dimensional Loads upon road allowances within the Township of Oro-Medonte; Now Therefore the Council of The Corporation of The Township of Oro-Medonte hereby enacts as follows: 1. DEFINITIONS a) "Over Dimensional Load"shall mean any combination of vehicle and load having a width, length, height, or weight in excess of the limits provided for in the Highway Traffic Act; 2. That every person with an Over Dimensional Load within the Township of Oro- Medonte road allowances, shall obtain an annual or single use/daily permit; 3. That notwithstanding Section 2 above, all farm equipment or machinery, and machinery or equipment used by contractors while in the employ of the Township of Oro-Medonte, are exempt from this by-law; 4. That should damages occur during the mobilization of Over Dimensional Loads within the Township of Oro-Medonte road allowances, the permit holder shall reinstate the Township's road allowance to its original state. Failure of the permit holder to comply with the required restorative works will result in the Township of Oro-Medonte performing the restoration work and the permit holder shall be invoiced for all costs absorbed by the Township. 5. That the permit holder shall be responsible for the regulation of traffic control; 6. That the permit holder shall be responsible for all overhead utility lines and make necessary arrangements for utility awareness and assistance; 7. That the permit holder shall arrange for a police escort, if required; 8. That the permit holder shall provide proof of liability insurance ($5,000,000 minimum) that shows the Township of Oro-Medonte as additional insured and a copy of the Commercial Vehicle Operator's Registration (C.V.O.R.), prior to the permit being issued;The permit holder is responsible for providing both an updated certificate of insurance and CVOR registration upon expiry, failure to provide updated certificates will deem the permit void upon expiry of insurance or CVOR registration. That the permit holder understands that he/she/they are fully responsible for any claims for any accident or damage that may arise against the Corporation of the Township of Oro-Medonte,due to the Over Dimensional Load occupying Township roadways while mobilization activities are being performed; 10. That during load restriction periods, special permission must be obtained to mobilize loads greater than five (5)tonnes per axle on Township of Oro-Medonte road allowances; 11. That the permit issued is not valid from one half hour after sunset to one half hour before sunrise or at any other time when, due to insufficient light or unfavourable atmosphere or conditions, persons and vehicles are not clearly discernible at a distance of one hundred and fifty(150)metres or less; 12. That every annual permit issued pursuant to this by-law shall expire on the 31s' day of December in the year in which it was issued. Every single use/daily permit issued pursuant to this by-law shall expire one half hour after sunset of the day the permit was issued; 13. That the permit fee shall be paid to the Corporation of the Township of Oro- Medonte at the time of issuance of the permit, and shall be as approved in the updated Fees and Charges By-law; 14. That Council for the Township of Oro-Medonte does hereby authorize the Director of Operations and Community Services or designate to issue single use/daily and annual Over Dimensional Load Permits; 15. That every person who contravenes any provision of this by-law is guilty of an offence and shall be liable to a fine in an amount to be determined pursuant to the Provincial Offences Act, R.S.O. 1990, c. P.33, as amended, and every such fine is recoverable under the Provincial Offences Act; 16. That By-law No. 2009-009 is hereby repealed in its entirety; 17.
