THE CORPORATION OF THE TOWNSHIP OF ORO
BY-LAW NO. 90-21
Being a By-law to Appoint a By-Law Enforcement Officer

WHEREAS the Municipal Act, R.S.O. 1980, Section 208(45), as amended,
provides that a Council of a Municipality may by By-Law appoint such
officers and servants as may be necessary for the purposes of the
Corporation;
AND WHEREAS the Solicitor General for the Province of Ontario has, in
writing, designated all employees of municipalities whose duties include
the enforcement of municipal by-laws, as Provincial Offences Officers
for the purposes of all by-law offences, pursuant to Section 1,
Subsection 2 of the Provincial Offences Act, R.S.O. 1980, Chapter 400
as amended;
AND WHEREAS Ron Kolbe was appointed Acting Chief Building Official
for the Corporation of the Township of Oro by By-Law No. 89-42, passed
by Council for the Corporation on the 5th day of June, 1989;
AND WHEREAS Council for the Corporation of the Township of Oro deem it
necessary to appoint the Chief Building Official as a Provincial Offences
Officer for the purposes of by-law offences;
NOW THEREFORE the Council the Corporation of the Township of Oro hereby
enacts as follows:
1. THAT Ron Kolbe is appointed By-law Enforcement Officer for the
Corporation of the Township of Oro.
2. THAT the By-law Enforcement Officer is charged with the duty and
responsibility of enforcement of all By-laws of the Corporation
of the Township of Oro.
3. THAT the By-law Enforcement Officer, pursuant to the designation
in writing by the Solicitor General for the Province of Ontario
is appointed as a Provincial Offences Officer for the following
purposes:
(a) all municipal by-law offences; and
(b) all offences under the Building Code Act and the
regulations thereunder; and
(c) all offences under the Dog Licensing and Livestock
and Poultry Act; and
(d) offences under Section 44 of the Ontario Water
Resources Act and regulations made under the
authority of the said section; and
(e) all offences under the Public Health Act and the
regulations thereunder; and
(f) all offences under the Plant Diseases Act and the
regulations thereunder; and
(g) all offences under the Weed Control Act and the
regulations thereunder.

4. THAT the duties and responsibilities of the By-law Enforcement
Officer commence on the date of the passage of this By-law and
continue during the pleasure of Council.
5. THAT the hours and terms of work and the remuneration of the
By-Law Enforcement Officer so appointed shall be fixed by Council.
6. THAT in the event of a conflict between this and any other preceding
By-law with respect to the appointment, duties and responsibilities
of any individual relating to the enforcement of By-laws for
the purposes of By-law offences, the provisions of this By-law
shall prevail, and all preceding By-laws are hereby deemed to be
amended, in so far as necessary to give effect to the provisions
of this By'law.
It is understood that the municipality may have more than one
By-law Enforcement Officer appointed at anyone time and it is
not the intention of this By-law to replace existing Enforcement
Officers, duly appointed by by-law.
7. By-law No. 86-63 is hereby repealed.
