THE CORPORATION OF THE TOWNSHIP OF ORO BY-LAW NO. 90-101 Being a By-Law to Close, Sell and convey Part of the Road Allowance between Concessions 6 and 7 and Part of Lots 2 and 3, concession 7, in the Township of Oro and being Parts 2, 3, 4, 5, 6, 7, 8, 9, 10 & 11 on a Reference Plan deposited in the Registry Office for the County of simcoe as No. 51R-20018. WHEREAS The Municipal Act, R.S.O. 1980, section 298 as amended provides that by-laws may be passed by Councils of local municipalities to stop up and close any part of a highway and to sell and convey a stopped up and closed highway; AND WHEREAS pursuant to the Municipal Act, notice of this by-law to stop up, close and sell the lands described herein has been posted and published; AND WHEREAS the Council of the Corporation of the Township of Oro deems it advisable to exercise this authority pursuant to section 298 of The Municipal Act; NOW THEREFORE the Council for corporation of the Township of Oro hereby enacts as follows: 1. That the part of the Road Allowance between Concessions 6 and 7 and part of Lots 2 and 3, Concession 7, in the Township of Oro, and being Parts 2, 3, 4, 5, 6, 7, 8, 9, 10 and lIon a Reference Plan deposited in the Registry Office for the County of Simcoe as No. 51R-20018 be and are hereby stopped up and closed. 2. That the Corporation of the Township of Oro do sell and convey the aforesaid described lands to the owners abutting or as it may direct. 3. That the Reeve and the Administrator/Clerk of the Township of Oro be and are hereby authorized, directed and empowered to do all things necessary to complete the sale and conveyance of the said lands and are hereby authorized to execute such conveyances as are necessary to carry out the provisions of this by-law on behalf of the Corporation of the Township of Oro. 4. That attached to this by-law as Schedule "A" is an Affidavit of Robert W. Small, Administrator/Clerk of the Township of Oro setting out the particulars of publication and posting of the said Notice pursuant to [I the provisions of The Municipal Act and reciting the persons who appeared before the Council. A F F I D A V I T I, Robert W. Small, of the city of Barrie, in the County of Simcoe make oath and say as follows: 1. I am the Administrator/Clerk for the Corporation of the Township of Oro and as such have knowledge of the matters hereinafter deposed to. 2. Notice of Road Closing pursuant to section 301 of the Municipal Act, R.S.O. 1980, as amended was given by publishing the "Notice" attached to this my affidavit as Exhibit "A" in two local newspapers, the Examiner and the Packet once a week for four consecutive weeks from Monday June 4, 1990 to Monday June 25, 1990 inclusive. 3. I did also cause to be posted a copy of the Notice attached as Exhibit "A" to this my affidavit in six of the most public places in the immediate neighbourhood of the subject roadway for a period of greater than one month pursuant to section 301 of the Municipal Act, R.S.O. 1980 as amended. 4. Notice was given to the County of Simcoe pursuant to section 298(7) on the 24th day of May by registered mail and no objection to the proposed by-law was filed within the sixty day period following notice being given. , 1 . e " 5. That the proposed by-law came before Council of the Corporation of the Township of Oro for consideration at a meeting held on the 7th day of August, 1990 and at that time the following persons appeared before Council for the corporation: No one. Sworn before me this day of August, 1990. /~~ Robert w.~ OF THE TOWNSHIP OF ORO ROAD CLOSING e PUBLIC NOTICE TAKB NOTICB that the Council of the corporation of the Township of Oro proposes to enact a by-law to stop up, close and convey Part of the Road Allowance between Concessions 6 and 7 and part of Lots 2 and 3, concession 7, in the Township of Oro and being Parts 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11 on a Reference Plan deposited in the Registry Office for the County of Simcoe as No. 51R-20018. AND FURTHER TAKB NOTICB that the council of the corporation of the Township of Oro will, after the publication of this notice at least once a week for four successive weeks, in the Barrie Examiner and the Orillia Packet, at a meeting to be held at the council Chambers in the Administration centre, Oro station at the hour of 7:00 o'clock in the evening on the 7th day of August, 1990, consider and if deemed expedient pass a by-law to stop-up, close and convey Parts 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11, Reference Plan 51R-20018. AND FURTHER TAKB NOTICB that any person who claims that his land will be prejudicially affected by the said by-law and who desires to be heard, shall be heard by the Council of the corporation of the Township of Oro, either in person or by counsel, agent or solicitor. AND FURTHER TAKB NOTICB that any person interested may see a plan of that part of the public highway to be closed in the office of the Administrator/Clerk, Township Offices, in the Administration Centre during regular office hours.
