II II I I II II I; II II II II II I' Ii I, Iq I II 'i I' I I I I I I I BY-LAW NO. 90-121 Being a By-Law to Close, Sell and convey a Portion of .the Road Allowance between the 6th and 7th Concessions more particularly described as Parts 2, 3, 4, 5, 6 and 7 on Reference Plan 51R-21234. WHEREAS The Municipal Act, R.S.O. 1980, section 298 as amended provides that by-laws may be passed by Councils of local municipalities to stop up and close any part of a highway and to sell and convey a stopped up and closed highway; AND WHEREAS pursuant to the Municipal Act, notice of this by-law to stop up, close and sell the lands described herein has been posted and published; AND WHEREAS the Council of the Corporation of the Township of Oro deems it advisable to exercise the authority pursuant to section 298 of The Municipal Act; NOW THEREFORE the Council for the Corporation of the Township of Oro hereby enacts as follows: 1. That a portion of the original Road Allowance between the 6th and 7th Concessions of the Township of Oro , being Parts 2, 3, 4, 5, 6 and 7 on Reference Plan 51R-21234 be and is hereby stopped up and closed. 2. That the Corporation of the Township of Oro sell and convey the aforesaid described lands for the purposes of the operation of a municipal airport. 3. That the Reeve and Administrator/Clerk are hereby authorized, directed and empowered to do all things necessary to complete the sale and conveyance of the said lands and are hereby authorized to execute such conveyances as are necessary to carry out the provisions of this by-law on behalf of the Corporation of the Township of Oro. 4. That attached to this by-law as Schedule "A" is the Affidavit of Robert W. Small, Administrator/Clerk of the Township of Oro setting out the particulars of publication and posting of the said Notice pursuant to the provisions of the Municipal Act and reciting the persons who appeared before the Council. A F F I D A V I T e In the Matter of A By-law to stop up, Close and Convey a portion of the Original Road Allowance between Concessions 6 and 7, more particularly described as Parts 2, 3, 4, 5, 6, and 7 on Reference Plan 51R-21234. I, Robert W. Small, of the City of Barrie, in the County of Simcoe make oath and say as follows: 1. I am the Administrator/Clerk for the Corporation of the Township of Oro and as such have knowledge of the matters hereinafter deposed to. 2. Notice of the Road Closing pursuant to section 301 of the Municipal Act, R. S. O. 1980, as amended was given by publishing the "Notice" attached to this my affidavit as Exhibit "A" in two local newspapers, the Examiner and the Packet & Times once a week for four consecutive weeks from September 10, 1990 to October 1, 1990. 3. I did also cause to be posted a copy of the Notice attached as Exhibit "A" to this my affidavit in six of the most public places in the immediate neighbourhood of the subject roadway for a period of greater than one month pursuant to section 301 of the Municipal Act, R.S.O. 1980 as amended. 4. Notice was given to the County of Simcoe pursuant to section 298(7) on the 24th day of August, 1990 by registered mail and no objection to the proposed by-law was filed within the sixty day period following noticie being given. 5. Any person who wanted to be heard by Council was invited to appear before them on the 5th day of November at 7:00 p.m. At that time the following objections were heard: Mr. Harry Hughes expressed concern over the level of service along the 6th line. Two cul-de-sacs will be constructed at the ends ot the closed road sections as illustrated in the sketch below. AND rUR'1'B1R TUI IOTIC. that the Council of the Corporation of the Township of Oro will, after the publication of this notice at least once a week for four successive weeks, in the Barrie Examiner and the Orillia Packet, at a meetinq to be held at the Council Chambers in the Administration Centre, Oro station at the hour of 7:00 p.m. on the 5th day of November, 1990, consider and if deemed expedient pass a by-law to stop-up, close and convey Parts 2, 3, 4, 5, 6 and 7 on Reference Plan 51R-21234.
