THE CORPORATION OF THE TOWNSHIP OF ORO
BY-LAW NO. 91- 18
Being a By-law of the corporation of the
Township of Oro to prohibit the obstructing,
encumbering or fouling of highways or bridges within
the boundaries of the corporation of the Township of Oro.
WHEREAS it is provided by Subsection 315(1) of The Municipal Act,
R.S.O. 1980, Chapter 302, that the Councils of all Municipalities
may pass by-laws to prohibit the obstructing, encumbering or
fouling of highways or bridges;
NOW THEREFORE the Council of the Corporation of the Township of
Oro enacts as follows:
1. Definitions
i) "Highway" means a common or public highway, and
includes a street and a bridge forming part of a
highway or on, over or across which a highway passes.
ii) "Obstruction" means, but is not limited to: fill;
gravel; construction material; excavation materials,
piling or shoring; snow; ice; refuse or barriers.
2. Scope
The provisions of this By-law shall apply to all highways
within the Corporation of the Township of Oro.
3. Obstructions and Encumbrances
i) No person shall obstruct or foul any highway under the
jurisdiction of the Township by any means whatsoever.
ii) without limiting the generality of the subsection i),
the obstruction or fouling of a highway includes:
a) the building or maintaining of a fence on a
highway;
b) depositing of snow or ice on a highway, and
c) the depositing of large refuse containers or bulk
containers on a highway.
4. Approval from the Administrator of Public Services
No person shall place or maintain any obstruction or
encumbrance, whether permanent or temporary, on any highway
without prior written approval from the Administrator of
Public Services.

5. Enforcement
i)
Every person who contravenes any of the provisions of
this By-law is guilty of an offence and upon
conviction, is liable to a fine not exceeding the sum
of TWO THOUSAND DOLLARS ($2,000.00), exclusive of
costs, for each offence, recoverable under The
Municipal Act and The Provincial Offences Act for the
Province of ontario.
6. Repeal of By-Law No. 1148
By-Law #1148, and amendments thereto are hereby repealed.
7. Effective Date
This By-law shall come into effect on the day of its final
passing.

READ a third time and finally passed this 4th day of March, 1991.
