I i Ii I II 1'1 I II II II II \ I II - I I ~ THE CORPORATION OF THE TOWNSHIP OF ORO BY-LAW NO. 92- 56 Being a By-law to Amend By-law No. 91-71; a By-law of the corporation of the Township of Oro to provide for the numbering of buildings along highways and streets, and the keeping of a record of such highways and streets and the numbers allocated to buildings thereon. WHEREAS Council for the Corporation of the Township of Oro duly passed By-Law No. 91-71 on the 17th day of September 1991; AND WHEREAS section 210(106) of The Municipal Act, being R.S.O. 1980 c.302, provides that by-laws may be passed for numbering the buildings and lots along any highway, beach, park, reserve or any other property in the municipality that is considered necessary to number by the Council, and for affixing numbers to the buildings and for charging the owner or occupant with the expenses incident to the numbering of the lot or property, and WHEREAS it is further provided by the paragraph 21(106) (a) that such expense may be collected in the same manner as taxes; and if paid by the occupant, subject to any agreement between him and the owner, may be deducted from the rent payable to the owner; and WHEREAS subsection 210(107) of the Municipal Act, R.S.O. 1980, Chapter 302, provides that by-laws may be passed for the keeping of a record by Council, of the highways, beaches, parks, reserves and of the numbers of the buildings, lots, and other propertYi and for entering therein, a division of the streets with bQundaries with distances, for public inspection; and AND WHEREAS Council deems it advisable and expedient to amend By- law 91-71; NOW THEREFORE Council for the Corporation of the Township of Oro hereby enacts as follows: 1. THAT Section 9 shall be deleted in it's entirety and shall be replaced with the following: Every number affixed to a building or premise shall be of sufficient size and located in a manner, so as to be clearly legible from the street. The minimum size for every number shall be four (4) inches in height and shall be three quarters (3/4) of an inch in width and shall be luminous in nature. 2. THAT this By-law shall come into force and take effect on the final passing thereof. BY-LAW READ A FIRST AND SECOND TIME THIS 17TH DAY OF JUNE 1992. The Township Planner is authorized to assign to any building along any street the number appearing in the Municipal Addressing System for the Township of Oro as the proper number for such building. 5. Whenever a new building is erected along any street, the Township Planner shall assign a number to each new principal building erected along any street. 6. Every owner or occupant of a building for which an official street number has been assigned shall, no later than thirty days from the date of notification of such assignment, or in the case of a new building before occupation, affix the official street number in a manner set out in this By-law. 7. Any official street number not affixed in accordance with section 6, may be affixed by the Chief Building Official or designate, and all expenses incurred in connection with the re-numbering of the building shall be collected in the same manner as taxes. 8. No person shall affix to any building or premises or, being the owner or occupant, shall allow to be affixed or to remain affixed thereto any number except that appearing in the Municipal Addressing System as the number of such building or premises. 9. Every number affixed to a building or premise shall be of sufficient size and located in a manner, so as to be clearly legible from the street. The minimum size for every number shall be five (5) inches in height and shall be three quarters (3/4) of an inch in width and shall be luminous in nature. 10. Whenever it becomes necessary to have the numbers changed on any street or portion of a street, the Township Planner shall report to Council and, if so directed by by-law, shall thereafter renumber the buildings along the said street or portion of the street and shall cause the owners of property on the said street or portion of the street to be notified and directed to remove the previous numbers and affix new numbers to the building. The Municipal Addressing System will be amended accordingly. 11. e 12. Should a Section or provision of this By-law be declared by a court of competent jurisdiction to be invalid, the same shall not effect the validity of the By-law as a whole or any part thereof, other than the Section or provision so declared to be invalid. Every person who violates any provision of this By-law, upon conviction, is guilty of an offence and shall be liable to a fine in an amount to be determined pursuant to the Provincial Offences Act, R.S.O. 1980, c. 400. , . - e 1 ~ I - 3 - 13. This By-law shall take effect and come into force on the date it is passed by Council. READ a FIRST and SECOND time this 17th day of September / 1991.
