J THE CORPORATION OF THE TOWNSHIP OF ORO BY-LAW NO. 93-44 Being a By-Law to Authorize the Amendment of Agreement Registered as Number 7534 Made with Scott silo Construction Limited WHEREAS a Notice of Agreement registered as number 7534 in the Office of Land Titles at Barrie (No. 51) was entered into between Scott silo Construction Limited and The corporation of the Township of Oro on lands including, inter alia, part of the West Half of Lot 10, Concession 12, designated as Part 2 on Reference Plan 51R-5857, now being part of parcel 10-1, in the Register for section 51-0ro-12: AND WHEREAS the Subdivision Agreement contemplated the subject lands being transferred to Lloyd Scott, the father of the subdivider; AND WHEREAS the said Lloyd Scott died on or about the 10th day of October, 1980; AND WHEREAS Council passed a resolution on or about the 10th day of March 1993, releasing this provision of the Subdivision Agreement: NOW THEREFORE the Council of The corporation of the Township of Oro hereby enacts as follows: 1. THAT the Corporation is hereby authorized to amend Agreement No. 7534 by deleting the following from the said agreement: "provided that Part 2, Plan 51R-58~1 shall be conveyed to Lloyd Scott, the present owner of the land described in Instrument No. 348546 in the deed of conveyance that Part 2 of the lands described in Instrument No. 348546 shall form one parcel of land and Part 2 shall not be conveyed and apart from the lands described in Instrument No. 348546. 2. THAT the Reeve and Clerk are hereby authorized to execute al documents necessary to give effect to this By-Law, and including the Agreement attached hereto and forming part of this By-Law as Schedule "A". 3. This By-Law shall come into full force and take effect on final passing thereof. THIS AGREEMENT made in duplicate the 26th day of February, 1993. BET WEE N SCOTT SILO CONSTRUCTION LIMITED, (hereinafter called the "Developer") OF THE FIRST PART - and - THE CORPORATION OF THE TOWNSHIP OF ORO, (he rei nafter called the "Muni ci pa 1 ity") OF THE SECOND PART WHEREAS the parties entered into an agreement with each other, which agreement was dated the 4th day of July, 1975; AND WHEREAS said agreement was attached to a Notice of Agreement, and registered in the Land Registry Office for the Land Titles Division of Simcoe (No: 51) on the 14th day of September, 1976 as instrument no: 7534 for the lands described as part of the west half of Lot 10, Concession 12, of the Township of Oro, in the County of Simcoe, designated as Parts 1 and 2, on a Plan of Survey of record in the Land Registry Office, Land Titles Division of Simcoe (No. 51) at Barrie as 51R-5857; NOW THEREFORE this Agreement Witnesseth that in consideration of the mutual covenants and agreements herein contained that the "Developer" and the "Municipality" hereby covenant and agree as follows: 1. That sai d agreement regi stered as instrument number 7534 be amended by deleting the following from the said agreement: "provided that Part 2, Plan 51R-5857 shall be conveyed to Lloyd Scott, the present owner of the land described in Instrument no: 348546 in the deed of conveyance that Part 2 of the lands descri bed in Instrument ho: 348546 shall form one parcel of land and part 2 shall not be conveyed separate and a part from the lands described in Instrument no: 348546." 2. That the above described lands have now been entered into the. Land Titles Registry System and are now described as follows: Part of Parcel 10-1, Section 5l-0ro-12, Township of Oro, County of Simcoe, being part of the west half of Lot 10, Concession 12, designated as Part 2, Plan 51R-5$67.
