2023-050 By-law to amend the zoning provisions which apply to lands at Part of Lots 11, 12, 13,18 and 19 and all of lots 20-28, 31-34 and part of Craig St, First St, Reg Plan 91 and Part of Lots 41/42 (2) The Corporation of the Township of Oro-Medonte By-Law No.2023-050 A By-law to amend the zoning provisions which apply to lands at Part of Lots 11, 12, 13, 18 and 19,and all of Lots 20, 21,22,23,24, 25, 26,27,28, 31,32, 33 and 34 and Part of Craig Street and Part of First Street, Registered Plan 91,and Part of Lots 41 and 42, Concession 1 E.P.R., and Part of the South Half of Lot 42, Concession 1, Geographic Township of Medonte, County of Simcoe 2022-ZBA-11 (Craighurst Limited Partnership) Whereas the Council of the Corporation of the Township of Oro-Medonte is empowered to pass By-laws to regulate the use of land pursuant to Sections 34 and 36 of the Planning Act, R.S.Q. 1990, c.P.13; And Whereas Council deems it appropriate to rezone the subject lands in accordance with Section C3.2 of the Official Plan. Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: 1. Schedule 'A14'to Zoning By-law 97-95, as amended, is hereby further amended by changing the zone symbol applying to the lands located in Part of Lots 11, 12, 13, 18 and 19, and all of Lots 20,21, 22, 23, 24, 25, 26, 27, 28, 31, 32, 33 and 34 and Part of Craig Street and Part of First Street, Registered Plan 91, and Part of Lots 41 and 42, Concession 1 E.P.R., and Part of the South Half of Lot 42, Concession 1, Geographic Township of Medonte, County of Simcoe, from Residential One Exception 301 (R1*301), Residential One Exception 301 - Holding 2 (R1*301(H2)), Institutional Exception 311 (1*311), Agricultural/Rural (A/RU), Agricultural/Rural Exception 15 (A/RU*15), Open Space-Holding 3 (OS(H3)) and Environmental Protection Exception 303(EP*303)to Residential One Exception 301 (R1*301), Residential One Exception 301 -Holding 2 (R1*301(H2)), Residential Two Exception 343(R2*343), Open Space Exception 311 -Holding 3(OS*311 (1-13)), Open Space Exception 311 and 344-Holding 3 (OS-311 &*344(H3))and Institutional Exception 345(1*345), as shown on Schedules"A", "B"and "C" attached and forming part of this By-law. 2. Section 7-Exceptions of Zoning By-law 97-95 as amended is hereby further amended by adding the following subsections: "7.343 *343-Part of Lots 11, 12, 13, 18 and 19, and all of Lots 20, 21, 22, 23, 24, 25, 26, 27, 28, 31, 32, 33 and 34 and Part of Craig Street and Part of First Street, Registered Plan 91, and Part of Lots 41 and 42, Concession 1 E.P.R., and Part of the South Half of Lot 42, Concession 1 (Medonte) Notwithstanding the provisions of Section 4.0, Table B1 Use Standards R2 Zone, the following provisions shall apply to semi-detached dwellings: a) Minimum Lot Area 235 square metres b) Minimum Lot Frontage 7.6 metres c) Minimum Front Yard Setback to Dwelling 4.5 metres d) Minimum Front Yard Setback to Garage 6.0 metres e) Minimum Interior Side Yard Setback 1.5 metres on one side f) Minimum Interior Side Yard Setback 0.75 metres on one side g) Minimum Exterior Side Yard Setback 3.0 metres" "7.344 *344-Part of Lots 11, 12, 13, 18 and 19, and all of Lots 20, 21, 22, 23, 24, 25, 26, 27, 28, 31, 32, 33 and 34 and Part of Craig Street and Part of First Street, Registered Plan 91, and Part of Lots 41 and 42, Concession 1 E.P.R., and Part of the South Half of Lot 42, Concession 1 (Medonte) Notwithstanding the provisions of Section 4.0, Table B5 Use Standards OS Zone, the following provisions shall apply: a) Minimum Lot Area 0.14 hectares b) Minimum Lot Frontage 0 metres "7.345 *345—Part of Lots 11, 12, 13, 18 and 19,and all of Lots 20,21,22, 23, 24, 25, 26, 27, 28, 31, 32, 33 and 34 and Part of Craig Street and Part of First Street, Registered Plan 91, and Part of Lots 41 and 42, Concession 1 E.P.R., and Part of the South Half of Lot 42, Concession 1 (Medonte) Notwithstanding the provisions of Section 4.0, Table B5 Use Standards OS Zone, the following provisions shall apply: a) Maximum Height 15 metres 3. Section 7.303—Exceptions of Zoning By-law 97-95 as amended is hereby further amended by: a) Deleting in the first paragraph the text"zoned (E=P*303)" and replacing it with the text"denoted by the symbol*303"; and b) Deleting in the second paragraph the text"zoned Environmental Protection (EP*303)"and replacing it with the text"denoted by the symbol *303". 4. Schedules"A", "B"and "C"attached are declared to form a part of this By-law. 5. This By-law shall come into effect upon the date of passage hereof, subject to the provisions of the Planning Act, as amended.
