2022-097 By-law to amend the zoning provisions which apply to lands at Con 1 E Part Lot 9 2021-ZBA-14 (French Properties ltd)The Corporation of the Township Of Oro-Medonte By -Law No. 2022-097 A By-law to amend the zoning provisions which apply to lands at Concession 1 East Part Lot 9 (Orillia) Township of Oro-Medonte 2021-ZBA-14 (French Properties Limited) Whereas the Council of the Corporation of the Township of Oro-Medonte is empowered to pass By-laws to regulate the use of land pursuant to Section 34 and 36 of the Planning Act, R.S.O. 1990, c.P.13. And Whereas Council deems it appropriate to rezone the subject lands. Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: 1. Schedule 'A13' to Zoning By-law 97-95, as amended, is hereby further amended by changing the zone symbol applying to a portion of the lands located in Concession 1 East Part Lot 9 (Orillia), Municipally known as 554 Line 15 North, from the from the Mineral Aggregate Resource Two (MAR2) and Environmental Protection (EP) zones to the Mineral Aggregate Resource Two Exception 332 Hold (MAR2*332(H)) and Environmental Protection (EP) zones, as shown on Schedule "A" attached and forming part of this By-law. 2. Section 7.0 — is hereby further amended by adding the following subsection: "7.332 *332 Concession 1 East Part Lot 9 (Orillia), Township of Oro- Medonte (French Properties Limited) 7.332.1 Permitted Uses Notwithstanding Table A4 — Agricultural/Rural Zone and Mineral Aggregate Resource Zones Permitted Uses and in addition to the permitted uses in the MAR2 Zone, on the lands zoned MAR2*332 the following uses are permitted: a) On -farm diversified uses b) Agri -tourism uses 7.332.2 Provisions Notwithstanding any other provision in this by-law to the contrary, the following provisions apply to the permitted uses identified in Section 7.332.1: a) Minimum required parking spaces for on -farm 55 spaces diversified uses and agri-tourism uses b) Building used for on -farm diversified uses • maximum height 13.7 metres (45.0 feet) • maximum gross floor area 1085.0 sq.m. (11,679.2 sq.ft.) c) Maximum lot area dedicated to the on -farm Maximum 2% of diversified use, which shall include areas the property or containing buildings, well and septic systems, 0.81 hectares (2.0 hard surface driveways/laneways and parking acres) areas. Existing laneways shared between agricultural uses and on -farm diversified uses or agri-tourism uses are not to be included in the area calculation. d) Maximum number of guests and staff per event 150 for an on -farm diversified use e) The frequency and timing of any events must not interfere with cropping cycles or other agricultural uses on the farm or in the surrounding area. f) On -farm diversified uses shall include, but not be limited to: single -day events, such as, or similar to, a wedding, reception and banquet. g) Agri -tourism uses shall include, but not be limited to: farm related attractions and events lasting multiple days which include, or are similar to, a fun farm, Halloween displays and Christmas displays. h) Maximum number of on -farm diversified use 50 events in a calendar year i) Hours of operation for hosted events 10:00 am to 12:00 am (midnight) j) On -farm diversified use events must occur in the barn that is existed on the effective date of this By-law, or within any additions to the existing barn that are done in accordance with the provisions of Section 7.332.2 of the Zoning By- law, with the exception of an outdoor wedding ceremony. k) On -farm diversified uses and agri-tourism uses shall be secondary to the principal agricultural use on the subject lands I) Minimum setback for a parking area from a public 140.0 metres street (459.3 feet) 3. That the Holding Provision shall be removed after the appropriate Site Plan is approved by the Township, the related Site Plan Agreement is registered and the Township has received the securities identified in the Site Plan Agreement. 4. Schedule "A" attached to By-law No. 2022-097 is declared to form a part of this By- law. 5. That this By-law shall come into force and effect on the date that it was enacted subject to Official Plan Amendment No. 45 coming into force pursuant to Section 24(2) of the Planning Act, R.S.O. 1990, as amended, and in accordance with the provisions of Section 34 of the Planning Act, R.S.O. 1990 and the regulations thereto.
