2022-010 By-law to Authorize the Execution of a Subdivison Agreement Amendment btwn Oro-Medonte and Braestone Development CorporationThe Corporation of the Township of Oro-Medonte By-law No. 2022-010 A By-law to Authorize the Execution of a Subdivision Agreement Amendment between the Corporation of the Township of Oro-Medonte and Braestone Development Corporation Whereas Section 51, Subsection (26) of the Planning Act, R.S.O. 1990, Chapter P.13, as amended, provides that municipalities may enter into agreements imposed as a condition to the approval of a plan of subdivision and such agreements may be registered against the land to which the subdivision plan applies being Phases 1 A-1 B- 1 C of the Braestone Estates Development (Plans 51 M-115), Township of Oro-Medonte, County of Simcoe. And Whereas Council of the Corporation of the Township of Oro-Medonte authorized the execution of a Subdivision Agreement with Braestone Development Corporation by By-law 2017-024 in February 2017; AND WHEREAS the original Subdivision Agreement between the Township of Oro- Medonte and Braestone Development Corporation is now required to be amended; And Whereas Council deems it necessary that the original Subdivision Agreement between the Township of Oro-Medonte and Braestone Development Corporation is now required to be further amended to reflect the revised parkland development plans for Starfall Park; Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: 1 That the Mayor and Clerk are hereby authorize to execute, on behalf of the Township of Oro-Medonte, a Subdivision Agreement Amendment, a copy of which is attached hereto and forms part of this By-law as Schedule "A"; 2. That the Subdivision Agreement Amendment, a copy of which is attached hereto and forms part of this By-law as Schedule "A", be registered on title against the lands described therein; 3. That the Township of Oro-Medonte shall be entitled to enforce the provisions of the Amended Subdivision Agreement against the owners and any and all subsequent owners of the land; 4. This by-law shall take effect on the final passing thereof. By-law read a First, Second and Third time, and Passed this 8th day of June, 2022. That Section 7.18 is hereby deleted in its entirety and replaced with the following: "7.18 Parkland/Recreation Block All parkland/recreation works for Block 61 as identified on Schedule "H" and consisting of Landscape Drawings prepared by Envision Tatham issued for Approval August 31, 2020 being Drawings LA-1 Layout Plan, GR-1 Grading Plan, PP-1 Planting Plan, Landscape Details LD-1 through LD-5, and Earthscape Drawing Set for the play equipment are to be constructed in accordance with Section 14 — Park Requirements of the Township of Oro- Medonte Development Engineering Policies, Process and Design Standards. The Township and the Developer agree that revisions to the proposed parkland works are permitted, and will be subject to an amendment to this agreement, and are subject to the acceptance of such parkland revisions by the Township. The parkland/recreation block dedications for the required works will be dedicated to the Township as part of Phase 1 B-1 C of the subdivision agreement. The parkland/recreation works shall be completed at the expense of the developer. The Township will contribute $57,700 towards the purchase, installation and surfacing for the selected playground development as outlined on the approved drawings in Schedule C. The parkland/recreational block works must be completed to the satisfaction of the Township and any phasing of these works will be to the satisfaction of the Township." 2.
