Aubichon 2 The Corporation of the Township Of Oro-Medonte By -Law No. 2022-061 A By-law to Adopt An Amendment to the Official Plan of the Township of Oro-Medonte OPA No. 44 (2041063 Ontario Limited) Whereas The Corporation of the Township of Oro-Medonte is empowered to Amend its Official Plan as required; And Whereas Sections 17, 21, and 22 of the Planning Act, R.S.O. 1990, Chapter P. 13, as amended, provide Council such authority to amend its Official Plan; And Whereas the policies of the Official Plan of the Township of Oro-Medonte are approved and in force and effect at this time; And Whereas Council has considered the appropriateness of amending the Official Plan in regard to lands located at 5071 Highway 11 North, described as East Part of Lot 16, Concession 14 (Oro), Township of Oro-Medonte County of Simcoe; And Whereas the Council of the Corporation of the Township of Oro-Medonte deems it necessary and desirable to adopt an amendment to the Official Plan of the Township of Oro-Medonte; Now Therefore the Council of the Corporation of the Township of Oro-Medonte enacts as follows: 1. That the attached explanatory text and Schedule "A", which constitute Amendment Number 44 to the Official Plan, is hereby adopted; 2. That the Clerk is hereby authorized and directed to make application to the County of Simcoe for approval of the aforementioned Amendment No. 44 to the Official Plan of the Township of Oro-Medonte; and, 3. That this By-law shall come into effect upon the date of passage therefore subject to the provisions of the Planning Act R.S.O. 1990, c. P. 13, as amended. (January 18, 2022) 6 Part 1 — The Preamble 1.1 Purpose The purpose of this Official Plan Amendment is to amend the permitted uses within the Agricultural designation within the Township of Oro-Medonte Official Plan in order to recognize the uses that have existed on the subject property historically. The intent of the Official Plan Amendment is to insert additional permitted uses within Section C.1.4 as they specifically apply to the subject site in order to recognize the existing uses. The passing of this Amendment will permit site specific zoning to be established on the subject lands by way of a Zoning By-law Amendment. 1.2 Location The lands affected by this Amendment are legally described as Part of Lot 16, Concession 14 (Oro), being Parts 1-3 on Plan 51R-30258 (5071 Highway 11 North), Township of Oro-Medonte, County of Simcoe. 1.3 Basis The subject property is designated 'Agricultural', 'Environmental Protection One' and 'Environmental Protection Two' by Land Use Schedule 'A' to the Township of Oro-Medonte Official Plan (OP). The existing structures and land uses are fully situated within the 'Agricultural' designation area. The historical and current use of the subject property does not fall within the permitted uses within the Agricultural designation as per Section C1.2 of the OP; however, they represent a continuation of uses, many of which have existed prior to the OP. The Amendment proposes a site -specific exemption under Section C.1.4 (Agricultural — Exceptions) of the Township's Official Plan. The effect of this amendment is to recognize the existing commercial and industrial uses on the property and to permit a concurrent Zoning By-law Amendment to conform to the Official Plan. The existing uses that are proposed to be recognized through the site specific Amendment area as follows: Existing Buildings, Buildings Supply Outlets and Showroom, Business Offices, Custom Workshops, Retail Stores accessory to a permitted use, Building Contractors Supply Outlet, Auction Centre, Contractor's Yard, Warehouses, Outdoor Storage Uses, Equipment Sales and Rental Establishment, Banquet Hall, Recreational Vehicle Sales Establishment (Snowmobiles, all -terrain vehicles), Swimming Pool and Spa Sales Establishment, Dock and Seasonal Sales Establishment, Motor Vehicle Sales 7 Establishment (for a maximum of 50 vehicles), Trailer/Recreational Vehicle Sales Establishment (fora maximum of 135 units), Mobile/Modular Home Sales Establishment (maximum of 5 units), Service Shops Light, Accessory Outdoor Display and Sales (to a maximum of 7 businesses), and Temporary Tents. 8 Part 2 — The Amendment 2.1 Preamble All of this part of the document entitled "Part 2 — The Amendment" consisting of the following text and map schedule "A" constitute Amendment No. 44 to the Official Plan for the Township of Oro-Medonte. The lands affected by this Amendment are legally described as Part of Lot 16, Concession 14, being Parts 1-3 on Plan 51R-30258 (5071 Highway 11 North), Township of Oro-Medonte, County of Simcoe. 2.2 Details of the Amendment 2.2.1 Text Amendment Section C.1.4 — Exceptions of the Official Plan is amended by adding the following new Section under heading of C1.4. Exceptions: "C.1.4.8 Part of Lot 16, Concession 14, being Parts 1-3 on Plan 51R-30258 (5071 Highway 11 North) Notwithstanding any other policy in this Plan, the following existing structures and land uses are permitted: Existing Buildings, Buildings Supply Outlets and Showroom, Business Offices, Custom Workshops, Retail Stores accessory to a permitted use, Building Contractors Supply Outlet, Auction Centre, Contractor's Yard, Warehouses, Outdoor Storage Uses, Construction Equipment Sales Establishment, Banquet Hall, Recreational Vehicle Sales Establishment (Snowmobiles, 4x4 vehicles), Swimming Pool and Spa Sales Establishment, Dock and Seasonal Sales Establishment, Motor Vehicle Sales Establishment (for a maximum of 50 vehicles), Trailer/Recreational Vehicle Sales Establishment (for a maximum of 135 units), Mobile/Modular Home Sales Establishment (maximum of 5 units), Service Shops Light, Accessory Outdoor Display and Sales (to a maximum of 7 businesses), and Temporary Tents." 2.2.2 Map Amendment Schedule "A" — Land Use is hereby amended by identifying the lands as shown on Schedule "A" attached hereto as subject to Section C.1.4.8. 2.31mplementation The provisions of the Official Plan regarding the implementation of that Plan shall also apply to this Amendment. Furthermore, this Amendment shall be implemented through an Amendment to the Township of Oro-Medonte's Zoning 9 By-law No. 97-95, as amended, passed pursuant to Section 34 of the Planning Act R.S.O. 1990, c.P 13, and through application(s) for Site Plan Control Approval pursuant to Section 41 of the Planning Act R.S.O. 1990, c.P 13. 2.4Interpretation The provisions of the Official Plan as amended from time to time shall apply in regard to this Amendment. 10 Part 3 — Appendices Consists of the background information and planning considerations associated with this Amendment.
