2024-020 By-law to Authorize the Issuance of the Certificate of Maintenance and Final Acceptance (Aboveground Services) for Owen Estates Subdivision Reg Plan 51M-1094THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 2024-020 Being a By -Law to Authorize the Issuance of the Certificate of Maintenance and Final Acceptance (Aboveground Services) for Owen Estates Subdivision, Registered Plan 51M-1094 Whereas Section 51, Subsection (26) of the Planning Act, R.S.O. 1990, Chapter P.13, as amended, provides that municipalities may enter into agreements imposed as a condition to the approval of a plan of subdivision and such agreements may be registered against the land to which the subdivision plan applies; And Whereas Council for the Corporation of the Township of Oro-Medonte entered into a Subdivision Agreement with Southshore Isabella Estates Inc. in June 2016 to construct a residential development consisting of twenty-nine (29) lots on Grace Crescent and Dylan Avenue. And Whereas the Township received a request from the Developer's Engineer dated March 8, 2023, requesting the Township end the maintenance period and issue the Certificate of Maintenance and Final Acceptance; And Whereas the Township's Manager, Development Engineering has provided a recommendation dated December 6, 2023 regarding the completion of the two-year maintenance period and issuance of the Certificate of Maintenance and Final Acceptance; And Whereas with the above recommendation the requirements of this Subdivision Agreement with respect to the aboveground works have now been met; Now Therefore the Council of the Corporation of the Township of Oro-Medonte hereby enacts as follows: 1. That the Certificate of Maintenance and Final Acceptance (Aboveground Services) for Owen Estates Subdivision, Registered Plan 51M-1094, may now be issued by the Township in compliance with the Subdivision Agreement between the Corporation of the Township of Oro-Medonte and Southshore Isabella Estates Inc. 2. That this by-law be considered the "Certificate of Maintenance and Final Acceptance" required by the Subdivision Agreement to be issued effective February 14, 2024. 3. That this By-law shall come into effect upon the date of passing hereof By-law read a first, second and third time, and passed this 14 day of February, 2024.
