Drury Deputy Mayor Ian Beard Reeve David Caldwell Deputy Reeve Norman Dalziel Councillor Donald Bell Councillor Alastair Crawford Councillor Joanne Crokam Councillor Walter Dickie Councillor Murray Martin Councillor Leonard Mortson staff Present: Mr. Gary Cunnington, Administrator, Kris Menzies, Planner, Andria Leigh, zoning Administrator L. D. Cotton, Thelma Halfacre, Shirle Woodrow, Neil craig, Lloyd Fletcher, Ralph Hayes, Bonnie Sanderson, Sandra Sanderson, Don Sanderson, Don Pearo. Also Present Were: Mayor Robert Drury chaired the meeting. Mayor Robert Drury opened the meeting by explaining to those presen that this Public Meeting was to receive public comments with respec to a proposed Zoning By-Law Amendment, under section 34 and 39 of the Planning Act, R.S.O. 1990 c. P. 13. The applicant has applied to have a temporary use by-law on certain lands, Part Lot 13, Concession 3 (Oro). To date, the Council of the Corporation of the Township of Oro- Medonte have not made a decision on this application, other than proceeding to this Public Meeting. Only after comments are receive from the Public, requested agencies and Township Staff, within the appropriate time period, will Council make a decision on this application. Notice of the Public Meeting was mailed out on September 29, 1994, to all property owners within 120 metres of the subject lands. Notice of the Public Meeting was also placed in both the Barrie Examiner and Orillia Packet on September 29, 1994. Mayor Robert Drury then asked the Clerk if there had been any correspondence received on this matter. The Clerk responded by indicating that no correspondence had been received. The Mayor then stated that those persons present would be afforded the opportunity of asking questions with respect to the proposed Amendment. He then turned the meeting over to the Township Planner Ms. Kris Menzies, to explain the purpose and effect of the proposed Zoning By-Law Amendment. Kris Menzies: Thank you Mr. Mayor. The subject property is located on Part Lot 13, Concession 3 in the former Township of Oro. The purpose of tonights meeting is to allow Council the opportunity to hear public comment on the rezoning application prior to making a decision. Th applicants are requesting a temporary use zoning. What a temporar use zoning in effect is that if Council sees fit to approve the zoning by-law, the use will only be permitted for a infinite number period of time, up tÒ a maximum of 3 years as permitted by the Planning Act. In fact, the applicants have requested that this .. - 2 - Kris Menzies: temporary use by-law be in effect for 3 years. The by-law is a si specific or more accurately, a temporary use zoning on a rural residentially zoned piece of property in order to permit the housi of 2 horses in an existing structure. This use currently is not allowed in the zone, this is why the applicants are requesting tha council see leave to pass the temporary use zoning by-law in order to permit the horses to be located on the property. Mr. Mayor, Mr. and Mrs,. Sanderson, the owners of the property are here and I am sure they would be available to answer any questions if the public has any. Mayor Drury: Thank you Kris. Is there any questions, comments or concerns with the proposed amendment before us this evening from the public? I will ask for the second time, any questions, comments or concerns from the public? Council members? Sir, state your name please. Ralph Hayes: I am Ralph Hayes and I live right across the road from Don and I have no objection to the purpose of keeping horses there. That is my side of the story. Mayor Drury: Ok, thank you Mr. Hayes. Councillor Dickie: council members? councillor Dickie. Thank you Mr. chairman, through to Kris. You mentioned that the term is 3 years, can that be extended or is it over at the end of 3 years? Kris Menzies: No. The applicant can request of Council to extend the temporary use by-law for another 3 year time period but at the second 3 years it must be terminated by legislation. Mayor Drury: There being no questions or comments, when being called for the third time, the Mayor in closing the meeting, thanked those in attendance for their participation and advised that Council would consider all matters before reaching a decision. He then advised those present that if they wish to be notified of the passing of th proposed By-law, they should leave their name and address with the Clerk.
