SPECIAL PUBLIC MEETING
WEDNESDAY, NOVEMBER 6, 1996 @ 7:18 P.M. - COUNCIL CHAMBERS

Mayor Ian Beard chaired the meeting.
Mayor Beard opened the meeting and the Clerk explained to those
present that this Public Meeting was to receive public comments
with respect to a proposed Zoning By-law Amendment, under
provisions of Section 34, and 39 of the Planning Act R.S.O.,
1990, c. P. 13. The applicant has applied to rezone lands
being Concession 2, Part of Lot 16, formerly Township of Oro.
This amendment would rezone to allow for a temporary garden
suite for a period of ten years.
To date, the Council of the Corporation of the Township of Oro-
Medonte have not made a decision on this application, other
than proceeding to this Public Meeting. Only after comments
are received from the Public, requested agencies and Township
Staff, within the appropriate time period, will Council make a
decision on this application.
Notice of the Public Meeting was mailed out on October 17, 1996
to all property owners within 400 feet of the subject lands.
Notice of the Public Meetng was also placed in both the Barrie
Examiner and Orillia Packet and Times on October 17, 1996.
Clerk indicated that correspondence had been received on this
matter by the following persons: Katherine I. Heal & J. Heal,
and Nottawasaga Valley Conservation Authority
The Clerk then stated that those persons present would be
afforded the opportunity of asking questions with respect to
the proposed Amendment. She then turned the meeting over to
the Development Co-ordinator, Mrs. Andria Leigh, to explain the
purpose and effect of the proposed Zoning By-law Amendment.

Andria Leigh:
Thank you Madame Clerk. The purpose of this meeting tonight is
to obtain comments from the public before Council considers
this amendment.
The proposed amendment would rezone a portion of land in
Concession 2, Lot 16 to permit a temporary use. This temporary
use would be for a "Garden Suite" for a maximum period of ten
years.
The subject property is located at the intersection of the
15/16 Side Road and Line 2 North. The parcel subject to the
temporary use is highlighted in red (shown on map).
The effect of this amendment would be to permit the
construction of a one unit detached residential structure for a
maximum time period of ten years. This temporary use is
permitted under Section 39 of the Planning Act and permits
Council to enter into the appropriate agreements with the owner
under Section 207.2 of the Municipal Act, 1994, c.2, s.44(1).
As I indicated previously, tonight's meeting is solely to
obtain public comments with respect to the temporary use prior
to Council's consideration.
Brian Thompson:
Mr. Thompson questioned the comments made by Mr. & Mrs. Heal
regarding the road and if this was relevant. An explanation of
how the garden suite operates with respect to whether it is
totally separate regarding septic systems and water.
Andria Leigh:
The new Planning Act, which came into force and efffect in 1995
under Bill 20, includes a new provision under temporary uses
which allows for what the province terms as a "Garden Suite"
with a permitted time period of 10 years.
The definition provides for a "Garden Suite" is as follows: A
one - unit detached residential structure containing a bathroom
and kitchen facilties that is ancillary to an existing
residential structure and that is designed to be portable.
With respect to your comments on building. A building permit
would be required for the "garden suite" and all building code
requirements would be required to be adhered to.
Walter Dickie:
Andria, what is the size of the lot?
Andria Leigh:
The lot is 25 acres.
Walter Dickie:
Does it have a separate entrance?
Andria Leigh:
Yes, due to the flood plain area beside the existing house the
granny flat may not be located off the same driveway and
therefore the garden suite would require it's own entrance.

Can Andria read the notice?
Andria Leigh:
Take Notice that the Council of the Corporation of the Township
of Oro-Medonte will hold a Public Meeting on Wednesday,
November 6, 1996 at 7:05 p.m. in the Municipal Council Chambers
to consider a proposed amendment to the Zoning By-law, under
Sections 34 and 39 of the Planning Act R.S.O. 1990, c. P. 13.
The proposed Zoning By-law Amendment would rezone those lands
located in Part of Lot 16, Concession 2, former Township of
Oro, to allow for a temporary garden suite for a period of ten
years.
A Key Map for File P-50/96 is provided below.
Any person may attend the Public Meeting and/or make written or
verbal representation either in support of or in opposition to
the proposed Zoning By-law Amendment.
Additional information relating to the proposed amendment is
available for inspection between 8:30 a.m. and 4:30 p.m. at the
Township of Oro-Medonte Municipal Office.

What is the zoning being changed from and to?
Andria Leigh:
The zoning is not changing.
Jacquie Besse:
What fees are applicable and can they be itemized by staff.
Discussion occurred regarding the bond required for this
rezoning.
There is an awful corner there for a separate driveway and this
new driveway will be even closer.
Mrs. Barcicki:
The driveway to the field will be used with the permission of
Council.
Mr. Thompson:
Can anyone make a request to do this on any piece of Property,
no matter the size?
Andria Leigh:
Yes, anyone may apply to do this but consideration to all
issues such as Health Unit must be addressed.
Bob Drury:
Is a mobile trailer considered as a garden suite?
Andria Leigh:
Yes, they could be.

There being no further questions or comments, when being called
for the third time, the Mayor in closing the meeting, thanked
those in attendance for their participation and advised that
Council would consider all matters before reaching a decision.
He then advised those present that if they wished to be notified
of the passing of the proposed By-law, they should leave their
name and address with the Clerk.

(Conc. 2, Part of Lot 16, (Oro) now be adjourned at 7:45 p.m.
