Mayor Ian Beard chaired the meeting.

Mayor Ian Beard opened the meeting by explaining to those
present that this Public Meeting was to receive public comments
with respect to a proposed zoning By-Law Amendment, under
provisions of section 34, of the Planning Act. The applicant
has applied to rezone certain lands located in Part of Lots 1
and 2, Concession 4, former Township of Medonte, to rezone those
lands as described from the Open Space (OS2) Zone to the
Residential Exception (Rl-8) Zone to permit the development of
250 townhouse condominiums and a draft Approval Plan of
Subdivision.
To date, the Council of the Corporation of the Township of Oro-
Medonte have not made a decision on this application, other than
proceeding to this Public Meeting. only after comments are
received from the Public, requested agencies and Township Staff,
within the appropriate time period, will council make a decision
on this application.
Notice of the Public Meeting was mailed out on December 18,
1995, to all property owners within 400 feet of the subject
lands. Notice of the Public Meeting was also placed in both the
Barrie Examiner and Orillia Packet and Times on December 18,
1995.

Mayor Beard then asked the Deputy Clerk if there had been any
correspondence recei ved on this matter. The Deputy Clerk
responded by indicating that correspondence had been received
from the Ministry of Natural Resources indicating no objection
to the proposed amendment. correspondence was also recei ved
from the Ministry of Environment and Energy regarding the status
of the application for certificate of Approval Sewage
Treatment Plant as well as correspondence from Ron Kolbe, Chief
Building Official, expressing no objection.

The Mayor then stated that those persons present would be
afforded the opportunity of asking questions with respect to the
proposed Amendment. He then turned the meeting over to the
Township Planner, Mr. Mark Stagg, to explain the purpose and
effect of the proposed Zoning By-Law Amendment. '
Mark stagg:
Thank you, Mr. Mayor. Qui te a number of
years ago now, the former Township of
Medonte through its Official Plan, invited
a whole series of designations for land
immediately north of County Road 22, right
across from the main resort development of
Horseshoe in Concession 4. Part of that was
to designate the subject property for a
high-density form of residential
development. That was then followed by an
amendment to the Medonte Zoning By-law which
specifically created an Exception to the
zone known as RR1-S. Included in that was
a maximum provision of 250 townhouses for a
said piece of land. The proposal now in
front of us is to expand the land area on
which this development would occur but not
to change any of the details of the site-
specific zoning; in other words, it would
still be 250 units but on a slightly larger
piece of land and all the other zoning
conditions remain. The other question that
came up was the definition of the western
boundary of the property because of the
creek immediately beyond it very close to
the road between Concession 3 and 4. The
applicant had a professional study
undertaken by M. M. Dillon. We have that
study in our possession with the detail line
which is referred to in the correspondence
from the Ministry of Natural Resources. I'm
quite satisfied that the land is properly
established so that the property that is
being rezoned will not be subject to
flooding or other environmental damage. The
other letter that was read out came from the
Ministry of Environment with respect to the
sewage servicing of the area. There is an
indication at least that the applicant is
attempting to move. forward. It would appear
with some success to get the approvals from
their perspective to service the area.
There are other negotiations which have
still to occur between council and the
developer to finalize that. Tonight, I
think we're simply dealing with a very small
expansion of the land area. The applicant IS
planning consultant has submi tted a very
thorough report on the whole subject, and
perhaps with your permission, Mr. Mayor, I
could let my colleague, Ms. Menzies, carry
on.

Thank you Mr. Mayor, thank you Mark. My
name is Kris Menzies, I'm a planner and I'm
here representing Horseshoe Resort
Corporation. With me this evening is Graeme
Clark. Graham is a civil engineer; he is
also Horseshoe Resort's Development Manager.
What I'm here to explain in a little bit
more detail this evening, is the reason why
the corporation has come here for a public
meeting, and what the Corporation's
intention is in relation to the development
of this property. Mark has aptly pointed
out that there is a proposal for a 250
townhouse condominiums on property which is
owned by Horseshoe Resort corporation and
essentially is located just east of the
third concession road, which isn't built.
It's north of Horseshoe Valley Road, south
of the Copeland Forest. This property is
designated under the Official Plan, which is
approved for the 250 townhouse condominiums.
It is already draft-plan approved by the
Minister of Municipal Affairs and, I would
estimate 97 percent of the property is zoned
to allow the 250 townhouse condominiums.
What I've done here, is outline in yellow
the area which is already approved and zoned
the 250 townhouse condominiums. What
Horseshoe's intent is, is to rezone the
little red area to allow some more land mass
to the location of those 250 townhouses.
The townhouses currently are approved to be
located here and what Horseshoe wants to do
is spread out that density to allow the
townhouses to be developed, here. That will
reduce the density of the proposal, it will
still be 250 townhouse condominiums, but
they will be spread out over a larger land
mass. It will allow for a little bit better
(?) circulation in here, and it will allow
for a little bit more creativity once the
final design of the location of the
townhouses are developed. To give you a
little bit further orientation, if any of
you have golfed up at Horseshoe, this is the
fourth...located behind the fourth fairway.
The reason that council has called this
public meeting is to here public comments on
what you think about the rezoning of this
little red area. Part of the process, and
the reason why the Ministry of Natural
Resources has commented on the proposal, is
this blue area shows schematically the
location of a creek. Horseshoe Resort
wanted to determine how close they could get
to the creek and not disturb the
environmental integrity of that creek. So
they retained an environmental firm by the
name of M. M. Dillon. Jennifer Harper is a
wetland biologist with M. M. Dillon and she
did a report which she submitted to the
Ministry of Natural Resources which
determined how close she felt the
development could go to that creek and still
maintain its environmental integrity.
Horseshoe Resort was encouraged by Ms.
Harper's work in that the Ministry of
Natural Resources has a policy which

basically says, to this type of creek,
you're looking at a distance of 15 to 20
metres from the creek's edge. The
corporation, through M. M Dillon decided
that they wanted to take a little bit more
of a sensitive approach, throw that policy
to one side, and determine how close should
it be. The basic distance which has been
surveyed and now agreed upon by MNR ranges
from 23 metres to 65 metres. That is why
the Ministry of Natural Resources wrote the
Municipality and said that they had no
concern with the rezoning as long as this
line was selected the survey line which was
produced from Dillon's work. Essentially,
Your Worship, that's about all I have to say
in relation to this proposal but if anybody
has any questions I'd be glad to answer
them.

view of the development that's taken place
at Horseshoe, could I have some
understanding of how the Horseshoe Valley
Road will be updated?

Okay, that I would say, doesn't directly
affect this particular rezoning on this
piece of property; however, there are normal
negotiations for road upgrades is at the
time of the plan of subdivision. Mr. stagg?
That is correct, Mr. Mayor. That will come
fairly soon, I would think. I think it is
also fair to point out that the basics of
how much traffic would come in and out and
what was required was worked out in a
previous situation when the original zoning
and everything was put in place, so we're
not really changing the amount of
development in the rezoning that's here
before you tonight, but simply playing
around and expanding the land area a little
bit. The issue of traffic is very valid,
but there's going to be another place where
that's going to be addressed.

events, we are very reluctant to schedule
meetings other than at the Township offices,

Mr. Mayor, I think what probably will happen
is that the Township along with its
consultants will meet with the developer and
a consultant and we have to go through all
the conditions the Minister of Municipal
Affairs has imposed on the draft plan
approval. Finally, that leads to a
subdivision agreement. There will be an
occasion when that finally comes forth to
this Council, an open council, for your
consideration and adoption. I suppose, then
if we wish to have the public involved we
have to advise them of that date, when you
have this formally in front of you. There
are many hours of technical discussion to
bring us to the point that we are back in
front of Council.
Yes, Mr. Dryden, I wouldn't want to say that
we're going to...negotiations with the
subdivider are sometimes something that you
don't want to hold in public session and we
appreciate the circumstances, but normal
course of events are that your council
members are there to represent you and,
also, anything passed will be passed at a
public meeting perhaps your councillor, Mr.
Dickie, or myself, or any councillor for
that matter, can...
