Mayor Ian Beard opened the meeting and the Clerk explained to those present that this
Public Meeting was to receive public comments with respect to a request for an
amendment to the Zoning By-law to rezone the lands located in Concession 14, Part of Lot
6 (former Township of Medonte) from the Institutional (I) Zone to the Highway Commercial
Zone, under Section 34 of the Planning Act R.S.O. 1990 c.P.13.
To date, the Council of the Corporation of the Township of Oro-Medonte has not made a
decision on the request, other than proceeding to this Public Meeting. Only after
comments are received from the Public, requested agencies and Township staff, within the
appropriate time period, will Council make a decision on the proposed amendment.
Notice of the Public Meeting was mailed out on October 16, 1997 to all property owners
within 400 feet of the subject lands. Notice of the Public Meeting was also placed in the
Barrie Examiner, Orillia Packet and Times and Midland Free Press on October 16, 1997.
The Clerk then indicated that no correspondence had been received on this matter.
Mayor Beard stated that those persons present would be afforded the opportunity of asking
questions with respect to the Application. He then turned the meeting over to Andria Leigh,
Township Planner, to explain the purpose and effect of the proposed amendment to the
Zoning By-law.

Andria Leigh:
Thank-you your worship. As the mayor has indicated this is a public meeting to obtain
comment of a particular proposal for a re-zoning. I've got a map here that basically
explains where the property is located (pointing to map) and this is Highway 12 in this
location here, this is the Warminister Sideroad, we are up in the former Township of
Medonte in the hamlet of Warminister. The subject property is outlined here right on
Highway 12, it's a lot which currently hosts the arena hall or the Orange Hall and the
applicant is intending to rezone that from the Institutional Zone to a Highway Commercial
Zone in order to use the existing building for the sale of automobile books and parts. We
did receive comment when we initially looked at the application from the Ministry of
Transportation and the Health Unit indicating that they would allow a conversion to the
Highway Commercial Zone provided that it was dry uses only. So, we have received
approvals that are required to look at this rezoning. Essentially, that would be my
comments at this point in time and I will turn it back to the Mayor to receive public
comment.
Mayor Ian Beard:
Is there anyone present who would like to make comment or ask a question, and I would
remind you that we are recording this so the minutes can be typed up accurately. If anyone
present would like to ask a question would they please state their name. Are there any
questions on this particular item? Council members as well. Mr. Dickie.
Councilor Walter Dickie:
Thank you Mr. Mayor. Through you to Andria. Andria, by rezoning it to Highway
Commercial from Institutional will that allow for apartments to be located on the site?
Andria Leigh:
The Highway Commercial Zone, through to Councilor Dickie, does allow for one accessory
apartment. It doesn't allow for more than that. Commercial use is the main use of the
property, so if the owner wanted to have an apartment to live in on their premises that
would be permitted, but it's only one apartment that is permitted by By-law.
Councilor Walter Dickie:
Andria, has that application been made or do you know?
Andria Leigh:
The owner is in the audience and he has indicated that he would live in the upstairs of that
building and would use the lower floor for his commercial use.
Councilor Walter Dickie:
The Department of Health has given their consent to that?
Andria Leigh:
Yes they have.
Mayor Ian Beard:
Any further questions?

Councilor Neil Craig:
Question through to Andria. The Highway Commercial Zone which is being sought here,
how varied a scale does that allow, or are you defining it strictly to the use being asked for
now.
Andria Leigh:
No. Through to Councilor Craig, we are not limiting it just to the automobile use. What we
found over the past year, year and a half, is that if there are no concerns from the agencies
as to limiting it to a particular use, I will allow it to go in the general list of uses. There are
approximately 15 in the Highway Commercial, now some of those are wet commercial uses
and would not be permitted, like a restaurant, a take-out, any kind of food establishment
would not locate in this area, but if it is a convenience store or some other form of
commercial use that would be permitted. We found that if we don't give a little bit of
flexibility it makes it difficult in the sale of these properties in the future.
Councilor Neil Craig:
The highway has indicated they don't have a problem, so have they granted a commercial
entrance permit?
Andria Leigh:
I would have to check with the applicant to see if they have granted that. They provided us
with their comments that they knew it was going to be a commercial use and there was an
existing entrance and they have no objections, so I would assume, if they haven't granted it
that they would be in a position to do that. But I could ask the applicant if he has a
commercial entrance at this point in time.
Maurice Young:
Actually, no.
Andria Leigh:
I can certainly clarify with the ministry that they have indicated that they have no objection
to the Highway Commercial Zone and from our past work with them that would indicate that
they would be willing to give the approval.
Mayor Ian Beard:
Any further questions or comments?
Lillian McConnell:
I was just wondering about the parking? Does the gentleman have parking along the
highway or where?
Andria Leigh:
Through to Ms. McConnell, there is parking. The driveway actually goes along the south
edge of the property and all of the parking would be in behind the existing building - there
would be no parking out front. That was one of the issues we had to address to ensure that
there would be enough on-site parking. The building is extremely close to the highway and
we didn't want people parking along the road.
Mayor Ian Beard:
Any questions? Second time for any questions. Third and final time for any further
questions. Being none, Council would like to thank all those in attendance. In closing the
meeting, the Mayor advised that Council would consider all matters before reaching a

decision. He then advised those present that if they wished to be notified of the passing of
the proposed By-law, they should leave their name and address with the Clerk.
