11 05 1997 SP Public Minutes IF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE SPECIAL PUBLIC MEETING WEDNESDAY, NOVEMBER 5,1997 TIME: 7:05 P.M. ONE HUNDRED AND TWENTY-THIRD MEETING 1994-1997 COUNCIL Council met this evening @ Present: 7:20 p.m. with the following members present: Mayor Ian Beard Deputy Mayor Murray Martin Councilor Walter Dickie Councilor Don Bell Councilor Neil Craig Councilor Thelma Halfacre Absent: Councilor Ron Sommers Staff Present: Andria Leigh, Planner; Jennifer Zieleniewski, CAOlTreasurer; Jerry Ball, Roads Superintendent; Deborah Broderick, Director of Recreation and Community Economic Development Also Present: Lorna Gushue, Toller Willson, Lillian McConnell Maurice Young, Debbie Mooney, Larry Boland, Shirley Woodrow, Eric Miller, Oliver Hopkins, Dorothy Hopkins, Paul Marshall, Barry Moore, Earl Robertson, Daryl Watson, Tosh Skalosky, Sharon Irvine, Sarah Irvine, Larry Koza, Arch Brown. Mayor Ian Beard opened the meeting and the Clerk explained to those present that this Public Meeting was to receive public comments with respect to a request for an amendment to the Zoning By-law to rezone the lands located in Concession 1, West Part of Lot 15 and West Part Lot 16 (former Township of Orillia) from the Highway Commercial Exception Seven (C2-7) Zone to the Highway Commercial (C2) Zone, under Section 34 of the Planning Act RS.O. 1990 c.P13. To date, the Council of the Corporation of the Township of Oro-Medonte have not made a decision on the request, other than proceeding to this Public Meeting. Only after comments are received from the Public, requested agencies and Township staff, within the appropriate time period, will Council make a decision on the proposed amendment. Notice of the Public Meeting was mailed out on October 16, 1997 to all property owners within 400 feet of the subject lands. Notice of the Public Meeting was also placed in the Barrie Examiner, Orillia Packet and Times and Midland Free Press on October 16, 1997. The Clerk then indicated that no correspondence had been received on this matter. Mayor Beard stated that those persons present would be afforded the opportunity of asking questions with respect to the Application. He then turned the meeting over to Andria Leigh, Township Planner to explain the purpose and effect of the proposed amendment to the Zoning By-law. I apologize, the lines on this map are a little light, basically the property we are looking at, this is Highway 12 in this location here, this is the 14th Line of Oro Township, they are just east of the town line and just south of Highway 11. The subject property is highlighted in orange in this location, it is part of Lot 15 and Part of Lot 16 and the original road allowance use to go through the property, but that was stopped up and closed and deeded back to the owner of the property. Currently what happens, the road allowance goes around the southerly edge of this property and that is the entrance that the owner of the property currently uses to get into his property. The property presently is in a Highway Commercial Exception Zone which only allows for the sales and servicing of recreational vehicles on the property. The applicant is looking to change that back to a general Highway Commercial which would allow for a wide range of commercial uses. Primarily what he is looking at the property for initially is the display and storage of amusement devices and then future building along that same line in the future. Now we did receive a copy of the MTO approval for the entrance that is at the southerly end of this property for the change in the commercial zoning and we did receive a verbal from the Health Unit indicating dry uses would be permitted, but not any other type of commercial usage. At this point I will turn it back to the mayor for any questions from the public. Mayor Ian Beard: Are there any questions from the public. I would ask you to state your name, as with the previous meeting, this is being recorded so we can have an accurate set of minutes. Are there any questions on this item. Lorna Gushue: I was just concerned about the increase in traffic in and out of that driveway. It is not that far from the highway exit. My children, I live next door, they cannot be picked up by the school bus as they can not be seen behind the school bus and it has been deemed unsafe. Yet we are having transport trucks come in and out of that driveway, and my concern is that someone is going to have a bigger accident due to the increased traffic coming in an out of that driveway. Mayor Ian Beard: That is noted and Andria would you like to address that? Andria Leigh: Yes, it is certainly noted and I spoke with the lady earlier today and I explained to her that the Ministry of Transportation does have the approval authority over that entrance and I just want to clarify with them that they did take that into consideration when they looked at the Highway Commercial zone because there would be an increase in potential traffic because initially its use was for storage. Toller Wilson: My name is Toller Wilson. I live next door. Brian Shelswelilives up the road from us. He also had a driveway in the same spot and the Ministry made him move it so that he could open his property and use it for commercial use. It just seems odd that they would pass this entrance when Mr. Shelswell was made to move his. Mayor Ian Beard: So you are suggesting that it would be safer to move the driveway. 3 Toller Wilson: Well, yes. It would be safer off the highway for sure. Mayor Ian Beard: That will be noted as well. Further questions or comments at this time. For the second time, any further questions or comments on this particular item. Third and final time, are there any questions of comments. The Mayor in closing the meeting thanked those in attendance for their participation and advised that Council would consider all matters before reaching a decision. He then advised those present that if they wished to be notified of the passing of the proposed By- law, they should leave their name and address with the Clerk.
