Mayor Ian Beard opened the meeting and the Clerk explained to those present that this
Public Meeting was to receive public comments with respect to a request for an
amendment to the Zoning By-law to rezone the lands located in Concession 1, Lots 17 to
24, Plan 1 (former Township of Oro) from the Natural Area (NA) Zone to the Shoreline
Residential (SR) Zone, under Section 34 of the Planning Act R.S.O. 1990 c.P.13.
To date, the Council of the Corporation of the Township of Oro-Medonte have not made a
decision on the request, other than proceeding to this Public Meeting. Only after
comments are received from the Public, requested agencies and Township staff, within the
appropriate time period, will Council make a decision on the proposed amendment.
Notice of the Public Meeting was mailed out on October 16, 1997 to all property owners
within 400 feet of the subject lands. Notice of the Public Meeting was also placed in the
Barrie Examiner, Orillia Packet and Times and Midland Free Press on October 16, 1997.
The Clerk then indicated that no correspondence had been received on this matter.
Mayor Beard stated that those persons present would be afforded the opportunity of asking
questions with respect to the Application. He then turned the meeting over to Andria Leigh,
Township Planner to explain the purpose and effect of the proposed amendment to the
Zoning By-law.
Andria Leigh:
Thank you your worship. As the mayor has indicated, this is a public meeting to obtain
comments with respect to this particular piece of property which is located south of the
Shanty Bay and the Ridge Road and just east of the boundary of the City of Barrie.

Looking at Colborne Street in this location, the unopened O'Brien Street is here and
Georgina Drive in this location, and it is north of the CN Rail Lines. The property has been
the subject of four severance applications which have been approved by the Committee of
Adjustment to allow for five lots in total in this larger area and this one additional lot here.
Each of those is being rezoned right now from the Natural Area Zone to the Shoreline
Residential Zone, which will allow for one single-family dwelling on each of those lots for a
total of six. There were, with the second consent application, approvals received for
entrances for those lots onto the Shanty Bay Road, which is a County Road, and there
were also comments from the Health Unit favorable with allowing a septic on each of those
properties. There was one problem when the notices were sent out, that it didn't indicate
where the O'Brien Street was noted on the property and it is not part of the property being
rezoned at this point of time, so I just bring that forward. Now I will turn it back to his
worship.
Mayor Ian Beard:
Thank you. Any questions on this item. Will you please state your name and speak up for
the microphone as it is being recorded.
Larry Koza:
I live directly across from O'Brien Street. My question is to the placement of the houses. At
my end of Barrie Terrace, where I am, the corridors are very thin lots, myself and my
neighbor Robinson Anderson. I wonder how the houses are going to be placed on the
lots?
Andria Leigh:
So you are at this end of O'Brien Street, you are on the far end of Barrie Terrace.
Larry Koza:
Yes, I'm the last guy.
Andria:
The lots in this location, each lot is approximately three to four hundred feet deep and the
yard set back required from the property line from each of those houses - they are a
minimum of 30 feet back from any property line. So that would be the minimum distance
the applicant would have to set the house back from that. In terms of further site location
on that I may ask the applicant if he can respond to that, if he knows exactly where the
houses are going to be placed at this time. That would be dependent on the Health Unit
approval and where the septics are going to go.
Larry Koza:
How does the placement of the extra land between the road and the north end of the CN
corridor?
Andria Leigh:
At this point in time I can't give you an answer on that. That is still part of the CN corridor
and it's not owned by the applicant and so that would have to be determined in the future
what's going to happen with that portion of it.
Larry Koza:
Okay, my only concern is the lack of privacy on a dead-end road now. The CN corridor is
directly right in front of my house and I would like, you know, with the increased traffic and

houses on the other side, I won't have a lot of privacy, right next to my house. I wouldn't
be in favor of a rezoning application, if you're looking for input because of the privacy
issues.
Mayor Ian Beard:
Any further questions or comments on this particular item? Yes sir.
Paul Marshall:
Could the rezoning of this property eliminate the opportunity of an easement there for
public?
Andria Leigh:
No. As part of the severance applications along this property there was an easement to be
dedicated to the township for a walkway purpose, so that is a condition of the severances
getting their final approval and their stamping of the deed. So that will be dedicated to the
township.
Arch Brown:
Thank-you mayor. I'm the next to Larry, I back on Georgina Drive, and I'm not opposed to
the application, however I would like for the township in the dealings to give us
consideration, the right of the way of the railway is 100 feet at our point and you only really
need 66 feet, in light of the fact we have a large investment on the lakeshore I would like
the road way, if possible, to use the 66 feet of the north side as opposed to the south side
because there are no buildings on the north side facing that at the present time, so that
would give us an extra, the difference between 66 feet and 100 feet.
Andria Leigh:

Arch Brown:
Weill have one other thing. This is a matter of interest to you folks, that is, and I was very,
very surprised, and I brought this up at the last meeting about a week ago, coming out of
the Georgina Drive we see that the road that we always thought was the Shanty Bay Road
is now the Ridge Road and I really feel that the road from Lake Street to Shanty Bay
should be preserved as the perceived name of Shanty Bay, because Shanty Bay is much
more picturesque of a word than Ridge Road. I'm interested in knowing where the Ridge
Road originated and I'm doing a project for the Rotary Club of Barrie on the history of
Kempenfelt Bay and Barrie and I found a text book for the education committee of Simcoe
County Council, which is approximately 50 years old and looking through this book I
noticed that the main street of Barrie, of course is Dunlop, in 1814 a government project
under Dr. William (Tiger) Dunlop, and by the way he was the man that planned Godrich,
opened the Penetang Road through the tribe purchase by the Indians, and then it goes on
to say, it talks about the Penetang Road, but specifically it talks about a Ridge Road which
started at Crown Hill. Now this is in your jurisdiction and it joined an Indian Trail known as
the Ridge Road and that went to Shanty Bay, so we have a precedent of Ridge Road but it
starts at Crown Hill and it comes down to Shanty Bay, so I think that we should preserve
that and still call it Shanty Bay Road through Shanty Bay, but the Ridge Road from Shanty
Bay on. Thank you.

Are there any further questions or comments on the issue being discussed at this time? Mr.
Craig.
Councilor Neil Craig:
I have a couple questions through to Andria. The Official Plan designation on this property,
what is the Official Plan designation now?
Andria Leigh:
The designation is shoreline on this property at this time.
Councilor Neil Craig:
So, the rezoning that is being sought tonight would be in conformity with our Official Plan?
Andria Leigh:
Through to Councilor Criag, yes it would.
Councilor Neil Craig:
The other question I have is on the size of the lots which have been approved by the
Committee of Adjustment. Is there an average size, or can you give us an idea of what the
size of the potential lot along this piece of ground?
Andria Leigh:
The average size of the lot is two acres, anywhere from 1 % to 2 acres, the smallest parcel
is this one in this location which is a longer and narrower parcel. As you get further over
towards the old O'Brien Street they are upward of two acres.
Mayor Ian Beard:
Further questions of comments? Yes sir.
Larry Koza:
Are they planning on building on all five lots, even the narrow one there?
Andria Leigh:
I might ask the applicant if he would answer. They have the ability to build on all of those.
They have done a hydrogeological assessment and they have Health Unit approval for
even the narrowest lot to put in septic system and a house on that property. In my
understanding is, yes they are intending to build on each of those lots.
Larry Koza:
Okay, I would just like to make another comment. Not that I'm so much opposed to the
rezoning of the land, I'm just very concerned for my privacy. I pretty much would say the
same thing that Arch said about being in favor of moving the road to the farthest northern
boundary to give us more privacy. Also there is a steepness issue on the track. There's

also some drainage issues, some privacy issues. If there is a way at that end of Barrie
Terrace, how deep is that lot?
Andria Leigh:
The lot in this location is 420 feet, I believe.
Larry Koza:
So whether or not the road was in the northern part, or in the middle, the actual 15 feet, it
really wouldn't matter as much as it could matter on our side.
Andria Leigh:
Certainly, it's not an issue in terms of him being able to meet his minimum lot size
requirements. In terms of the road going through the CN lands, that's something that isn't
necessarily part of the rezoning. It's something Council would have to determine when they
actually go to construct it based on the engineering work.
Larry Koza:
Okay, so I'll change my thought track to a conditional kind of objection.
Councilor Walter Dickie:
Through to Andria. Normally when there is more than two or three lots developers go by
way of planned subdivision but this is by way of severance. In a planned subdivision we
have parkland dedication, could you explain to the public here how or what we are doing
for parkland dedication to ensure (land) for a potential trail in the future.
Andria Leigh:
Through to the public, essentially when we do a planned subdivision application, the
applicant is required to provide five per cent parkland dedication. A planned subdivision or
a severance application are considered under the same section of the Planning Act and
therefore the Committee of Adjustment, by Council, has the ability to ask for that parkland
dedication. Typically they have asked for cash in lieu, but in this case, because we wanted
to have that linkage trail the Committee of Adjustment put the condition in that there would
be a dedication of land along the Shanty Bay Road, which would be the parkland
dedication on this property, very similar to the way a planned subdivision is done.
Councilor Walter Dickie:
I understand there are going to be entrances off Shanty Bay Road. How does that work?
Are there going to be easements over the entrances or something like that?
Andria Leigh:
Through to Councilor Dickie, the applicant would be granted easements for each of those
driveways over the walkway area in order to access his property for those driveways.
Mayor Ian Beard:
Any questions or comments on this issue? Mr. Brown.
Arch Brown:

I wasn't going to bring this up. But a week or so ago, there was a letter to the editor in the
Barrie Examiner from George Taylor and I have been unable to find out where he got his
information. I've talked to all the residents on Georgina Drive and they are all surprised at
the innuendo's and information in that letter. I just want council to know that this did not
come in any way from the Georgina Drive residents.
Mayor Ian Beard:
Thank you Mr. Brown, I think one of the problems at this time, it's a very exciting time in
municipal politicians career and there are all sorts of ways and means of things getting out
that should be getting out and things being said that maybe shouldn't be said and its pretty
hard to pin down where something like that comes out. I believe I read the letter, as
probably every member of council did. I don't believe I have a copy of it now, but I believe I
did keep the letter. We do keep copies of all letters in the office for that purpose.
Further questions or comments on this item at this time? There being no further questions
or comments, when being called for the third time, the Mayor in closing the meeting,
thanked those in attendance for their participation and advised that Council would consider
all matters before reaching a decision. He then advised those present that if they wished
to be notified of the passing of the proposed By-law, they should leave their name and
address with the Clerk.
