06 03 1998 SP Public2 Minutes 8 ,.. . I SPECIAL PUBLIC MEETING UNDER THE PLANNING ACT Rezoning - P-70/98, Conca 2, Pt. Lot 1 & Pt. Tatham & Associates, Garth Daniels, Dana Anderson, DLA Consulting, Reid Holmes, Packet & Times, Shirley Woodrow, Mr. Loharu, Richard Hensley, Gord Knox, Bernie Stihl, Nick McDonald, The Planning Partnership Mayor Beard called the meeting to order and advised that all persons present would be afforded the opportunity of asking questions in respect to the proposed rezoning. It was noted that correspondence had been received from the Simcoe County District Health Unit indicating that they are not opposed to the proposed amend ment. Chris Jones from the Planning Partnership advised that the application was submitted by Ms. Dana Anderson of DLA Consulting Ltd. on behalf of Shanty Bay Woodlands Ltd. The subject lands have been granted provisional consent to sever one new lot by the Oro-Medonte Committee of Adjustment, with a condition of consent being that the applicant rezone the severed lands comprising the new lot. This application is therefore submitted to fulfill the condition of consent and to rezone from Agricultural Rural zoning to Shoreline Residential zoning. This will have the effect of implementing the shoreline policies of the Official Plan. Dana Anderson presented that the subject lands, also known as 2981 Shanty Bay Road, is a significant shoreline property with a substantial estate home on it. The property conveyed has 900' of road frontage and 110' of shoreline frontage. Each property maintain their own access and each lot has a home, a well and a septic system on it. The Shoreline Residential zoning is being implemented with this rezoning and to recognize the existing situation and to recognize the site specific areas that do not currently comply. Councillor McConnell queried if the environmentally protected area on the subject lands was a stream? - . r -2- Dana Anderson responded that the actual consent for the severance line is the centre line of that creek. Councillor McConnell then stated that her concern is that because the shed is, or could possibly be, encroaching on that, what uses are stored in the shed, what kinds of things could possibly leach into that, what kind of erosion is running through it. Also, what kind of natural restoration is there? Is the stream protected? Ms. Anderson replied that there is a 30 m. buffer and this is where the encroachment is occurring, but the stream is protected by trees. Deputy Mayor Bell asked Ms Anderson to explain why the boundary line is where it is. Ms. Anderson stated that Mr. McDonald of the Planning Partnership and herself have discussed this and the existing environmental protection was based on base-mapping, which shows the contours of the area. Councillor Sommers then questioned Nick McDonald as to whether he had any concerns with this rezoning. Mr. McDonald responded "No". Garth Daniels wanted to know why this is being done if everything is fine the way it is. He asked if one house would be torn down if the Township didn't agree to the rezoning. Mayor Beard commented that the new Official Plan and Zoning By-law do not allow for two houses on one lot and this would correct an existing problem. There being no further comments or questions, the meeting adjourned at 8:30 p.m. Moved by Bell, Seconded by Hough. Carried.
