05 19 1999 Council Minutes . I THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE COUNCIL MEETING ednesday, May 19, 1999 TIME: 7:00 P.M. THIRTY-EIGHTH MEETING 1997-2000 COUNCIL Council met this evening @ 7:00 p.m. with the following members present: Present: Mayor Ian Beard Deputy Mayor Don Bell Councillor Lillian McConnell Councillor Ralph Hough Councillor Neil Craig Councillor Ron Sommers Councillor Ruth Fountain Staff Present: Jennifer Zieleniewski, CAO/Treasurer; Debbie Mooney, Tax Collector; Bonita Coons, Special Projects Manager; Andria Leigh, Township Planner Also Present: Basil and Thelma Hogendoorn, Esther McKerroll, Jerry Wilson, Barb Sinton, Linda and Steve Watson, Ian Styles, Martial Forget, G. Robinson, Paul R. Amos, Garry Fell, Don Hanney, Eric Dickins Mayor Ian Beard assumed the chair and called the meeting to order, followed by prayer. 1. "DISCLOSURE OF PECUNIARY INTEREST AND GENERAL NATURE THEREOF - IN ACCORDANCE WITH THE ACT" None. 2. CONSENT AGENDA CORRESPONDENCE: a) Joanna Bowman, Accounting Technician, Skills Canada - Ontario, correspondence re: Advance Lottery Funding. Recommendation: Receive and file. b) City of Orillia, Notice of Public Meeting re: Zoning By-law Amendment, Lots 6, 7 & 8, Conc. 111, South Division, former Township of Orillia, east of Harvie Settlement Road, south of Bass Lake Sideroad, Orillia. Recommendation: Receive and file. c) Township of Springwater, Notice of Public Meeting re: Proposed Amendment to Former Vespra General Zoning By-law No. 83-15. Recommendation: Receive and file. 3. DEPUTATIONS: a) 7:05 p.m. Public Meeting re: Proposed Amendment to Zoning By-law re: Conc. 6, Part of Lot 9 (formerly within the Township of Oro). I Ii II , I I . b) 7:10 p.m. Public Meeting re: Proposed Amendment to Zoning By-law re: Conc. 5, Part of West Half Lot 10 (formerly within the Township of Oro). c) 7:15 p.m. Paul Amos, Warminster Optimist Club, presented Council with a donation to the Warminster Soccer Field. d) 7:20 p.m. Jennifer Zieleniewski, CAO/Treasurer, provided information to Council and the public regarding the Ramifications of Bill 79. 4. COMMUNICATIONS: a) Township of Morris, correspondence re: Program to Provide Financial Assistance for "Rural Water Quality Improvement". b) Township of Centre Wellington, correspondence re: Infrastructure for Bridge Replacement and Repairs. c) County of Elgin, correspondence re: Maintenance and Use of Drainage Ditches. 5. REPORTS OF COMMITTEES: a) Report No. 99-9, Regular Committee of the Whole Meeting held on Wednesday, May 12,1999. b) Minutes of the Oro-Medonte Township CN trail Usage & Design Committee meeting held on Wednesday, April 14, 1999. c) Minutes of the Township of Oro-Medonte Planning Advisory Committee meeting held on Tuesday, May 4, 1999. Motion No.1 Moved by McConnell, Seconded by Hough Be it resolved that the agenda for the Regular Council Meeting dated Wednesday, May 19, 1999, be adopted as printed and circulated. . Carried. 2 Motion No. 3 Moved by Hough, Seconded by McConnell Be it resolved that the recommendations listed on the Consent Agenda, Item 7, be received and adopted. Carried. Motion No.4 Moved by Hough, Seconded by McConnell Be it resolved that the donation toward the Warminster Soccer fields from Paul Amos, President, Optimist International, Warminster be received with thanks. Carried. Motion No. 5 Moved by Bell, Seconded by McConnell Be it resolved that the correspondence from the Township of Morris re: Program to Provide Financial Assistance for "Rural Water Quality Improvement" be received and the resolution of the Township of Morris be endorsed. Carried. Motion No.6 Moved by Hough, Seconded by Bell Be it resolved that the correspondence from the Township of Centre Wellington re: Infrastructure for Bridge Replacement and Repairs be received and the resolution of the Township of Centre Wellington be endorsed. Carried. Motion No. 7 Moved by Hough, Seconded by Bell Be it resolved that the correspondence from the County of Elgin re: Maintenance and Use of Drainage Ditches be received. Carried. Motion No. 8 Moved by Hough, Seconded by McConnell Be it resolved that Report No. 99-9, Minutes of the Regular Committee of the Whole meeting held Wednesday, May 12, 1999 be received and the recommendations therein adopted. Carried. 3 . I Motion No.9 Moved by Hough, Seconded by Bell Be it resolved that the Minutes of the Oro-Medonte Township CN Trail Usage & Design Committee meeting held on Wednesday, April 14, 1999 be received. Carried. Motion No. 10 Moved by Craig, Seconded by Sommers. Be it resolved that the Minutes of the Township of Oro-Medonte Planning Advisory Committee meeting held on Tuesday, May 4, 1999 be received. Carried. Motion No. 11 Moved by Sommers, Seconded by Fountain Be it resolved that Development Application P-79/98 a proposed plan of subdivision proceed to a Public Meeting and further that the applicant should review the following concerns prior to the Public Meeting: Intentions of Blocks 14 and 15 Building, Driveway and Septic Envelope Re-evaluation of Lot Size and density Tree protection inventory and locations. Carried. Motion No. 12 Moved by Fountain, Seconded by Sommers Be it resolved that Development Application P-87/99 a proposed Zoning By-law Amendment not proceed to a Public Meeting and further that the Application be denied. Carried. Motion No. 13 Moved by Craig, Seconded by Fountain Be it resolved that a by-law to provide policy for encroachments on road allowances and municipally owned property be introduced and read a first and second time and numbered By-law No. 1999-50. Carried. Carried. That By-law No. 1999-51 be read a third time and finally passed, be engrossed by the Clerk, signed and sealed by the Mayor. Carried. Motion No. 15 Moved by Craig, Seconded by Sommers Be it resolved that a by-law to authorize a decrease in the speed limit on certain roads within the Township of Oro-Medonte be introduced and read and first and second time and numbered By-law No. 1999-52. Carried. That By-law No. 1999-52 be read a third time and finally passed, be engrossed by the Clerk, signed and sealed by the Mayor. Carried. Motion No. 16 Moved by Fountain, Seconded by Sommers Be it resolved that a By-law to confirm the proceedings of the Regular Council Meeting held on Wednesday, May 19, 1999 be introduced and read a first and second time and numbered By-law No. 1999-53. Carried. That By-law No. 1999-53 be read a third time and finally passed, be engrossed by the Clerk, signed and sealed by the Mayor.
