K .. - COUNCIL CKAKBBRS TWENTIETH MEftING 1994-1997 COUNCIL (P16Lj95) The following members of Council were present: Mayor Ian Beard Councillor Walter Dickie Councillor Don Bell Councillor Neil Craig Councillor Larry Cotton Councillor Ron Sommers Absent: Deputy Mayor Murray Martin staff Present: Gary cunnington, C.A.O., Mark Stagg, Planner, Jennifer Zieleniewski, Treasurer Also Present Were: Marg & Leonard Mortson, Alastair Crawford, Shirley Woodrow, John Hare, Thelma Halfacre. Mayor Ian Beard chaired the meeting. Mayor Ian Beard opened the meeting by explaining to those present that this Public Meeting was to receive public comments with respect to a proposed Zoning By-Law Amendment, under provisions of section 34, of the Planning Act. The applicant has applied to rezone certain lands, Lots 23 & 24, Plan 728, Concession 13, former Township of Oro, to rezone those lands as described to allow the conversion from a seasonal residential use to a permanent residential use, subject to compliance with By-law requirements and Simcoe County District Health Unit or Ministry of the Environment approval of a sewage disposal system. To date, the Council of the Corporation of the Township of Oro- Medonte have not made a decision on this application, other than proceeding to this Public Meeting. only after comments are received from the Public, requested agencies and Township Staff, within the appropriate time period, will Council make a decision on this application. Notice of the Public Meeting was mailed out on April 27, 1995, to all property owners within 120 metres of the subject lands. Mayor Beard then asked the Clerk if there had been any correspondence received on this matter. The Clerk responded by indicating that a letter of concern had been received from Greg Price, owner of Lots 25 & 26, Plan 728 regarding the odour of sewage from the applicants property. The Mayor then stated that those persons present would be afforded the opportunity of asking questions with respect to the proposed Amendment. He then turned the meeting over to the Township Planner, Mr. Mark Stagg, to explain the purpose and effect of the proposed Zoning By-Law Amendment. Mark stagg: Mr. Mayor and members of Counci I, the subj ect property is located in the south east part of Oro Township abutting Lake Simcoe and accessed from the Lakeshore Road between the 13th Concession Line Road and the Townline. " If 8 8 \ - 2 - Mark stagg: The Township has adopted a conversion approach policy which states that conversion from seasonal to permanent residence may occur on lots of a minimum size subject to public health approval for a Class 4 sewage system or a Ministry of Environment approval, as the case may be. The policy requires that the lot have a lot area of 1850 square metres and/or lot frontage of 15 metres. Where the lot can be reduced in size to 1100 square metres if you have got that wide of frontage, except if the Committee of Adjustment or anybody else dealing with it feels that the small lot size would be a problem. The lot in fact has a frontage of 28.9 metres and a lot area of 2868 square metres and therefore conforms to the conversion policies and in that sense, the Planning department would have no further comment. I did have the opportunity of inspecting the property, Mr. Mayor and members of Council. Do wish to have my report on that now or later? Mayor Beard: I would think that we are going to get a report on this in writing in the future at some point or is it verbal. Mark stagg: This is a verbal report, first of all, I would report that the health unit have not yet inspected the property. They have been made aware of the letter that has been received which the Clerk has read out to you. I have seen the property since that letter was received. I personally did not notice a smell but I was smoking my pipe and maybe that was the reason Mr. Mayor. I did notice some water trickling out a bank where the property comes to the lake and that matter I have reported to the health unit and no doubt they would look into it. I return to the Planning Department's comment that it fits the policies but it seems essential in this case that the approval of the health unit be obtained before council, if it so sees fit, proceeds to a final reading of this By-law. There being no further questions or comments, when being called for the third time, the Mayor in closing the meeting, thanked those in attendance for their participation and advised that Council would consider all matters before reaching a decision. He then advised those present that if they wished to be notified of the passing of the proposed By-law, they should leave their name and address with the Clerk.
