NVCA comments are herein presented as advisory in nature as the subject site is outside the NVCA Regulation Limit. Our comments are presented in accordance with the NVCA-Oro-Medonte Memorandum of Understanding to provide expert consultation on Natural Heritage matters. NVCA Recommendation: Approval of this application for consent will facilitate development within a Significant Woodland. NVCA Staff recommend that the application be deferred for additional information to address consistency with Provincial, NVCA and Township Official Plan policy as outlined below. NVCA Planning Advisory Comments: The property is captured within the Simcoe County Greenlands, which is currently the applicable Natural Heritage System for application of Growth Plan policy. Based on NVCA Staff interpretation of the Township Official Plan (OP) schedules, the property is further designated as Core Area within the Oro Moraine. Significant Woodlands are mapped within the Oro Moraine area; a note on the Schedule Corridor Areas and Outliers By way of this note, the property is mapped by the Township Official Plan as Significant Woodland. NVCA Staff note that development is prohibited in Significant Woodlands via the Provincial Policy Statement (Sec. 2.1.4), and that Growth Plan requirements also prohibit development within Key Natural Heritage Features (KNHFs) such as Significant Woodlands (Sec. 4.2.3). NVCA Staff offer additional interpretation of the application to be considered development under PPS definitions: the existing use is residential and the applicant is proposing an agricultural use necessitating an accessory structure, which should be considered a change of use and thereby development as defined in the PPS. Further, NVCA Staff note the lot is an established residentially-used property with no evidence of an existing agricultural use which would necessitate an agricultural structure. In consideration of the use of the property as agricultural; it is not clear how the benefitting land (190 Mill Pond Sideroad) propose to undertake agriculture use as the property area does not meet the 2.0ha minimum size requirement set out in the AG/RU Zone provisions. In effect, this application furthers non-conformity with the minimum lot size requirements for agricultural use, while proposing an agricultural use accessory to residential use, within a Significant Woodland. NVCA Planning Staff maintain that the application does not meet the intent of the PPS, Growth Plan, NVCA or the Township of Oro-Medonte Official Plan policies which prohibit development within Significant Woodlands. Approval of this application may result in creating as-of-right permission to develop within a Significant Woodland and allow a residentially-used property to have an accessory agricultural structure without established agriculture on the lot. NVCA Staff advise that the application should be considered premature until the applicant can demonstrate that the nature of the existing agricultural use which necessitates an accessory structure, and therefore the boundary adjustment. I agree that the newly severed lot does not pose any significant threat to the PSW. The significant threat comes from existing land use (pasturing) and presumed construction of a house and other buildings by the current or future owner on the main property. I am asking that Council request comment from SSEA on how to best protect the PSW. SSEA produced an excellent report on the Horseshoe Valley Craighurst Master Plan Cole submission. The only difference I see is the scale of the two plans. I am also requesting that the $2000.00 cash-in-lieu of parkland collected be given to the SSEA to assist in providing funding for potential fencing. The Township Zoning Map below shows the EP land that needs protecting. The surrounding neighbours are doing their part to protect the PSW. With a little help from Council, the portion on this property can be protected as well. The proposed addition is located within the Regulation Limit and requires permission (a permit) under the Conservation Authorities Act from the NVCA. The proposed addition to the existing agricultural structure is situated within the mapped extent of the flood and erosion natural hazards. Based on available mapping, the application does not appear to be consistent with Section 3.1 of the Provincial Policy Statement or NVCA Planning and Regulations policies. The application also appears not to be minor in nature or consistent with the Township's Official Plan. NVCA staff advises in our regulatory capacity for the applicant to adjust the application to situate the proposed addition outside natural hazard features, which would bring the application into conformity with Township zoning, NVCA and Provincial policy. In our advisory capacity to the Township on Natural Heritage, the NVCA advises that a scoped EIS may be warranted in order to assess the potential impact of this application to the nearby watercourse, as well as any associated tree clearing that may be required. It is also advised that the site is within the Simcoe County Greenlands, and that County planning staff may provide more specific comment on this application.. Please advise the applicant that they may contact me for further detail on the above comments. The application has also been reviewed through our role as a public body under the Planning Act as per our CA Board approved policies. Site Characteristics Existing mapping indicates that the subject property is partially regulated due to the associated shoreline flood and erosion hazards. The hazards are regulated under Ontario Regulation 179/06 under the Conservation Authorities Act. The subject property is currently designated Shoreline in the Township of Oro- The subject property is currently zoned Shoreline Residential (SR) Zone. LSRCA has reviewed the application through our delegated responsibility from the Province to represent provincial interests regarding natural hazards identified in Section 3.1 of the Provincial Policy Statement (PPS). The proposed accessory structure is not within the hazard area and therefore the proposal is consistent with Section 3.2 of the PPS. 2. LSRCA has reviewed the application as per our responsibilities as a regulatory authority under Ontario Regulation 179/06. This regulation, made under Section 28 of the Conservation Authorities Act, enables conservation authorities to regulate development in or adjacent to river or stream valleys, Great Lakes and inland lake shorelines, watercourses, hazardous lands and wetlands. Development taking place on these lands may require permission from the conservation authority to confirm that the control of flooding, erosion, dynamic beaches, pollution or the conservation of land are not affected. LSRCA also regulates the alteration to or interference in any way with a watercourse or wetland. Page 3 of 3 Summary LSRCA is satisfied from a watershed management perspective that the application is consistent with the natural heritage and hazard policies of the PPS, and in conformity with provincial policies and the LSPP. Given the above comments, it is the opinion of the LSRCA that: 1. Consistency with Section 3.1 of the PPS has been demonstrated; 2. Ontario Regulation \[179/06\] applies to the subject site but a permit from LSRCA will not be required prior to any municipal approvals. On this basis, any approval of this application should be subject to the following conditions: 1. The Owner shall provide payment of $500.00 to the LSRCA as per our approved Fee Schedule for review of this Minor Variance application.
