The following provided public comments: Elizabeth Dunn provided opposition comments with respect to the application, the need to protect the environment, the well being of the resident's way of life, presented background rural and history information, wildlife and rural haven comments, application is not minor and not a small business, setting a dangerous precedent, significantly impacting the residents, website/class/time schedule concerns, business not appropriate in this location, traffic and noise concerns, size of yoga studio, photo of elevation and drawing concerns, housing of tractor in the building concerns, future and long term intentions, potential magnification of the use of Copeland Forest, following the proper process, no input from NVCA to date, and the rural area being exploited for financial gain. Marcia Boldt provided opposition comments with respect to preserving the quiet residential area, their application 20 years ago through the Township and following the proper process, not objecting to a family home but objecting to a business in a quiet rural area, application is not minor (5x higher and 3x higher), traffic concerns, negative impact on preservation of Copeland Forest, concern to everyone's quiet lifestyle, what will future area be used for, will a family dwelling be built at all, second home agreement concerns, no stipulation of a family dwelling to be build, use of second storey concerns and building of the family dwelling should be done first. Brennan MacKenzie provided opposition comments, the process he went through with NVCA before taking occupancy, the need to go through proper channels to satisfy all organizations, the need for an invested community interest, future property owner concerns, and future zoning/uses, an application, once done through the proper channels will set the guidelines on the lot in the future and properly addresses policies, would like Article 5.12, timing of construction, to allow appropriate time to do studies and ensure application is not a commercial gain in a residential area. Virginia Gingras provided comments of her previous yoga studio, has received no complaints, the right to run a home occupation/yoga studio, number of classes, caring about Page 6 of 17 Development Services Committee Meeting Minutes — Wednesday, March 4, 2020. the Copeland Forest, importance of the environment, the preference to live in a small dwelling with an accessory building for a yoga studio. Patricia Meller-Roach provided opposition comments with respect to the number of variances, the importance to follow the rules and have a home first and established followed by the commercial business, the impact on the residents, number of sessions seven days a week, increased traffic all week, the use and topography of Line 5, seasonal use of Line 5, increased snowmobile and vehicle accidents, dangerous turning with the increased traffic and potential accidents, road not set up for increased activity and the need to follow the rules, size and future use of building after the home is built. Robin Stoer provided opposition comments and the need to adhering to the rules and provincial policies from the County of Simcoe and the Nottawasaga Valley Conservation Authority, agreed to all the previous comments, before making an informed decision the need to have all the factual information first. Tom Stoer provided comments that he would have preferred to proceed with his application in this manner, everyone should have to follow the same rules, the application is excessive and overboard (5x the size). Jessica Roach questioned the type of equipment that is in to be the building, existing business already has the platforms in place, the use of Copeland Forest for commercial gain, increased traffic, her driveway is on a hill with potential dangerous turning, young children and animals on the road. That DS2020-18, Catherine McLean, Planner re: Minor Variance Application 2020- A-04, Virginia & Raymond Gingras, 3626 Line 5 North be received and adopted. 2. That Minor Variance Application 2020-A-04 by Virginia & Raymond Gingras, specifically for permission to build a two -storey accessory building with a temporary dwelling unit on the second floor, prior to the construction of the main dwelling and with an increase in height and floor area on the lands municipally known as 3626 Line 5 North, Township of Oro-Medonte, be deferred to provide the applicants time to obtain an Environmental Impact Study to determine whether the proposed development will have an impact on the key natural heritage features in accordance with the policies set out in the PPS, 'A Place to Grow: Growth Plan for the Greater Golden Horseshoe' (2019), County and Township Official Plans, and as recommended by the Nottawasaga Valley Conservation Authority. 3. That Minor Variance Application 2020-A-04 by Virginia & Raymond Gingras, specifically for permission to build a two -storey accessory building with a temporary dwelling unit on the second floor, prior to the construction of the main dwelling and with an increase in height and floor area on the lands municipally known as 3626 Line 5 North, Township of Oro-Medonte, be approved for the reasons that the general purpose and intent of Provincial Natural Heritage policies will be maintained subject to the following conditions: 3. The following provided public comments: Keith Graham, on behalf of local neighbouring property owners, provided opposition comments with respect to the size of the business, the number of trucks/vehicles consistently parked at location, state of property, there is no agricultural use/vehicles, no farm equipment, only a corporate entity, website advertising concerns, the number of loads, process is all done outside and not in the building, vehicles with signage, number of delivery trucks/people coming and going, noise concerns, lights from traffic concerns, NVCA inconsistencies, diesel refueling beside an environmental area, trucks are parked beside a stream, believes it is a commercial use, believes would not get a permit from the County of Simcoe, traffic/dangerous blind turning area, potential accidents with trailers pulling out, NVCA having no knowledge it was not being used for agricultural use, loss of property value. Jim Drury provided opposition comments of the abuse of agricultural lands and the same concerns as Keith Graham. That Zoning By-law Amendment Application 2019-ZBA-22, that would rezone the subject lands from the General Commercial (GC) Zone and Agricultural/Rural (A/RU) Zone to General Commercial Exception 314 Hold (GC"314(H)) and Environmental Protection (EP) Zone, be approved. 3. That the required Holding (H) Provision not be removed from the zoning of the subject lands until such time as the appropriate Site Plan is approved by the Township, the related Site Plan Agreement is registered and the Township has received the securities identified in the Site Plan Agreement. 4.
