2020-040 By-law to Stop Up and Close Portions of a Highway (Horseshoe Blvd, Part 19 Plan 51R-40713) To Authorize Land Exchange With Skyline and to Establish Part 24, 51R-40713, Part 1, 51R-42363 as Public HwyThe Corporation of the Township of Oro-Medonte By -Law No. 2020 — 040 A By -Law To Stop Up and Close Portions of a Highway (Horseshoe Boulevard, Part 19 Plan 51 R-40713) To Authorize Land Exchange With Skyline and to Establish Part 24, 51 R-40713 And Part 1, 51 R-42363 as a Public Highway Whereas pursuant to Section 27 and 34 of the Municipal Act, S.O. 2001, c. 25, as amended, a municipality is given authority to pass a by-law permanently closing highways that are under the municipality's jurisdiction; And Whereas Horseshoe Boulevard is a public highway under the jurisdiction of this Municipality; And Whereas the Council of the Township of Oro-Medonte did approve a land exchange on August 12, 2015 through motion C150812-16; And Whereas the Township will be acquiring lands described as Part 24, 51 R-40713 and Part 1, 51 R-42363 for the purposes of road widening in exchange for an existing portion of Horseshoe Boulevard described as Part 19, 51 R-40713; And Whereas the permanent closure of Part 19, 51 R-40713 is exempt from the requirement to give notice of such surplus and closure and from the requirement for a valuation pursuant to By-law 2012-112; Now Therefore the Council of The Township of Oro-Medonte hereby enacts as follows: Stop Up and Close - This Council does hereby stop up and close the lands described as Part 19, 51 R-40713 being part of Horseshoe Boulevard. 2. Surplus Land — Part 19, 51 R-40713 is hereby declared surplus. 3. Authorization for Exchange — This Council does hereby authorize the exchange of Part 19, 51 R-40713 for the lands described as Part 24, 51 R-40713 and Part 1, 51 R- 42363 for the purposes of road widening. 4. Execution of Documents — a) If Paper Registration -The Mayor and the Deputy Clerk are hereby authorized to execute all documents for paper registration (including public utility easements, if any) in connection with the closing and subsequent transfer of title to the lands described in section 2. b) If Electronic Registration -The Deputy Clerk is hereby authorized for or on behalf of the Municipality to execute, for the Municipal Solicitor an "Acknowledgment and Direction" authorizing the Municipal Solicitor to complete the Electronic Registration for any required easements, and the subsequent transfer of title relating to the lands described in section 2. Establishment as Public Highway - Upon the registration of the transfer of Part 24, 51 R-40713 and Part 1, 51 R-42363 and upon the registration of this by-law upon the title thereof, the foregoing lands are established as a portion of the public highways known as Horseshoe Boulevard and Birch Grove Drive.
