The changes are recognized to permit the expansion of the existing commercial land use, and protect a remnant unevaluated wetland. The Provincial Policy Statement (PPS) and Growth Plan for the Greater Golden Horseshoe direct the protection of natural heritage features for the long term, and stipulate that development and site alteration shall not be permitted in significant wetlands, and only through evaluation and demonstration of no negative impacts on the natural features or their ecological functions may development or site alteration be permitted on adjacent lands. The County Greenlands designation serves as the provincial mapping of the Natural Heritage System for the Growth Plan. The Simcoe County Official Plan (SCOP) designates the parcel as Rural and Greenlands, which the Township Official Plan replicates with a Commercial and Environmental Protection One designation. SCOP Rural policies allow for other rural land uses including commercial uses. SCOP (Section 3.8.16), establishes that legally existing uses within the Greenlands system will be recognized and can continue in accordance with Sections 3.3.15 and 4.11.6 of this Plan and the applicable policies of the local municipal official plan. County policies (Section 3.3.15) require an evaluation and the demonstration that no negative impacts on the natural feature or their ecological functions will occur within significant wetlands or on adjacent lands. This County requirement follows the Provincial Policy Statement (PPS 2.1.8) and Growth Plan (4.2.4.1) for development on and adjacent to key natural heritage features (Dalston Provincially Significant Wetland). Review and acceptance of the Natural Impact Study (Birks Natural Heritage Consultants Dec. 19, 2019) assessment and recommendations by the Nottawasaga Valley Conservation Authority (NVCA) will address requirements of provincial and county policies. The proposed lot to be severed features sloping topography associated with the banks of a tributary of the Hog River which runs west-east through the retained property. The plans submitted indicate the proposed rear lot line of the severed parcel would cross through the watercourse. NVCA Planning and Regulation Guidelines apply a 30m regulation limit on this watercourse. Based on available topographic information, the area surrounding this reach of the watercourse is characterized by sloping topography and steep, potentially unstable valley slopes which the NVCA regulates as a Slope Erosion Natural Hazard. This Natural Hazard passes through the proposed new lot. NVCA Regulatory Comments: The NVCA advises that it is the responsibility of the applicant to demonstrate that there is a feasible developable envelope on the property, including the severed lot that is not affected by Natural Hazards and that the control of erosion and conservation of land would not be affected by development of the new lot. At this time the NVCA requires additional information to evaluate the feasibility given the natural environment features present. The NVCA has a mapped slope erosion hazard on the proposed new lot. To further assess this feature, the preparation of a Natural Hazard study is required prior to NVCA providing support to this application or any future development. Natural Hazard planning policies (NVCA and PPS) explicitly prohibit development (including lot creation) within Natural Hazard features. The application proposes developmentwithin a mapped Natural Hazard Slope Erosion feature and does not appear to conform to NVCA and PPS policies in this regard. O.Reg. 172/06: NVCA advises that the severed lot as proposed would be significantly affected by Ontario Regulation 172/06. A permit from NVCA would be required prior to any future development proposed on the severed parcel. Please be advised that NVCA Planning and Regulations Guidelines state that development is not permitted within 30m of watercourses or within the Erosion Hazard of a watercourse valley slope. It is NVCA staff opinion that this application does not conform to NVCA Planning and Regulations Guidelines and the Committee should be advised that based on available information, the NVCA does not believe there is a viable development envelope for which the NVCA may authorize permission to develop on the proposed new lot. NVCA Advisory Comments: Within the context of Provincial Growth Plan policy, the Hog River is considered to be a Key Hydrologic Feature; it extends from and beyond the subject site into lands designated as natural heritage system (Greenlands) by the Simcoe County Official Plan. We note that recent transition guidance from the Province dictates that the upper-tier Greenlands designation is the governing Natural Heritage System in which the Growth Plan Natural Heritage policies apply. Based on the watercourse being considered a Key Hydrologic Feature, Growth Plan policy 4.3.4 Lands adjacent to key hydrologic features and key natural heritage features is applicable to this application. This policy stipulates a minimum 30m Vegetation Protection Zone (VPZ) from the outside boundary of the watercourse which is free of development. lot creation per PPS definitions, indicating that the proposed lot lines shall not extend within 30m of the watercourse feature. We note that the policy also states in section 4.2.4.c) that a Natural Heritage Evaluation is not required for applications within 120m of the Key Hydrologic Feature if the proposed use is agriculture-related; therefore the provision of the minimum 30m VPZ would suffice for the proposed hobby farm to conform to this policy. The existing stream is currently subject to severe erosion and the sediment is either deposited on the adjacent property (1305) or carried to the Hogg Creek contributing to sedimentation and nutrient loading. This property (1305) is under a Conservation Easement held by Couchiching Conservancy for environmental protection. By creating a lot which will potentially hold multiple animals it will directly contribute to nutrient loading in Hogg Creek and subsequently Severn Sound. SSEA and NVCA have policies of restricting livestock from watercourses to reduce nutrient loading. Rather than restricting animals FROM the watercourse, creating this small lot as a hobby farm would effectively restrict animals TO the watercourse adding to nutrient loading. Conservancy policy directs that we do not become involved in land-use issues unless the situation has the potential to directly affect a property under our protection. The Conservancy holds a Conservation Easement Agreement with the adjacent landowner Lynn Melnyk. The conservation values of the Melnyk property have been recognized as Ecologically Sensitive through the Ecological Gifts Program of The Ministry of Environment and Climate Change Canada. The conservation values of the Melnyk property including the headwaters of Hogg Creek -- could be negatively affected by the changes proposed in the application. We are concerned about potential nutrient-loading into the stream on the property. Much of the proposed lot is currently zoned Environmental Protection (EP) and when a 30-meter buffer from the EP zoning is taken into consideration virtually the entire lot is encumbered. The Conservancy is concerned that severances promoting lot fragmentation which facilitate additional building lots are a major threat to the broad ecological integrity of the township. We would hope that both the Nottawasaga Valley Conservation Authority and the Severn Sound Environmental Association would be consulted as to the potential ecological impact that could occur should this application be approved. We respectfully request the township uphold existing zoning and reject the application.
